Most employers should start planning now for the proposed $55,000 overtime rule/exempt salary rate increase. At the very least, an audit of the pay structure for each job position is in order (and we always recommend that every couple of years anyway).

The U.S. Department of Labor will propose an increase of the minimum salary threshold for overtime eligibility under the Fair Labor Standards Act to $1,059 per week, or $55,068 per year, the agency announced Wednesday. The proposal outlines an automatic update provision for future overtime thresholds beyond what is included in the proposed rule and would not make changes to the #FLSA’s “duties test” for determining overtime eligibility. #labor #regulation #overtime

Another huge change was announced from the DOL that moves the salaried exempt threshold from the current $35,568 to $43,888 as of July 1st and $58,656 as of January 1, 2025. Employees will not be exempt from overtime if they are not paid these significantly higher values. I expect legal challenges to this ruling which may halt the deadlines above, but now is a great time to take a close look at worker classification.
