The EPA's final regulatory text for methane monitoring is here. And it brings some interesting insights for operators. As others have noted, the rule offers a lot of flexibility in favor of advanced methane monitoring technologies! Here's a brief overview from a LongPath continuous monitoring standpoint... 👉 Flexible Pathways: Operators can choose between traditional OGI, Periodic Screening and Continuous Monitoring Screening, each with pros and cons. But there are workable solutions for all production and compressor site types that favor operators who want to use advanced monitoring. 👉 Continuous Monitoring Screening: The rule specifies action levels for rapid find-and-fix as well as long-term stability of emissions. While this largely mirrors the supplemental proposal, EPA clarified / amended several key details underlying the continuous monitoring work practice. Most notably, baseline emissions are now properly accounted for. 👉 Freedom in Investigation: Remarkably, there are no prescribed investigative analysis requirements for continuous monitoring. Operators have the freedom to investigate and correct emissions above the action threshold as they see fit. In this way, continuous monitoring is strongly incentivized for operator use by offering less prescriptive follow-up requirements than the other options. The proof is in the pudding as they say! 👉 Certification Standards: To be certified as a continuous monitoring solution, a minimum detection limit and a valid quantified mass emission rate (or "equivalent") must be demonstrated. For those who meet these standards, flexibility in emissions control is easily attainable across site types. 👉 Periodic Screening with Continuous Monitors: Continuous monitors can also be used for compliance with periodic screening provisions. This flexibility allows operators to “mix and match”, combining the best of both worlds where different needs arise. 👉 Effective Compliance Date: The final rule is expected to hit the Federal Register in January, setting the effective compliance date 60 days later. Alternative technologies will likely start putting in applications in early Spring for use in 2025 (maybe sooner?). We'll continue to analyze the rule and provide more updates. Super Emitters: What are they and why are they important?   Did you know that a small number of sources are responsible for a significant percentage of methane emissions? They're called "Super Emitters". These emissions impact our environment and air quality.   In December 2023, the U.S. Environmental Protection Agency (EPA) finalized the rules for OOOOb and OOOOc for the oil and natural gas industry, aiming to reduce methane and other harmful air pollution from both new and existing operations. The new rule defines the super emitter program, and how it will operate.   The key points of this program include:   1. Defining Super Emitters: The EPA defines super-emitting events as emissions of 100 kilograms of methane per hour or more, primarily at specific sites like well sites, production facilities, compressor stations, or processing plants. 2. Leveraging Technology: The program relies on expertise and data from regulatory agencies or approved third parties with access to remote methane detection technology. 3. Notification Process: Approved notifiers, which can be technology vendors, industry experts, researchers, or non-profit organizations, will inform the EPA who will then assess the leak and then notify facility owners and operators. 4. Investigative Analysis: Upon notification, owners and operators must conduct an analysis and take corrective actions to eliminate the emissions source within pre-defined timeframes. 5. Transparency: The EPA will maintain a document repository with notices to operators and reports submitted by owners and operators. Is third party monitoring of methane emissions a bad thing? This article from BW Energy Law sends a cautionary flag up regarding recent efforts by third parties to detect methane emissions. They express concerns that their ability to detect emissions at lower and lower concentrations could lead to 'regulatory creep' whereby these third parties cause regulators to lower their emissions requirements. I hadn't considered this impact, but I still feel that sunlight is the best disinfectant and credible third party monitoring will help all parties in the long run. EU methane regulations prompt emissions reduction technology advancements The EU reached a provisional agreement in November 2023 on a new regulation on methane emissions reduction in the energy industry. The regulation was first proposed in December 2021, following the adoption of the EU Methane Strategy in 2020. The currect regulation includes but is not limited to the following measures, which have been put in place to minimize the release of methane in fossil fuel operations within the EU: 🔹 Mandatory measurement, reporting and verification requirements for emissions at the source level, including for non-operated assets 🔹 Mandatory leak detection and repair of equipment for all oil and gas facilities 🔹 Ban of routine venting and flaring in the oil and gas sectors and the restriction of non-routine venting and flaring to unavoidable circumstances 🔹 Obligation for oil, gas and coal sectors to complete inventory, emissions monitoring and mitigation plans for closed, inactive, plugged and abandoned assets 🔹 Limitation of venting from thermal coal mines starting in 2027, with tighter restrictions from 2031.
