Woah, Epic Games beating Google is a big deal. As someone who once led global marketing for Google Play Games and Apps, I see this having a ripple effect and lasting implications for mobile gaming. Here are some key takeaways from the verdict: - Google's dominance in app distribution through the Play Store has been challenged. Whether you agree or not, the court has recognized that Google's 30% commission on in-app purchases and mandatory use of its billing system stifle competition and harm developers. - The door has been cracked open for alternative app stores and payment methods. Potentially leading to greater diversity and choice for both developers and users. A prime example/use case for this is within the burgeoning Web3 gaming space where you have games like Axie Infinity side loading apps onto Android and incorporating blockchain payments. Expect a whole new crop of games in this space to follow suit. - I see this leading to a renaissance in Mobile gaming as it becomes more open and competitive. What a busy day Thursday always is in the #legalandregulatoryaffairs space. Today has been no different! Here's what I've been looking at: We learned that Epic Games Tim Sweeney will give evidence at the 16-week court showdown starting next week - but Sweeney won't appear in the witness box for a little while. For its part, Apple will have witnesses focusing on matters including privacy and finance - with at least 1 new witness since the US court matter. Google VP of Government Affairs and Public Policy Wilson White laid out some of the company's arguments on a "thriving and competitive" mobile ecosystem in Australia ahead of next week's kick off. 💰ASIC has been left considering whether to appeal the judgment in its Federal Court case against Finder Wallet, after Federal Court of Australia Judge Brigitte Markovic dismissed the regulator's case, finding the the Finder Earner product was not a debencher and didn't face financial services licensing requirements. The regulator is now one win and one loss down in its #cryptoenforcement efforts currently before the courts. Where does this leave the regulator? Should we expect a pivot in focus, is this the necessary clarity on a narrow issue? I continue to find it utterly bizarre that while agencies on both sides of the Atlantic apply increasingly close antitrust scrutiny to the activities of BigTech companies, they give those same businesses everything they want when it comes to hollowing out the patent system. If regulators and policy makers took a step back, they would see similar patterns in both areas. The motives that drive anti-competitive behaviour are the same as those that underpin advocacy to weaken the enforcement of patent rights - a desire to concentrate ever greater market power and wealth in the hands of those who already possess far more of both than anyone else. Maybe one day the dots will be connected but until that happens much of the antitrust scrutiny BigTech companies now face will be rendered meaningless by what they gain from the weakening of other people's IP. Those with deep pockets will pay billions of dollars or euros in fines all day long if they get carte blanche to co-opt third party inventions with next to no risk.
