Nokia announced it has signed a multi-year patent cross-license agreement with OPPO. Under the agreement OPPO will make royalty payments, along with catch-up payments to cover the periods of non-payment. The agreement resolves all pending patent litigation between the parties, in all jurisdictions. #Nokia’s industry-leading #patent portfolio is built on more than €140 billion invested in R&D since 2000 and is composed of around 20,000 patent families, including over 6,000 patent families declared essential to #5G. Nokia contributes its inventions to open standards in return for the right to license them on fair, reasonable and non-discriminatory (FRAND) terms. Nokia and vivo sign cross-license 5G patent deal, resolve dispute Nokia and vivo have officially resolved their patent dispute by signing a new cross-license agreement covering fundamental inventions in cellular technologies. The agreement puts an end to the prolonged legal conflicts between the two companies across various jurisdictions regarding patent payments. Oppo has issued a press release following the Chongqing FRAND rate ruling in its dispute with Nokia. It confirms it accepts the decision and says it hopes the Finnish company will do the same. Notably, it emphasises what it sees as the strength of its own SEP portfolio, suggesting (to me at least) that this is a significant bone of contention in the overall dispute. Having seen the statements from both companies now, I suspect this one still has a bit left to run - although Nokia now knows that it is going to get something whatever happens. Is there a bridge to build between this decision in China and what may happen further down the line in India that will solve things? Is there a route for Nokia to higher courts in China to see what they think and is this an option the company would want to pursue? So many questions!! Expanding to the next range of our Case Analysis Series, we present the concept of Standard Essential Patents (SEPs). In the words of Joel Cohen: A standard essential patent (or "SEPs") is a patent that, as the name suggests, is intended to protect an industry standard. Examples include USB, Wi-Fi, and JPEG. The same technology was protected by the Nokia Technologies Oy for their advanced models. But question is whether such grant of protection restricts incorporation of the said technology by others in their models. The answer to this is in the a recent judgment in the matter of Nokia Technologies Oy vs Guangdong Oppo Mobile,2022. Nokia alleged that Oppo had infringed on its standard essential patents (SEPs) related to 4G and 5G technologies, crucial for modern telecommunications. The case was heard in the Delhi High Court and was part of a broader international dispute concerning the use of Nokia’s patented technologies in Oppo’s products. In 2022, the Delhi High Court upheld Nokia’s claims of patent infringement by Oppo, recognizing the validity of Nokia’s standard-essential patents (SEPs) related to 4G and 5G technology. The court issued an interim injunction preventing Oppo from selling infringing products in India and emphasized the need for fair, reasonable, and non-discriminatory (FRAND) licensing negotiations. Both parties were ordered to engage in good faith negotiations to reach a licensing agreement, with the court underscoring the importance of protecting patent rights while ensuring fair competition. The judgment highlighted the protection of patent holders’ rights while promoting fair competition and reasonable licensing practices in the rapidly evolving tech industry.
