Proud to present the latest report from the ILAW Network, Labour Rights and Technology: Mapping Strategic Opportunities for Workers and Trade Unions. The report, prepared by Barbora Cernusakova, attempts to identify some of the ways that workers and trade unions have used the law to fight against the abuses of labour rights in the world of work caused or facilitated by the use of technology. The reach of technology in the workplace is pervasive. Indeed, as the cover notes, street sweepers have been put under surveillance by being forced to wear GPS-enabled wristbands. Fears of being enslaved by AI are no more than science fiction, right? 🤔😕 The thing about AI risk that is both the same as regular technology risk and dramatically different from tech risk — is that harm is driven by human actors using the technology. Technology is assumed to be amoral in the true sense of the word - without any moral value. This is how we used to think about capital, as well, until the last couple of decades. It’s the old, guns don’t kill people … &c fallacy. Technology just like capital just like weapons isn’t inherently dangerous, it’s the human controlling the tool that causes harm. Except we now recognize that when capital is hoarded, it transforms the currency holder in a very specific way - that person becomes motivated to hoard capital even more. A person with a horde of weapons is a lot more likely to cause harm than a person who owns just one, and a person who owns a weapon is much more likely to be killed by a weapon than a non-armed person. A person with command of sophisticated technology is capable of using that technology for good, or to cause harm. And when that technology is enabled by AI, that person can cause exponential harm. And if that AI-enabled technology is resource-gobbling to use and wildly expensive to develop, it will be in the hands of those with hordes of capital. Human in the loop isn’t good enough - this is why AI governance must be human-centred. Human-created content must be celebrated, documented, preserved, generated, and above all, privileged over synthetic content. Technically neutral does not mean that value-agnostic governance is right for AI - it’s a cornerstone of a governance infrastructure that places human values above all.

Interesting new report from ILAW on platform workers rights. The report quotes our draft legislation, Islamabad Capital Territory Platform Workers Bill. "Finally, the Centre for Labour Research and Fairwork Foundation in Pakistan prepared draft legislation, the Islamabad Capital Delivery (Territory) Platform Workers Bill. If adopted, it would provide digital platform workers with several new rights, including the right to employment contract in Urdu; the right to a minimum wage; bonuses for overtime, nightwork and work during inclement weather and holidays; the right to paid annual leave; the right to occupational health and safety protections; the right to protection from discrimination and harassment; and the right to freedom of association and collective bargaining."

📢 𝗘𝗪𝗖 𝗗𝗶𝗿𝗲𝗰𝘁𝗶𝘃𝗲 𝗨𝗽𝗱𝗮𝘁𝗲: Council of the EU agrees on amending the European Works Council directive The Council has agreed its negotiation position on the European Works Council directive, which aims to enhance the representation of EU workers in multinational companies. The amended directive will focus on making European Works Councils (EWCs) more efficient by simplifying their setup, ensuring better funding, and increased protection. One significant change is that all relevant companies will now be subject to the same rules for informing and consulting their employees, as exemptions will no longer apply. The new directive aims to clarify and strengthen the functioning of EWCs by defining transnational matters more precisely, establishing clearer rules for setting up EWCs, and enforcing information and consultation rights. It also emphasizes gender balance among EWC representatives, timely consultation processes, confidentiality of information only for justified reasons, and improved access to justice for enforcing EWC rights. ⏭ Next steps: Negotiations between the European Parliament and the Council to reach an agreement on the directive before its adoption and subsequent transposition into national laws within four years. 📧 Want to know more?
