Chapter I
THE PROBLEM AND ITS SETTING

Introduction
General Santos City Bulaong Terminal is owned and operated by the
Local Government Unit of General Santos City under the supervision of city
Administrators Office as mandated by section 5, Article 3 of ordinance # 8 series
of 2005 re: Administration, Operation and Maintenance of the City Terminal shall
be supervised by the City Administrator. (Facurib Jr., 2013)
The land area summed-up to eleven thousand and four hundred forty four
(11,444) square meters was donated by the heirs of the late Don Eusebio
Bulaong sometime in 1984. Upon completion of the Deeds of donation a building
was then built there on and became operational in 1992. Since such building
could not accommodate huge number of passengers and vehicles thus, major
renovation of the building was under taken and opened operationally last
December 22, 2004.In the first quarter of 2008, the city government has
constructed another concrete building just adjacent to the old one to be utilized
as terminal for vans and public utility jeepneys bound for nearby town, cities and
provinces and became operational last April 16, 2010. (Facurib Jr., 2013)
Providing service transportation which is adequate and appropriate is the
challenges that encountered in almost all cities in the world. Cities will always

have a new problem, which arise due to transportation system. In general, cities
like General Santos City are highly dependent to the road transport. Increasing
the number of residents and the use of motor vehicles has caused social and
economic problems for cities that are dependent on road transport highway.
Urban areas, such as General Santos City, characterized by limited right
of way, heavy population and traffic congestion, require special and innovative
structures and methods to lessen traffic congestion and accidents.
This research seeks to evaluate the operation and maintenance of

implementation is properly implemented and if the terminal is complied with rules


and regulations.

Objectives
This study aims to evaluate the current operation and maintenance of
Bulaong city terminal in General Santos City.
Specifically, the study will be guided by the following objectives:

Significance of the Study

This study is significant to the following person:


General Santos City Local Government Unit. This study will provide them an
evaluation of the current operation and maintenance system of the terminal and
whether to support an improvement about the systems.
Bus Terminal Administration. This study will identify which part of the
operational and maintenance system needs an improvement or determine where
this current program is Good, Fair or Poor.
Commuters. This study will help to determine whether the Bulaong terminal is
having a good operation and maintenance system. Thus, these as well help them
identify if the terminal is following the rules and regulations that need to be
implemented.
Future Researchers. This study will give them information and will serve as
basis for improving future studies related to this topic.

Scope and Limitations of the Study


This study aims to determine the facilities of Eusebio Bulaong Terminal,
whether the Bulaong City terminal complied with rules and regulations and the
ordinances, and the evaluation of operation and maintenance program of the city
terminal.

REGULATIONS IN THE OPERATION AND MAINTENANCE OF EUSEBIO
BULAONG PUBLIC TERMINAL LOCATED AT BULAONG SUBDIVISION,
BARANGAY DADIANGAS NORTH, GENERAL SANTOS CITY, AND FOR
OTHER PURPOSES

Be it ordained by the Sangguniang Panlungsod of General Santos that:


Article 1
Title
Section 1. The Integrated Transport Terminal Ordinance of General
Santos City is hereby enacted.

Section 2. Title. This Ordinance shall be known as the Integrated


Transport Terminal Ordinance of General Santos City, and hereinafter referred to
as the Ordinance.
Article 2
Coverage
Section 3. This Ordinance shall apply to the operation and
management of new General Santos City Terminal otherwise known as Eusebio
Bulaong Public Terminal.

Insofar as the departure fees herein provided,

however, are concerned, the same applies not only to the buses, jeepneys, vans
and filcabs/multicabs that are required to load and unload passengers at the
Bulaong Terminal, but also applies to the jeepneys, filcabs/multicabs that use the
Lagao Food Terminal. The departures fees of said passenger vehicles at the
Lagao Food Terminal shall be governed by this Ordinance, thereby amending
and/or repealing inconsistent ordinances/resolutions fixing departure fees of
public utility vehicles. Hence, departure fees of public utility vehicles using the
Bulaong Terminal and/or using the Lagao Food Terminal are now fixed by this
Ordinance.
Article 3
Definition of Terms

Section 4. Definition of Terms. For purposes of this Ordinance, the


following terms and acronyms shall be understood to mean as:
(a.)

