I am sure my Spanish lawyers contacts will be interested in watching English barristers arguing the issue! 12 King's Bench Walk Deka Chambers Beyond Spanish law, this will be an important decision for all cross-border personal injury practitionners on the question of whether penalty interest under a foreign law (which is applicable under Rome II in a case brought in an English court) is a question of procedure or substantive law, and if it is a question of procedure, whether the English judge can exercise its discretion to apply the foreign provisions. This decision will most likely have a wider impact on how English courts will deal with other foreign provisions on penality interest, such as the French Insurance code articles imposing sanctions on motor insurers who do not make offers within the required timescale.
