The following facts and circumstances are based on personal knowledge, observation and investigation, as well as, information received from brother Police Officers who were acting in their official capacities, TGNED Prager 2) On November 25, 2008, Officer Christopher Nolan of the Patrol Division, was assigned a Shoplifting Complaint at the Walmart Department Store Located at 515 Sawmill Road, As a result ofthis investigation, Jaquan Glass was arrested for the larceny. In addition, Glass was found to be in possession of a small amount of suspected heroin. Finally, after getting consent from Glass to search the 1998 Chevy Astro van bearing New Jersey Registration YHB-67C he was operating, | located and seized six (6) additional glassine bags each stamped with "Pins and Needles" and each containing a tan powder substance consistent with heroin. A subsequent field test on a representative sample revealed the presence of heroin. Glass was subsequently arrested and charged accordingly. 3) Affer a further search of the van we located an after market speaker wire running across the floor. We also located a toggle switch under the steering column, as well as, two non-factory leads, one on the frame of the van and the other ‘on the base of the sliding door. Based on my training and experience I know that type of non-factory equipment and after market wiring is often times indicative of a vehicle which has a hidden compartment or "trap." Furthermore, this van was equipped with no non factory equipment which would require the described non factory wiring and switch Based on the lack of light and conditions in the Walmart parking lot, the van was seized as evidence and towed to the ‘West Haven Police Department secure impound lot to be held with the intentions of drafting a Search and Seizure Warrant and conducting a more thorough search at a later date, 4) On November 29, 2008 at approximately 4:30 pm, I went into the impound lot to check on the van. ‘The Street Crime Unit porforms a check on all vehicles seized during drug investigations once per week to confirm they have not been damaged or tampered with while being held in the impound lot. Upon checking the van I observed that the front passenger seat was pushed forward and that the driver's door was unlocked. I knew that the seat was not forward and the van was locked after being placed in the Jot on November 25, 2009. DATES [DATE ae cf SIGNATURE Gat Ls i ‘AFFIDAVIT the van, I opened the driver's door and observed a small white package between the driver's seat and the passenger seat. Further inspection revealed the white package was ripped open and I could see that there were several more smaller packages inside with one being ripped open. Inside the ripped package were several "bundles" of white glassine bags each containing a tan powder substance consistent with heroin. A bundle is street terminology commonly used to describe ten glassine bags of heroin bundled together for street sale. ‘5) Based on the belief that someone had gained entry to the lot and the van, the erime scene was secured and Detective ‘Tammy Murray of the Identification and Crime Scene Unit was called in to process the scene. Detective Murray processed the crime scene and seized the evidence found in the van, as well as, other items believed to be related to the burglary. See Detective Murray's erime scene report for more details concerning her investigation. 6) Asa result of her investigation, Detective Murray seized nine (9) small white packages, seven (7) of which contained fifty (50) glassine bags, one (1) containing forty eight (48) glassine bags and one (1) containing forty (40) glassine bags all of which contained a tan powder substance consistent with heroin. The four-hundred and thirty eight (438) bags seized were stamped with cither "Bloodsport” or “We Da Best.” Officer Thomas Flaherty of the Street Crime Unit conducted a field test on a representative sample of the tan powder substance using, an approved reagent which achieved positive results for the presence of heroin. 