At Clean Start Africa, we are committed to addressing this issue by advocating for alternative justice approaches that not only alleviate overcrowding but also promote rehabilitation and reintegration. We urge the adoption of non-custodial sentences, probation, and aftercare services, especially for petty offenders! These alternatives provide a more humane and effective way to support those who find themselves on the wrong side of the law. By focusing on restorative justice and community-based solutions, we can help individuals rebuild their lives without overburdening our prison system. Our goal is to work hand in hand with the criminal justice system, supporting initiatives that uphold the dignity of every individual while ensuring public safety. Together, we can create a justice system that truly reflects the values of fairness and second chances, turning prisons into places of transformation rather than mere punishment. Will rehabilitation take centre stage? Hopefully employers will be incentivised to hire people who have a criminal record and we will finally see less prison sentences and more work on rehabilitation. Studies have shown that community sentences with purposeful activity, and stable accommodation is what helps to reduce reoffending. Today the Federal Attorney General, Mark Dreyfus, and all State Attorneys-General, will meet to discuss the age of criminal responsibility. Australia does not have a uniform approach across all States and Territories when it comes to determining under law at what age children have the mental capacity to be criminally responsible. In some states (including NSW) children as young as 10 can be arrested, convicted and incarcerated.     There is strong medical, educational and psychiatric and psychological consensus that children under the age of 14 are undergoing significant growth and development including important cognitive and neurological changes, such as the maturation of the brain and the establishment of neural connections. Emotional and social development are crucial aspects as well, with children learning to navigate relationships, develop empathy, and understand social norms.    There is substantial evidence supporting the fact that children in the criminal legal system often face a range of neurocognitive impairments, trauma, and mental health issues. Numerous studies have shown that a significant proportion of young people in detention centres have experienced adverse childhood experiences, including trauma, abuse, and neglect.    In Canada, Ireland and Scotland the minimum age is 12, in New Zealand it is 14 and in Denmark it is 15. The United Nations Committee on the Rights of the Child has consistently said that countries should be working towards a minimum criminal responsibility age of 14 years or older.    The #RaiseTheAge campaign, of which I am a strong supporter, seeks to raise the age across Australia to 14. Prisons are unsafe for women, and many women shouldn’t be there in the first place. Most women are imprisoned for non-violent crimes, often serving less than six months for offences like shoplifting. The Nebraska Examiner cited a study by the UNO Nebraska Center for Justice Research, released in February, which concluded that “only a small minority of programs” run by Nebraska corrections to turn inmates into law-abiding citizens were evidence-based.