Terminal refers to the Eusebio Bulaong Public Terminal located at

Bulaong Subdivision, Barangay Dadiangas North, General Santos City.


(b.)

Paved Bay an area within the terminal building allocated for Public

Utility Vehicles (PUV) for the purpose of loading and unloading passengers.
(c.)

Bus any motor vehicle covered with a valid Certificate of Public

Conveyance (CPC) and registered as bus for hire with the Land Transportation
Office.
(d.)

Jeepney any motor vehicle covered with a valid Certificate of Public

Conveyance (CPC) and registered as jeepney for hire with the Land
Transportation Office. This includes the so-called Filcab/Multicabs.
(e.)

Van any vehicle covered with a valid Certificate of Public Conveyance

(CPC) registered as van for hire with the Land Transportation Office.
(f.)

Operator a natural or juridical person who is either a holder of a

Certificate of Public Conveyance (CPC) or a holder of a valid business permit


and engage in legal activity within the terminal area.
(g.)

Dispatcher shall refer to the person in-charge of dispatching the vans,

jeepneys and buses.

Article 4
Policies, Rules & Regulations
Section 5. Administration, Operation and Maintenance of the City
Terminal. Administration, Operation and maintenance of the City Terminal shall
be supervised by the City Administrator who shall have the following duties and
responsibilities:
(a.)

To maintain the facilities, such as but not limited to keeping the fence and

gates intact, replacing the busted bulbs, and others;


(b.)

To keep the premises in a clean and sanitary condition;

(c.)

To adopt and enforce rules for orderly vehicle movements and parking

inside the terminal;


(d.)

To keep the terminal clear of vendors, peddlers, hawkers and illegal

occupants;
(e.)

To maintain peace and order inside the Terminal;

(f.)

To keep daily records of departure of Public Utility Vehicles;

(g.)

To assist the City Treasurers Office in the collection of terminal fees from

PUVs;
(h.)

To keep accounts of collection and financial operation of the terminal;

(i.)

To award to appropriate groups the porterage/cargo handling services at

the rentable spaces of the terminal, provided that there will be at least three (3)
bidders accredited by the Sangguniang Panlungsod; and
(j.)

To perform all other functions required by the City Mayor for the efficient

operation of the Terminal.


Section 6. Rules and Regulations. The following rules and regulations
shall be observed in the operation of the Terminal:
(a.)

All vans and buses and all northbound and westbound public utility

jeepneys for hire with approved routes outside the city limits are required to enter
the Eusebio Bulaong terminal to load and unload their passengers but not to the
prejudice of unloading passengers in between the point of origin and point of
destination. It is understood that their destination is from terminal to terminal.
They shall not be allowed to go around the city to pick up passengers.
(b.)

No private van garage and/or booking office for public utility vans shall

operate outside of the designated van terminal site upon the effectivity of this
Ordinance;
(c.)

All eastbound public utility jeepneys, filcabs and multicabs presently

directed to use the Lagao Food Terminal shall remain and continue using the
said area as their terminal provided that they pay the corresponding
departure/terminal fees as provided for in this Ordinance. It is understood that

their destination is from terminal to terminal. They shall not be allowed to go


around the city to pick up passengers.
(d.)

Maintenance services and repairs of any vehicle shall not be allowed

inside the Terminal;


(e.)

Damages to the building or any Terminal facility shall be charged to the

party/parties responsible;
(f.)

Tricycles and private vehicles shall be allowed to enter Terminal access

road only to load and/or unload passengers. Tricycles are prohibited from
establishing their own terminal inside the Bulaong Terminal;
(g.)

