Delighted to have met with Dato’ Seri Mohd Hishamudin Yunus physically amidst his busy schedules! As a former Court of Appeal Judge and the current Chairman of the Competition Commission of Malaysia (MyCC), his time is undoubtedly precious. Despite his esteemed background, he still graciously carved out time to engage with me (just a pupil at RDS Partnership) in a short but meaningful dialogue with warmth and openness, embodying true mentorship qualities. During our encounter, we briefly touched upon a rather intriguing negligence case that I recently came across. I am immensely grateful for his generosity in sharing his time and insights with me during our conversation. In Koperasi Sahabat Amanah Ikhtiar Bhd v RHB Investment Bank Bhd [2002] 6 MLJ 722, I initially found myself in total agreement with the decision of the High Court. That was before I read through the Court of Appeal’s reasoning and found myself convinced otherwise. The Court of Appeal found that the defendant did owe a duty of care to the plaintiff, in absence a contractual relationship, based on negligence law principles. This case emphasises the importance of the threefold test (foreseeability, proximity, and policy considerations), as established in Caparo Industries case and the other Malaysian cases.
