Law is meant to uphold justice and ensure order in society. But the rigours of law have immense potential for bringing in injustice to the people it serves. Failure of law to bring justice is one thing; working of the wheels of law to cause injustice to a person and put him in incarceration is another. This court has stood against such abuses of the process of law which is meant to protect its citizens. The entire legal fraternity needs to open its eyes firstly to openly acknowledge that such absues are happening and then refusing ourselves from being a part of such abuses using law. We Advocates must refuse from fighting cases meant to exploit the other party be it males or their family members or any other class of society. Refuse from adding false domestic violence and dowry cases in family and marital disputes or divorce proceedings. Refuse from slapping false rape cases as a measure of revenge or extortion. Refuse from using law for offense rather than defence. The academic legal fraternity also needs to rise up to the cause through meticulated research aimed at bringing the true state of facts before the public and the courts.
