Recognizing the good work in the luxury law industry is one of our favourite activities. Diageo’s general counsel, Tom Shropshire, Bird & Bird and Kering’s Italian legal team were among the big winners at our recent Luxury Law Awards programme. Shropshire won General Counsel of the Year, Kering’s Italian legal team was recognised as Legal Team of the Year and Bird & Bird secured Luxury Law Firm of the Year – International Practice. Other winners included Mark Green, head of IP at REVOLUTION BEAUTY, who received the Lifetime Achievement Award, and Adrian Bratt, from Princess Yachts, who secured Business Leader of the Year for his role in the company’s acquisition by KPS Capital Partners. Immaculate Vegan founders Annick Ireland and Simon Bell were honoured as Entrepreneurs of the Year for their work supporting sustainable fashion. Delhi High Court Rules in Favor of Karim Hotels in Trademark Infringement Suit Against Restaurant "Karin's" In a recent decision, Delhi High Court ruled in favor of Karim Hotels Private Limited and its licensee, Karim's Mughlai Foods, in a trademark infringement suit against Nizamuddin and his father. The suit arose from Nizamuddin's use of the "KARIN'S" mark, which was found to be deceptively similar to "KARIM'S," violating a 2009 Cancellation Agreement. The court's decision highlighted the following key points: Agreement and Breach: Nizamuddin had initially entered into a lease agreement with Karim's Mughlai Foods in 2008, which was terminated due to unsatisfactory business performance. A 2009 Cancellation Agreement explicitly barred Nizamuddin from using the "KARIM'S" trademark or any similar marks. Infringement: Despite the agreement, Nizamuddin continued to use the "KARIN'S" mark along with "KARIM'S" and "SECRET OF GOOD MOOD TASTE OF KARIM'S FOOD" for a restaurant at the leased premises in 2010. Court Decree: The court decreed the suit in favor of the plaintiffs after the defendants affirmed that no business was being conducted under the disputed marks from the lease premises. Relief Granted: Karim's waived its prayers for damages, rendition of accounts, and delivery up but sought an award of costs for litigation expenses. The court directed that Karim's is entitled to recover actual litigation costs from Nizamuddin. Cost Computation: The plaintiffs were instructed to file their bill of costs in accordance with Rule 5, Chapter XXIII of the Delhi High Court (Original Side) Rules, 2018 by July 15, 2024. The matter will then be listed before the Taxing Officer for the computation of costs.