7) During the month of December 2008, the Street Crime Unit was contacted by a confidential and reliable informant, hereinafter referred to as C/I#1. C/f#1 has provided information that has led to the seizures of narcotics as well as with items commonly associated with the distribution of illegal narcotics. Furthermore, C/I# is well versed not only in the street terminology and methods of operation of dealers of illicit narcotics, but with the weights and/or properties of illicit narcotics themselves. Information provided by C/l#1 has resulted in the arrest and subsequent convietions of | persons involved, in state courts of law. C/l#1 has been an informant of the West Haven Police Department in excess of three years and has never been known to provide information to law-enforcement officers that has been misleading or untruthful. C/I# stated that Jaquan Glass and a second male with the street name "Jamaica June" formulated a plan and breached the impound lot sometime between November 25, 2008 and November 29, 2008. C/I#!] stated that Jaquan Glass was told by his cousin, who C/ll identified as Tarulus Glass or "Dred", that he better get the "stuff" out of the van, C/l#1 further explained that the van had a hidden compartment and that when Jaquan Glass was arrested there was approximately four thousand bags of heroin inside the compartment and a handgun, C/I#] further stated that Tarulus Glass hired “Jamaica June" to assist with the break in because he already broken into the West Haven Police Department impound lot on two other occasions and knew how to get into the lot undetected. Finally, C/I stated that he/she believed that Jaquan Glass and “Jamaica June" stole the heroin and returned it to Tarulus Glass. 9) As part of Detective Murray's crime Scene investigation she removed several latent prints from the tape holding cach individual package of the suspected heroin together. Once these prints were removed, she submitted them to the Division of Criminal Justice Services in Connecticut, New York and New Jersey for analysis. On January 8, 2009, Detective Murray received written notification from the State of New York that four of the latent print impressions submitted relating to the impound lot burglary matched the known fingerprint impressions of Jeftiey Alba, date of birth of November 7, 1980, of New York City. 10) During the month of February 2009, the Street Crime Unit was contacted by Sergeant Peter Brano of the Yale University Police Department. Sergeant Brano advised me that he was contacted by a confidential informant, hereinafter referred to as C/l#2, Sergeant Brano stated that C/I¥2 informed him that he/she was approached by ‘Tarulus Glass and Tarulus began talking about the impound lot Burglary in West Haven. Sergeant Brano stated that his C/I knows Tarulus Glass as the owner of the car wash on Dixwell Avenue and speaks with him on a regular basis. Sergeant Brano stated that C/1#2 stated that Tarulus Glass started bragging about the break in and told him/her that he organized the break in. Sergeant Brano stated C/I#2 told him that Tarulus Glass had his nephew Jaquan get the heroin back from the impounded van. Sergeant Brano stated that C/1#2 told him that Tarulus Glass was proud of the break in and has been telling people around the ear wash since the incident happened. This individual, Mark Reid, has been the target of two different heroin investigs ‘conducted by the Street Crime Unit, including one where Reid was identified as selling a quantity of heroin in West Haven and subsequently arrested. 22 12) On April 28, 2009, Reid was taken into custody on an outstanding Arrest Warrant by the West Haven Police Department Patrol Division and was being held on a court set bond. Myself and Officer Thomas Flaherty conducted an interview with Reid while in custody based on the belief that he was involved in the Burglary. Reid was given his Miranda warning, stated that he understood his rights, waived them and agreed to speak with us, Reid stated to us, in substance, that he is acquaintances with both Jaquan Glass and Tarulus Glass. Reid stated he knows Tarulus Glass as | "Dred." Reid stated that he believes Jaquan is Tarulus’ cousin. Reid stated that on November 28, 2008, he was at | Tarulus Glass' car wash on Dixwell Avenue in Hamden hanging out, Reid stated he was there with both Jaquan and | Tarulus. Reid stated that Tarulus and Jaquan were discussing Jaquan's arrest and the van being impounded. Reid stated | that both men were nervous and that Tarulus was stressing to Jaquan that getting the "truck" impounded could come | back to all of them and they would all go to jail. Reid stated they were nervous because there was heroin and a gun | hidden inside a compartment inside the van. Reid stated that Tarulus was telling Jaquan that he "fucked up" and that he | had to get the "stuff" back, Reid stated that Jaquan responded by saying that he had to redeem himself and had to get the "stuff" back, Reid stated that he left the car wash a short time after this conversation took place. Reid went on to state that at approximately 8:00 pm he received a call from Tarulus Glass who asked him to return to the car wash. Reid stated that he went back to the business and spoke with Tarulus who asked him to give Jaquan a ride to West Haven. Reid stated that