Today, following the #EUParliament vote on the #AIAct on March 13th. #IAPP's Joe Jones hosted the co-rapporteur of the Act, Dragos Tudorache, for a very insightful talk covering a wide range of themes emerging from AI Regulation and what can be expected from ongoing regulatory efforts.
⚖ The MEP reiterated the fundamental pillars that shaped the European legislative approach to AI: focusing on (i) protection of fundamental rights on the one hand, (ii) incentivizing and promoting (safe) innovation, through an ongoing flexible and adaptable risk-based methodology, on the other, differentiating obligations applicable to #SME's and creating Regulatory Sandboxes to ease the burden of risk assessments and compliance.
📋 Implementation efforts are centered on the #EUCommission's actions through its #AIOffice in shaping, on an ongoing basis, the development of harmonized technical standards and codes of practice. The MEP also considered the following years will be focused on implementing and perfecting the Digital regulations now approved.
The need Member States to decide how to implement National Supervision Authorities for AI was also stressed, either by creating new Entities, or vesting previously instated ones with new competences.
❗ On the matter of whether National Data Protection Authorities would be a right choice, the MPE considered that it would likely be beneficial to separate the enforcement of privacy and data protection rights from the enforcement of the #AIA's obligations, stating that authorities chosen to supervise the #DSA or the Data Act could potentially be better suited to regulate AI, allowing DPA's to act has a "referee", maintaining their "profile" intact.
🔴 Finally, an interesting reflection was made on the matter of convergence between the globally emerging regulatory ecosystem's, expressed, for instance, in President Bidden's Executive Order's or the UK's Bletchley Declaration, whereby the MEP believed the path ahead would be one of convergence and not division between regional frameworks, given, in part, the shared scientific community which is shaping AI.
