New lawyers can never learn courtroom skills if they’re never given a chance. Law.com reported that it’s getting harder and harder for young attorneys to get in-court experience. How do we fix this? Here are my thoughts: One: Judges need to stop cancelling hearings. In ERISA cases, there generally are no trials, so most of our cases are decided on the briefs. The only time the attorney really gets to be heard in court is if the judge holds a hearing on the motion. Time and time again, though, we’re seeing judges cancel motion hearings. Young attorneys can’t get court experience if there’s never an opportunity to appear in court. Two: Stop infantilizing your associates. I’ve got friends who have been practicing as long or longer than I have, but who have been given far less opportunities to spread their wings. Coach your associates, don’t stifle them.
