With an average of 713 fraud offenses per 100,000 people in 2022, identity theft was the most common type of fraud In Delaware, accounting for 261 offenses.  

Healthcare fraud, like most other fraud crimes, is an intent crime. This means that conviction hinges on the prosecution proving that you intended to commit fraud. Committing fraud and making a mistake on a form while at the doctor’s office are two very different things, and only one can result in you being sent to jail. Due to intent being required, there are two defenses most often utilized in Los Angeles healthcare fraud cases: Lack of intent: Healthcare forms can be confusing. It is incredibly easy to write in the wrong information, check the wrong box, or sign the wrong form. While you may have accidentally committed fraud, making a mistake does not mean you should go to jail. Pointing out that your so-called “fraudulent act” was just an honest slip-up could be enough to get your charges dropped. Lack of knowledge: If you were caught up in a fraud scheme involving other people, then the best defense is a lack of knowledge. Again, the prosecution must be able to prove that you truly intended to commit fraud. If you were under the impression that you were doing your friend a favor, then you cannot be convicted of fraud, unless the prosecution can show that you were aware that your actions were illegal. I was driving 65 mph in a 65 mph zone yesterday and passed a police officer parked perpendicular to the road. I braked. Deterrence is real. Every football defensive back and wide receiver knows this. It’s why receivers tend to drop more passes going over the middle after they’ve been hit hard. They become reluctant to “go there.” So does every criminal defendant. I hear defense lawyers claim that “deterrence” doesn’t work. Nonsense. It’s a ridiculous yet awesome claim, because deterrence is impossible to quantify and therefore nearly impossible to refute with examples. Even crime stats won’t accurately tell that story. How does one measure something that doesn’t happen but we know is real? 1987: Davidson vs. Dartmouth: Mentioned this game elsewhere – I blocked a field goal that was returned for a TD, caused a fumble, and recovered a fumble. One of the better hits of my career and knocked the ball out. Also knocked him out of the game for a bit. Fewer throws over the middle after that… 2024: United States v. Blevins: Last defendant sentenced yesterday in a COVID-relief unemployment insurance fraud scheme. She asked for a downward variance from her guideline range, which was quite high. I opposed. Severely abbreviated paraphrase follows: Judge: “Mr. Neff, how much $ has the govt lost in COVID-relief fraud schemes in total?” Me: “Billions.” J: “Billions?” Stares at defendant. Def lawyer: “Your honor, my client had a rough childhood. 1 parent died and 1 went to prison.” J: “I grew up in abject poverty in Arkansas. At age 14, I had a friend who had 9 siblings. They had a single mom working 2 jobs. Mom died in car wreck, so my friend had to raise her siblings and go to school and became successful. What do you make of that?” DL: “Every situation is different.” J: “Some think it is not the govt’s role to give $ away, b/c it must be taken from other taxpayers. How would you respond to someone who would point to your client as proof of that point?” DL: “Er” J: “Mr. Neff, what is the govt’s position? Me: “Judge, the most important factors here are respect for the law and general and specific deterrence. The def has convictions for violent crimes, drugs, and other white-collar offenses. This was not an impulsive crime committed to satisfy a drug craving; it was a well-crafted and executed conspiracy that lasted months.” J: “Mr. Neff is right. Deterrence is paramount. The govt tried to get $ out to people quickly, and in doing so, it made things easy for people to commit fraud. People who see that there are very real harsh consequences will be more reluctant to start down this road – especially when the execution of such a scheme is so easy and difficult to detect. Effective roadside reporting proves vital in refuting this fraudulent claim! BACKGROUND Our insured driver was turning when the rear of their trailer hit the TP vehicle. CLAIM DETAILS While liability was accepted in this case, we then received 4 PI claims for alleged occupants in the TP vehicle. Our driver was adamant that there were only 2 occupants in the vehicle at the time of the incident. OUTCOME We had it on record from our driver that the TP driver had said they were taking their son to a hospital appointment at the scene. Our driver had also taken a photo at the scene which shows one minor sat in the rear of the TP vehicle and an adult male exchanging details with our insured driver. In light of this, we decided to send the file to DWF, solicitors who specialise in tackling fraud, to investigate further:   - Disclosure of the claimants' medical records were requested. The only records received were for an infant. - The entry was interesting as it noted the seating positions of all 4 alleged claimants, which is unusual for a GP entry! - There was also an entry from the Urgent Care Centre on the day of the accident which stated that the infant attended for a head injury from an incident that occurred at home, with no reference to an RTA. The entry stated the infant attended the UCC with their father, which corroborated our driver's account of the number of occupants in the vehicle at the time of the incident. A robust stance was taken, and we confirmed we had no offers to make. The TP solicitors confirmed that as a result of this, their files were now closed meaning a significant saving of £42,000 for our policyholder! #FightingFraud #ProtectingPolicyholders