Passenger vehicles waiting for passengers must be parked properly on

the bays provided for them;


(h.)

The operation and maintenance of the rest rooms shall be turned over to

the barangay where the terminal is located.


(i.)

To ensure cleanliness and maintain sanitation, bus, vans and jeepney

operators shall provide their own garbage receptacles for bio and nonbiodegradable wastes.
Section 7. Assignment of Bays. Bays at the Terminal shall be assigned
to operators after consultation with them, subject to the following procedures:

(a.)

For purposes of loading and unloading passengers, public utility buses

shall occupy the bays at the new terminal building;


(b.)

Each bus line operator shall enter into a Memorandum of Agreement

(MOA) with the City Administrator for the assignment of bays. The MOA shall be
renewable annually;
(c.)

Public utility jeepneys and vans shall occupy twelve (12) bays at the old

terminal, as indicated in the sketch hereto attached as Annex A to form part


hereof, each bay to accommodate two (2) units; and
(d.)

Public utility vans and jeepneys shall have separate bays. Vehicles

sharing the same or common routes shall occupy one bay and shall be parked
upon the instructions of the terminal authorities. Bays shall be assigned by
drawing of lots.
Section 8. Rental of Spaces. The following rates shall be charged as
rentals or leased fees:
(a.)

P30.00 per square meter per day rental for all office spaces in the

Terminal building.
(b.)

The leased contract shall be renewable every three (3) years.

(c.)

The schedule of increase in rental is shown in the table below:

Section 9. Porterage and Cargo Handling. The porterage/cargo


handling shall be governed by the following:

(a.)

Porterage/cargo handling shall be provided by appropriate group duly

screened and recommended by the Terminal Authorities.


(b.)

Porters/cargo handlers shall secure individual working permit yearly.

(c.)

Porters shall wear a prescribed uniform and an official Identification (ID)

Card issued by the appropriate group and duly signed and approved by the
terminal overseer.
(d.)

Porterage/cargo handling fee shall be regulated by the Terminal

Authorities subject to review and amendment every two (2) years.


(e.)

Passengers who desire to carry their own cargoes shall not be obliged to

avail of the services of handlers.


Section 10. Dispatching. The following provides for the guidelines on
dispatching:
(a.)

Barkers and private dispatchers for jeepneys and vans shall not be

allowed inside the Bulaong Terminal.


(b.)

Every public utility van and jeepney shall be assigned to a bay and shall

have a permanent occupancy number to be determined by drawing of lots.


(c.)

The Office of the City Administrator shall assign dispatchers for vans and

jeepneys who shall dispatch vehicles according to the assigned permanent


occupancy number.

(d.)

A Civil Security Unit (CSU) personnel assigned at the gate shall record all

departing and arriving vans and jeepneys to monitor the order of dispatching.
Article 5
Hawking, Peddling and Selling Along Sidewalks
Section 11. Prohibition to Hawk, Sell or Peddle Along Sidewalks. No
person shall hawk or peddle his/her wares along the sidewalks, alleys, aisles or
corridors inside the terminal;
Section 12. No person shall hawk or peddle his/her wares inside the
buses or any public utility vehicle within the terminal.
Section 13. Prohibition on Illegal Structures. No person shall put up
any structure, shanty, barong-barong, shed, table or push cart within the
premises of the Eusebio Bulaong Public Terminal for the purpose of selling or
keeping his wares or articles for sale to the public.
Article 6
Fees and Collection
Section 14. Departure Fees. On departure, there shall be levied a
terminal fee upon each owner/operator of any departing public utility vehicle for
using the new terminal bays at the following rates.
(a.)

