Here's a new mantra for the cannabis industry: A regulation is not a roadblock. There is an inherent tension between operators looking to test boundaries and attorneys who are supposed to act as guardrails. It's very easy to Just Say No (no pun intended), but success rolls in when you get creative. Don't just read what's on the page. Look at what isn't on the page. Understand the intent. It is a half step in the right direction as it pertains to public policy but will still fail in commercial implementation. Marijuana is a multi-billion dollar industry as it currently exists and re-scheduling marijuana from I to III still will not fit the the current industry commercial models. The industry just isn't going to shift to an RX pharmacy model. The end result will still be marijuana possession and distribution is illegal on a federal level but legal on a state level. The benefits to rescheduling would be the federal criminal penalty reductions. Great for those facing federal marijuana criminal charges. Irrelevant to everyone else.
