I'm working with a pickleball group to open up their own site. Which means we've been creative in finding the clear height indoors we need for a court, like checking out warehouses with 20'+ ceilings... Sometimes that takes you outside the boundaries of "recreational" zoned areas. What do you do then? You get a Conditional Use Permit/Zoning Change. Sounds easy right? 😅 NO. Fremont required we rezone the entire building and estimated it would be $10 a SqFt. For the ~20,000 SqFt building 🏢 we were looking at, that would be $200,000 up front JUST to change the zoning! Nevermind the $40,000 a month lease you signed... San Jose has a 3-9 month back-log of permitting, so on top of the ~$15,000 application fee, you might not even get approved 9 months after submitting for the Conditional Use Permit! Which means the lease you signed, and have been paying for some months now for an inoperable space, better have a termination right in there because you were denied the use... Business is hard.