Buses

Section 15. Collection and Disposition of Fees. The fees/charges


herein provided shall be collected by the City Treasurer through his duly
assigned deputies.
Section 16. There shall be an issuance of departure ticket, which shall
be in the prescribed form in the Ordinance hereto attached as Annex B.
Departure tickets are color coded, yellow for buses, light green for vans, pink for
filcabs and light blue for jeepneys.
Section 17. The operators shall subject themselves to inspection of their
departure tickets at the designated CTO Ticket Check Points located in Makar,
Apopong and Lagao, as the case may be. The operator shall present the CTO
and Operators Copy of the departure ticket. The CTO inspector shall detach the
CTO copy of the ticket and stamp the operators copy as used and sign the
same as proof of inspection.
Section 18. Any such fees/charges collected shall accrue to the
Economic Enterprise Fund-Operation of the City Terminal (Function Code 8821)
and shall be used exclusively for the maintenance and other operating expenses
of the Terminal subject to the usual accounting and auditing procedures.

Section 19. The City Treasurer is required to prepare daily departure


report copy furnish the Terminal overseer.
Article 7
Duties and Responsibilities of Operators of Buses, Vans and PUJs
Section 20. The operators of public utility buses, vans, jeepneys, filcabs
or multicabs shall secure the necessary individual business permits, licenses,
upon payment of appropriate taxes, fees and other impositions that may be
imposed, levied and collected by duly constituted authorities before using or
taking possession of the premises assigned to them.
Section 21. For operator of public utility buses, vans and jeepneys with
two or more units franchised under his/her name, he/she shall be required to get
only one permit for his/her units. The plate numbers of the units must be reflected
in the permit.
Section 22. There shall be printed/typewritten on the face of the
business permit the following: Any violation by the permitee of a law, ordinance,
executive order or other issuances in the preparation of his business shall be
cause for the revocation of the permit. The Business Permits and Licenses
Division shall also issue corresponding vehicle stickers to all approved permitee,
which shall be displayed on the front windshield of their vans, jeepneys and
buses.

Section 23. The Operators shall not start or proceed with any repair
work, extend the area, occupy more bays/alleys as allowed nor in any case
introduce improvements or make any alteration in the leased premises without
prior written consent and approval of the City Administrator; and that in case of
permitted improvements or alterations, the same shall not be removed but shall
belong to and become the exclusive property of the City Government of General
Santos, without any right of reimbursement on the part of the operators.
Section 24. The operators shall comply with all sanitation rules and
safety regulations which are promulgated by the duly constituted authorities and
those that may be imposed from time to time by the City Administrator and to
keep and maintain the leased premises in clean and sanitary condition and
disposed of all rubbish or garbage only thru the means and places indicated by
the City Administrator for the purpose.
Section 25. Each operator shall require his/her employee/s to wear
companys ID upon entering the premises of the Eusebio Bulaong Public
Terminal and to require them to log-in the logbook prepared by the overseer of
the said Terminal for identification purposes.
Section 26. Each Operator shall not directly or indirectly sublease,
assign, transfer, convey mortgage or in any way encumber his privilege of lease
over the leased premises or any portion thereof under any circumstances
whatsoever, or shall allow any person to conduct business thereat by tolerance,

thus, any agreement or contract that may be made in violation of this clause be
null and void.
Section 27. Each operator shall undertake the expenses for minor repair
of the leased premises resulting from ordinary wear and tear but major repairs
shall be assumed by the City Administrators Office provided that the operator
informs the City Administrators Office before any repair is undertaken.
Section 28.

Each operator shall comply with any and all laws,

ordinances, regulations or orders of the National or City Government authorities


arising from or regarding the use, occupation and sanitation of the leased
premises.
Section 29. Each operator or his/her duly authorized representatives
shall recognize the authority of the City Administrator or his duly authorized
representatives to inspect the leased premises at any reasonable hour of the day
or night.
Section 30. Each operator shall notify in writing the City Administrator at
least Thirty (30) days in advance should he/she decide to vacate the leased
premises.
Section 31. All operators shall submit to the terminal authorities their
own daily arrival and departure reports on arrivals and departures of their own
units;

Article 8
Penalty, Amendatory, Separability, Effectivity Clauses
Section 32. Penalty Clause. Any person violating the provisions of the
foregoing Sections shall be punished as follows:
(a.)