he asked Tarulus why Jaquan had to go to West Haven and Tarulus replied "You know why." Reid stated that Tarulus offered to pay Reid and fix his vehicle for no charge if he drove Jaquan. Reid indicated he believed this would be payment for taking Jaquan to retrieve the heroin and the gun from the van. Reid stated that at approximately 12:30 am on November 29, 2008, he was still at the car wash along with Tarulus, Jaquan and Tarulus’ father Charles. Reid stated that Tarulus approached him again and told him he had to take Jaquan to West Haven, Reid stated that he agreed to take Jaquan for a payment of five hundred dollars and the repairs to his vehicle. Reid stated that after agreeing to give Jaquan a ride, Jaquan told him that they were just going to drive by the impound lot and scope it ‘out. Reid stated that Jaquan knew exactly where the lot was behind the Police Department. Reid stated that just when Jaquan was going to get out of the car, Reid noticed a man coming out of the bar across the street from the Police Department. Reid stated he told Jaquan not to get out because there was someone outside the bar. Reid stated that he then pulled his car into the Mobile station further up Sawmill Road. Reid stated that after sitting in the Mobile station for awhile he pulled into the Pizza Hut parking lot so Jaquan could get out and check out the impound lot. Reid stated that Jaquan was wearing a black hooded sweatshirt and black pants and got out of Reid's car and ran across the strect. Reid stated he could see Jaquan run across the street and run along side of a house right behind the Police Department. Reid stated that once near the house it was to dark and he could not see Jaquan anymore. Reid went on to say that approximately four or five minutes later he saw Jaquan running down the street. Reid stated that Jaquan ran back to Reid's vehicle and jumped into the car hold a black bag. Reid stated that once inside the car Jaquan yelled "I got that shit, I got that shit" and then told Reid to drive away. Reid stated that Jaquan told him that he did not even have to use the bolt cutters because there was a big hole under the fence and he just crawled right in. Reid then stated that while they were driving back to New Haven, Jaquan called Tarulus and told him what had transpired. Reid stated that Tarulus was very happy and referred to Jaquan as a "beast" and told him he redeemed himself. Reid stated that Tarulus then instructed him and Jaquan to meet him (Tarulus) at Reid's apartment at 79 Norton Strect in New Haven. Reid stated that after speaking with Tarulus, Jaquan called "Charles" and advised him of what happened. Reid stated that Jaquan told "Charles" that he got the heroin from the van, but thinks he may have dropped some, Reid stated that Jaquan told "Charles" he was so nervous that he thinks he dropped some of it, referring to the heroin. Reid stated that Jaquan also described to "Charles" how he made entry into the lot. Reid then stated that he drove Jaquan to his apartment on Norton Street and parked in the back of the house. Reid stated that Tarulus Glass and "Charles" showed up and took possession of the bag. Reid stated that he expected to get paid for taking Jaquan, but Tarulus did not pay him that night and has never paid him. Reid stated that during the ride back with Jaquan he looked inside the bag and estimated there was probably eighteen to twenty 'bricks" of heroin and a handgun. It should be noted that the term "brick" is street terminology describing fifty bags of heroin packaged together. Finally Reid stated that on several occasions he wanted to call the Police and report the incident, but he is scared of Tarulus and his family and believes they would physically harm him. Reid gave a taped audio statement detailing this incident. 13) It should be noted that Molloy School is located at 255 Meloy Road and within 1500 feet of the Police Department impound lot. 14) Whereby, based on the facts and circumstances set forth in this Affidavit, the undersigned believes that probable cause docs in fact exist for the issuance of this Arrest Warrant charging Jaquan Glass, a black male with a date of birth of August 19, 1982 with Burglary in the Third Degree 532-103, Conspiracy to Commit Burglary in the Third Degree 53a-48/53a-103, Possession of Heroin 21a-279(a), Possession of Heroin with Intent to Sell 21a-278(b), Possession of Heroin with Intent to Sell within 1500 Feet ofa School 214-278(a)(b), Tampering with Evidence 532-155, Conspiracy to Commit Tampering with Evidence 53a-48/53a-155, Criminal Trespass in the First Degree 53a-107 and Conspiracy to Commit Criminal Trespass in the First Degree 53a-48/53a-107.
