In the latest briefing from the aviation team partner Simon Wong explores 'no oral modification' clauses (NOM clauses) as they apply to commercial aircraft lease agreements, in light of a recent New York court judgement on the question of whether an NOM clause effectively restricts the way in which parties may vary a contract. #aviation

The FCA has published the findings of its review into the treatment of Politically Exposed Persons ('PEPs'), with a call to action for firms to review their policies and procedures, staff training, and customer communications to ensure compliance. Alongside this, the FCA is consulting on proposed revisions to its guidance on PEPs, to align with regulatory changes that came into force earlier this year. Fitzpatrick explain how in Garofalo v Crisp [2024] EWHC 1737 (Ch), the High Court continued an ex parte injunction which removed a director from the board of a luxury perfume group, after finding that there was a strong prima facie case that he had knowingly caused the group to breach The Russia (Sanctions) (EU Exit) Regulations 2019.
