There has been a global rise in climate lawsuits, with recent cases involving greenwashing lawsuits against several companies in the U.S., UK, and Australia, wildfire compensation lawsuits against multiple plantations in Indonesia, renewable energy law violation lawsuit against a state grid corporation in China, and many more. While some lawsuits like the Youth vs. Montana judgment affirming Montanana youth's right to a clean and healthful environment have been impactful, most climate lawsuits haven't had much success. Although the rise in climate litigation hasn't achieved much legal gain yet, there has been a tremendous social value gain. Specifically in being able to push the issue of our climate crisis to the forefront of public and policy discussions and reframing the discussion around justice and equity. One of the most valuable outcomes of these climate lawsuits is what comes out during discovery.* Findings related to what companies contributing to the climate crisis have known about the crisis and what they have done to mischaracterize these facts add to public knowledge. These findings and climate lawsuits, in general, add to public knowledge and strengthen future litigation. One of the most important things achieved by the Youth Vs Montana judgment is that it will influence how judges approach similar cases in other states and encourage more youth to sue their governments for not protecting their right to a clean environment. Some litigations can be more effective in certain political systems than others, and these climate lawsuits influence how others approach climate litigation in different countries.
