This matter was brought pursuant to the provisions of the Energy Reorganization Act of 1974, as amended, 42 USC 5851 by complainant James Nelson Saum. Following a finding that discrimination was not a factor in the action which comprised the complaint, Mr. Saum requested a formal hearing before the Office of Administrative law Judges. Prior to the formal hearing complainant, by letter received November 14, 2000, advised he is pursuing his case in the Superior Court of the State of California, and is dismissing his complaint before the Office of Administrative Law Judges of the U.S. Department of Labor. Accordingly, this matter is dismissed.
