More Layoffs Coming in Insurance Industry Without Reform: San Francisco might not be the only California colossus in a so-called ‘doom loop.’ The property and casualty insurance market is experiencing a crisis of its own, and the consequences are dire for the entire state economy. Here’s one recent example. In August, California-based Farmers Insurance laid off 2,400 people, about 11-percent of its workforce. Not coincidentally, Farmers announced in July that it would limit its exposure to the California homeowner’s insurance market, shortly after State Farm and Allstate announced they would no longer be writing new homeowner’s policies in the state. These companies don’t see California’s regulatory environment, forest management and wildfire risks, and sky-high building costs as a winning formula for their businesses right now. Some of you may know that insurance runs in my family. My father started his own insurance agency in the 1960s, and I grew up helping him around the office. I admired his dedication to his clients, and how he made a positive difference in their lives. He also insisted on giving outstanding customer service. I also had other interests and ambitions, so I pursued a different career path. I enjoyed my work and learned a lot, and yet during 2022/23, I found myself at a crossroads. That is when fate intervened. While volunteering for TEDxSanDiego, I met Pat Salas, the CEO of SBHIS Medicare Solutions Insurance. I was her speaker coach and impressed by her vision and leadership. She saw something in me and encouraged me to consider becoming an insurance broker, just like my father and two of my sisters. She also offered me a chance to join her team and learn from the best (including Jennifer Rico and Ania Chrostowska). The rest is history, as they say! $215,000 settlement in early litigation on a dog bite yesterday. Approximately $33,000 in meds, with an ER visit, follow up, and a couple months of hand therapy. #justice served. This case began like many of yours. No response to insurance inquiries. Look up prior cases against mechanic business. Call those attorneys. Learn of prior incidents. Learn there’s no insurance. Told defendant will never respond. Case looked dead. But client is hurt. So we tell him we’ll file. We’ll get a default, but explain recovery will be tough and unlikely. So we do what we say we will. We get the default, then have it set for a damages hearing. Guess what happens on the eve of the damages hearing? Insurance shows up. Turns out, defendant would give info to his insurance agent who would never forward to claims. Insurance asks for us to lift default. We say no but we’ll give them time to prepare. Then we learn of apparent dog bite exclusion in CGL policy. After a brief rush of excitement, case is dead, again… back to the default. In steps Benjamin Limbaugh. Ben negotiates with insurance. Insurance agrees to waive coverage defenses, including dog bite exclusion, if we vacate the default. So after a little back and forth, we settle on the terms and prepare a stipulation. While this is going on, we send a demand explaining to insurance the exposure. $100k initial offer. Ben gets to work. Within a month of the stipulation, we have a $215k resolution. Client is thrilled. Many would’ve given up, but not us. Default judgments might not ever pay, but sometimes they do. And for this client, yesterday was a great day. Pro tip: find out what happened with the papers you served and who/where they went. Maybe the defendant sat on them. Maybe they didn’t. And if they didn’t, maybe where they sent them will open additional or collateral coverage through an act/omission. Insurance agents or their staff may sit on them or fail to forward them on. #settlement #litigation #insurance #claims #dogs
