https://lnkd.in/dR3-FcpK A reminder to employers the law around flexible working requests is changing NEXT WEEK: From 6 April 2024: - Employees can request to work flexibly from day one in a new job (rather than after 26 weeks as it is now). This means an individual can formally apply to revise their working hours/days or work location during their probation period and before they have been confirmed in post. - The timescale for employers to deal with formal requests (including any appeal) drops from three months to two months. It will remain possible, by agreement with the employee, to extend this time period however. - Employees can make two formal requests a year (as opposed to one as it is currently). - Formal applications must still be in writing, but an employee need no longer explain how the desired change to their working arrangements would affect the employer, and how any impact could be overcome. - Businesses will be compelled to (more) meaningfully consider requests. If an employee’s request cannot be accommodated, the employer must explain why not and should go on to explore alternatives with an employee. - Employers remain entitled to refuse requests. The eight prescribed business grounds upon which requests can currently be declined are unchanged. - Where a request is granted, it will still amount to a permanent change to an employee’s terms and conditions unless stipulated otherwise. Flexible Working is changing!! It has been a long time coming but the rules around Flexible Working is changing from 6th April 2024. As as a business owner need to be aware of of them to remain compliant with HR legislation as you might see an increase in Flexible Working Requests ✨ From the first day of their employment , every employee will have the right to request flexible working ✨ Employees have 2 opportunities per year to put in their flexible working request. ✨ As an employer decision on flexible working must be made within 2 months of the request being made. ✨ You must consult with your employee before a decision is made regardless if it is declined or approved. ✨ Employees no longer have to explain how flexible working would affect the business or how they could deal with this change It is time to start thinking about how your business can work more flexibly to accommodate your people before the requests begin!

The forthcoming flexible working changes allows; - employees to request flexible sooner during their employment - allows employees to request flexible working more frequently - means employers need to respond to requests quicker - employers now need to consult with an employee before they reject a flexible working application. (Evidence/proof of why the flexibility cannot be accommodated would be helpful to share during this consultation I suggest). I feel these legal changes are trying to keep up with the reality of a workforce who are working more flexibly. #flexibleworking #employmentlaw