For operators of buses, jeepneys and vans who violate any provision of

this Ordinance shall be punished with a fine of Five Thousand Pesos


(P5,000.00);
(b.)

For peddlers, hawkers and or any personnel who violate any provision of

this Ordinance shall be punished with a fine of Five Hundred Pesos (P500.00).
(c.)

Any other persons shall be punished to pay a fine of Five Hundred Pesos

(P500.00).
Section 33. Amendatory Clause. All Ordinances, Resolutions, Orders,
Memoranda and other Issuances inconsistent herewith are hereby amended,
repealed or modified accordingly.

Section 34. Separability Clause. If, for one reason or another, some
part of this Ordinance is found to be invalid or unconstitutional, all other
provisions hereof not affected thereby shall remain to be in full force and effect.

Section 35. Effectivity Clause. This Ordinance shall take effect


immediately after fifteen (15) days following the completion of its full publication
in any newspaper of general circulation in the City of General Santos.

In the meeting of the President with the transport sector on 14 September
2011, it was reported that despite the joint issuance of this Department and
the Department of transportation and communication (DOTC) prescribing the
guidelines in the establishment and operation of public transport terminals,
severil LGUs blatantlv disregarded said issuance through the commission of

any or all of the following acts: compelling vehicles merely passing through
to use the public transport terminals established or designated by the LGUs
and imposing fees thereon; closing down existing private terminals or cut
tailing the operation of said terminals for the purpose of using the public
transport terminals established or designated by the LGUs; and the LGUs
failure to observe the policies, standards and limitations on the
establishment and operation of public transport terminals.
In view thereof, DILG-DOTC JMC No.1, s. 2008, particularly on the guidelines in
the establishment and operation of public transport terminal, is hereby
REITERATED.
Local Chief Executives and Presiding officers and Members of the
Sanggunian at all levels are hereby directed to IMMEDTATELY comply
herewith by amending all locally-issued ordinances, orders, rules and
regulations which are in conflict DILG-DOTC JMC No. 1. s. 2008.
All DILG Regional Directors are directed to cause the widest dissemination
of this Memorandum Circular in their respective areas of responsibility and to
monitor the LGUs' compliance here with.
Ordinance No. 02 series of 2013
WHEREAS, the Eusebio Bulaong Public Terminal is the only authorized
public passenger transport station in General Santos City;

WHEREAS, the City of General Santos continues to grow as a city, both


economically and socially and recognizes the publics growing need for public
transport, especially in the commercial areas;
WHEREAS, allowing large commercial establishments such as malls to
put up satellite public utility van terminals shall provide easy access,
convenience and safety to the riding public;
WHEREAS, the Department of the Interior and Local Government issued
Memoranda Circular No. 2011-150 dated October 12, 2011, subject matter of
which is the reiteration of DILG-DOTC Joint Memorandum Circular No. 01,
Series of 2008, particularly on the guidelines in the establishment and operation
of Public Transport Terminals;
WHEREAS, this Ordinance shall further supplement and modify
Ordinance No. 08 Series of 2005, entitled An Ordinance Providing for the
Policies Rules and Regulations in the Operation and Maintenance of Eusebio
Bulaong Public Terminal located at Bulaong Subdivision Barangay Dadiangas
North, General Santos City and Other Purposes ;
Section 1. Short Title. This Ordinance shall be known as Public Utility Van
Satellite Terminal Ordinance of General Santos City.
Section 2. Definition of Terms. As used in this Ordinance, the following terms
shall mean:

a. Large Establishment- refers to an establishment with a building


gross floor area of at least (50,000) square meters or One Hundred (100)
stores.
b. Public Utility Van Satellite Terminal- refers to a station where
transport van vehicles load or unload passengers or goods situated in
some large establishments in General Santos City.
c. PUV Satellite Terminal Operator- refers to the commercial large
establishment authorized to operate a Public Utility Van Satellite Terminal.
Section 3. Qualifications. The Proponent PUV Satellite Terminal Operator or
large

commercial

establishment

must

possess

the

following

minimum

qualifications;
a.

