On 14th May the Scottish Parliament approved the Housing (Cladding Remediation) (Scotland) Bill, which gives Scottish ministers new power to directly commission remediation work dangerous cladding without the property owners’ permission. The new legislation has the potential to impact many property owners and developers, with 105 buildings identified as needing remediation and new requirements set out for all property developers in Scotland. NATIONAL ROLL-OUT | Following a successful pilot in 2020, the Priority Property Pool (or "PPP500") case management framework has now been rolled out to all Federal Circuit and Family Court Registries in Australia. Our readers may already be familiar with the PPP500 pilot, which aimed to streamline case management where: - the asset pool of the parties (excluding superannuation) was less than $550,000 (formerly $500,000); or - the asset pool was not significantly greater than $550,000, but one party had special vulnerabilities (such as family violence, or subject to coercive control). Now available across Australia, the PPP500 will assist parties with judges closely monitoring compliance with court orders, reducing delays, requiring fewer court appearances, facilitating further opportunities for early dispute resolution, and providing proactive referrals. The Australian Institute of Family Studies (AIFS) concluded that, in addition to saved time and costs, the PPP500 has also assisted in lowering stress and anxiety, and has generally improved the emotional wellbeing of parties. Chief Justice Alstergren similarly praised the program, citing high costs and the threat of extensive interaction with an abusive party as identifiable issues disadvantaging vulnerable parties at Court.
