A conversation came to mind this morning that I had with the owner of a high-end pool construction company during a Ocala Metro Chamber & Economic Partnership event. Their typical install ranges from $500,000 to $1.5 million. The topic was about bidding and the prospect's reaction from being the middle to highest bidder. The common reaction is “why is the price high”, but his question back is “why are the other prices so low? What are the others leaving off? Less material, less labor, less skill, less guarentees, longer lead times, or add ons to be tacked on later in the project? The question “what is being left out” is a valid question for a managed service provider to ask their prospects.

So here we are, dealing with the rising diesel prices. What will be the effect on public projects, private projects, and housing projects? 1. There will be an increase in the cost of delivering construction materials, which will cause the overall project cost to rise. 2. The cost of operating construction machinery such as cranes, excavators, bulldozers, etc., will also increase, leading to higher project costs. 3. Contractors' operating cash flow will be impacted, especially for those who are not recipients of targeted subsidies. 4. Projects will experience losses, and project owners (especially in private projects such as housing) are exposed to the risk of abandoned projects if their contractors are not prepared to bear the additional costs. 😀 Mahanom Mohammad

Time at Large vs Constructive Acceleration In construction contracts, if an owner is obligated to extend the completion date due to excusable delays (often caused by the owner), the contractor has the right to a timely determination of this extension, allowing them to plan their work accordingly. A significant delay in granting the extension can lead to a situation known as "time at large." When time is considered "at large," it means the contractor is no longer bound to complete the work by a specific date but must do so within a reasonable timeframe. This scenario was exemplified in the Hawl-Mac Construction Ltd v Campbell River case, where a delay caused by the owner's engineer resulted in a delayed extension, leading to the conclusion that time was at large and liquidated damages provisions couldn't be enforced. Additionally, delays in granting extensions may lead to a claim for constructive acceleration. Constructive acceleration occurs when the contractor is compelled to accelerate its work due to owner-caused delays, even without owner-directed acceleration. In cases like Morrison-Knudsen Company v BC Hydro & Power Authority, if the owner refuses to extend the time in clear cases of owner-caused delays, the contractor remains bound to the original contract dates.
