📣USCIS has released an important update regarding the H-1B lottery registration selection for the fiscal year (FY) 2025. In March, USCIS conducted an initial random selection for properly submitted electronic registrations, including those eligible for the advanced degree exemption. Only petitioners with selected registrations were eligible to file H-1B cap-subject petitions during the initial filing period from April 1 through June 30, 2024. USCIS has now determined that additional registrations are needed to meet the FY 2025 regular cap numerical allocation. As a result, USCIS will soon conduct a second random selection from previously submitted electronic registrations to select additional unique beneficiaries. This second selection does not include the advanced degree exemption, as enough registrations were already selected to meet the numerical allocation. USCIS has announced that it will conduct a second H-1B lottery! According to the announcement, USCIS determined that they need to select additional registrations to reach the FY2025 annual H-1B quota. They have satisfied the Master's cap quota, and will release another round of selections to meet the regular cap quota. The selections are pulled from the existing pool of registrations that were submitted in March 2024, no new registrations can be submitted for this second lottery. Heads-up H-1B petitioners! As has happened in some past years, USCIS announced on 07/30/24 that it needs to select additional cap (lottery) H-1B registrations to reach the 2024/2025 allocation for the "regular cap" = the category of unique beneficiaries who do not hold a U.S. master's degree and who could therefore not fall under the "master's cap" (for which there is a separate numerical allocation every year, thereby increasing the chances of winning an H-1B lottery slot for those who are eligible for the master's cap). However, this second round of selection under the regular cap will include previously submitted registrations that indicated eligibility for the master's cap. (In other other words, it's ok that USCIS will not be running a second selection round for the master's cap allocation itself.) Petitioners should check their USCIS online accounts daily and look for new selection notices under this second round. Good news! USCIS just announced that a second H-1B lottery round will be run in order to reach the FY2025 regular cap numerical allocation. They have not yet provided a date but will confirm when complete. They also confirmed that the Master's cap selections were sufficient and no additional selections will be made to meet the Master's cap numerical allocation. As a reminder, no further action is required for previously submitted and unselected registrations to be included in the second round. The are current in "Submitted" status and we will be notified when USCIS has completed is second round of selections.
