On June 4, 2002, the parties submitted their executed settlement agreement in this case. They have requested that the terms of the settlement be kept confidential, and that respondent's pre-disclosure notification rights under 29 C.F.R. §70.26 (2001) be protected. Accordingly, the terms of the settlement will not be outlined here. Further, both parties are represented by counsel; and since I have not heard the case and have no basis to determine the merits of the respective parties' positions, I have no basis to second-guess the parties regarding the terms of the settlement.
Accordingly, it is recommended that the settlement agreement be approved.
