Worth reading this piece by Richard Smith, managing director of the Road Haulage Association (RHA), writing in The Law Gazette, especially for those critics of litigation funding who are fortunate enough to have never been victims of wrongdoing or can afford to access justice. The sad reality is well-resourced defendants tactically use their financial muscle to outspend claimants to stifle meritorious claims, like the £24m spent by the Post Office just on disclosure in the Bates case. Quick update on the below. Recently, the UK Government blocked the attempt to amend the Digital Markets, Competition and Consumers Bill so as to negate the effect of Paccar, on the basis that the issue was outside the scope of that item of legislation. However, particularly in light of the recent sub-postmasters' case against the Post Office, the government appears to recognise the need to reverse Paccar and facilitate the access to justice provided by litigation funders. Justice Secretary Alex Chalk has said that "at the first legislative opportunity" the government plans to reverse the "damaging effects" of Paccar. Claim value is a powerful dimension for examining performance in the market, and when considering claims over £1 million as a benchmark, Clyde & Co top this list too. HFW emerged in second after a very busy year, almost tripling their volume of higher value cases. Kennedys, Weightmans, and Morgan, Lewis & Bockius LLP are closely positioned, with DAC Beachcroft, Shoosmiths and RPC- law firm following. Dechert LLP is the defendant firm in several Russo-Ukrainian war disputes, which has seen its high value work increase threefold. Pinsent Masons feature, as do Herbert Smith Freehills, CMS UK, Quinn Emanuel and Mishcon de Reya LLP. Bird & Bird and Addleshaw Goddard have also been involved in high value disputes. What is the status of the Roundup Mass Tort? My top Mass Tort for 2024 is off an running with a jury trial already underway in the best city in the world, Philadelphia. The past two Philly juries returned verdicts of $3.5 Million and $175 Million. I am predicting another Plaintiff verdict, likely the first week of February. Much of the RU litigation is now focused in Missouri state court where over 19,000 cases are pending. Expect a total of 6 jury verdicts before the end summer. If Plaintiff's come out with a 4-2 split, I predict inventory settlements to follow and the litigation to finally start to wrap up.
