Tech layoffs across the US are motivating techies to move to the Great White North, with more than 6,000 H-1B skilled worker visa holders arriving in Canada as of October this year, according to CNBC. This comes after the Canadian government launched a pilot program on 16 July which allowed 10,000 American H-1B visa holders to apply for a three-year open work permit in Canada. The program reached capacity the following day. According to the American H-1B program, any skilled workers using this visa have 60 days to find a new employer or transfer visa status if they lose their job. Otherwise, they face being deported from Canada. Canada’s tech sector has quickly gained momentum in recent years, growing 15.7% since 2020 compared to just 11.4% in America. The U.S. is a titan of the global technology industry and is home to some of the most cutting-edge firms like NVIDIA, OpenAI, and Google. That dominance has attracted top talent worldwide, allowing the U.S. to best many of its Western competitors. While Canada, Spain, and Great Britain were the largest employers of global tech talent in 2023, the U.S. remains the top choice for highly skilled workers, according to a new Tech Migration report from Deel, a global HR and payroll company. The U.S. received the most visa requests in 2023, jumping 263% from 2022. International talent doesn’t seem deterred by some of the recent instability in the U.S. job market, tech layoffs, a high cost of living, legal barriers to immigration, and political unrest. In the last couple days, Google & Microsoft both announced a 100-person layoff - in their cloud divisions. If you are an immigrants or visa workers who has experienced a lay off, here are several options to stay in the country longer: 1/ ask for nonproductive paid status (in lieu of severance) Your grace period starts on your last day, and you've got 60 days to find a new role. Some companies are flexible and will put you in nonproductive paid status to extend your 60-day grace period. 2/ do a change of status to a B-1 visitor visa On visitor visa you can stay in the country for 6 months. USCIS is currently taking 10+ months to process these change of status applications. During the processing period, you can stay in the U.S. If you find a job, you can change your status back. 3/ do a change of status to F-1 student visa You can do a graduate program (or other degree program) while you look for a new job. You can also wait in the country while your change of status application is adjudicated. 4/ apply for a EB-2 NIW The EB-2 visa is an employment-based immigrant visa (aka green card) for people with an advanced degree or exceptional ability that are working in an area in the national interest of the United States. The NIW allows you to file on your own — without a job offer and without first acquiring a labor certification (PERM). Lawyers debate this point and will tell you to focus on what urgently gives you work authorization and/or extends your legal status. Last time I posted this, I got ripped apart by Robert Webber. However, lot's of immigrants I've talked to say they were grateful to lock in a priority date and start their path to permanent status. And just because you've been laid off doesn't mean you are not eligible for an EB2 NIW. Amber G.
