Study the following situations and determine if the accused is guilty of kidnapping under the MPC.

1. During a bank robbery, one of the robbers holds a gun to the bank president’s head while her cohorts
are getting the money from safe. She tells the president he her “hostage”. The robbery takes 10
minutes to complete after which the robbers leave the bank president unharmed.

2. A farmer picks up a mentally ill hitchhiker and him to his farm, which is 50 miles from the nearest
town. The hitchhiker is told he has to work at the farm until he is able to pay the farmer back for the
ride. Because the hitchhiker is mentally ill, he doesn’t realize that he can simply walk away from the
farm and find another ride to town.

3. A 13-year-old girl agrees to go to an out-of-state concert with 16-year-old boy from her high school.
They attend the concert without letting her parents know and don’t return for three days, during
which time her parents have informed the police that their daughter is missing.

4. A father, who was granted the right during a divorce processing to see his daughter on the weekends
(visitation rights), doesn’t bring the girl back on Sunday night. He and daughter have gone to Mexico
for two weeks without obtaining prior approval of the mother, who was granted custody by the court.

NAME THE CRIME

1. “I arrived home late and found that I’d forgotten my keys. I didn’t want to wake my wife up, and I
saw there was a ladder in the garden of the house next door. I got the ladder and climbed in. We’ve
just moved house and I didn’t realize I was in the wrong street …”

2. “I was walking my dog when I saw the gun lying on the ground. I picked it up-it was still warm and at
that moment, I saw the body lying in the long grass. I went across to look and it was my business
partner. That’s when the police arrived …”

3. “OK, so there are 200 copies of the video. That’s perfectly true, but I had no intention of selling
them. I’m collector.”

4. “ You misunderstand me. When I offered him the money, I meant it as a gift. I know that life can be
difficult for a young man on a police salary, especially if he has a family, young children etc. It is not
easy and I know that. I just wanted to help. I didn’t expect him to do anything in return …”

5. “After leaving the office I realized I’d forgotten my umbrella. I went back in to get it. When I went
in, I noticed that the photocopier was still turned on. It had been working very badly all day, and I
decided to quickly see want was wrong with it before going home. I made a few test copies of
documents that were in the office. I din’t even look at what I was copying. The machine seemed to be
working much better. I put the copies in my briefcase – intending to use the other side as notepaper. I
didn’t believe in wasting paper. At that moment MR. Sanders came out of his office…”

6. “ I painted them for pleasure. I did not intend to deceive people. I never said they were by other
people. Yes, I did include the signatures of other artists but that’s because I wanted them to be perfect
copies …“