Must be a resident of General Santos City and has

been operating the establishment for at least five (5)


consecutive years;
b.

Must have at least Five Hundred Million Pesos

(P500,000,000.00) capital;
c.

Must own the land, which should be at least one

hectare, to be used for this satellite Terminal;


d.

The establishment shall directly operate the terminal

without delegating to the van operators;

Section 4. Prohibition on the Use of Public Roads. The PUV Satellite


Terminal may be located within the commercial zone provided it is not along the
following major roads: Santiago Boulevard, Jose Catolico Sr. Avenue, Acharon
Boulevard, Pioneer Avenue, Pendatun Avenue and Magsaysay Avenue.
No PUV Satellite Terminal shall be set up and operated within a distance
of two kilometers from the other PUV Satellite Terminal.
Section 5. Facilities. The PUV Satellite Terminal shall, in addition to other
requirements of the Building Code, provide for:
(a) loading/unloading bays and vehicle lay-over areas;
(b) a ticket booth;
(c) covered, decent and comfortable waiting areas, and breastfeeding
room;
(d) clean comfort rooms for men, women, elderly and persons with
disabilities;
(e) a free and safe drinking station;
(f) garbage waste containers;
(g) a CCTV camera and sufficient security for safety; and
(h) at least one (1) emergency fire truck;
(i) availability of Information and Passenger Assistance Counters or
Personnel;

(j) appropriate and adequate signages;


(k) priority lane for persons with special needs specifically pregnant
women, mothers travelling with infants and/or small children and those with
physical disabilities.
Section 6. Fees. The following fees shall be levied upon:
a.) Terminal Fee. The public utility van satellite operators may charge
reasonable terminal usage fee to the public utility vans operating at the PUV
satellite terminals not exceeding P60.00;
b.) Departure Fee. The public utility vans will also pay P30.00 to the
operator as departure fee and which shall be remitted to the City Treasurers
Office;
The owner/operator is required to prepare daily departure report, copy
furnish the terminal overseer.
Section 7. Memorandum Of Agreement (MOA) with Van Owners/Operators.
For the efficient operation of the PUV Satellite Terminal, the commercial
establishment shall enter into a memorandum of agreement with the van
operators and drivers association on the use of the said Satellite Terminal.
Section 8. LTFRB Authority. There is hereby imposed the following
requirements to the owner, operator or driver of PUVs:

a.) The owner/operator shall secure a certificate of compliance from


the Office of the Land Transportation Franchising and Regulatory Board
(LTFRB);
b.) Business permit from the City Government through the
Business Permits and Licenses Division of City Mayors Office.
Section 9. Contract. The operator of the said public utility van satellite terminal
shall be given a two-year contract for its operation, renewable upon expiration of
the said contract.
Section 10. Penalty Clause. Any person or group of persons who violates this
Ordinance shall be punished by a fine of Five Thousand Pesos (P5,000.00) or
imprisonment of ten (10) days or both such fine and imprisonment at the
discretion of the Court.
If the violator is a group, association, corporation, partnership, or
cooperative, the group leader, president or manager shall additionally be liable
thereof.
Where the violator of this Ordinance does not contest his or her
apprehension and elect to pay the fine imposed under the preceding paragraph,
the enforcement officer shall forthwith issue citation ticket to the person
apprehended without resort to the Court. The citation ticket shall state or contain
(a.) the name, signature, age and address of the person apprehended, (b.) the
material facts obtaining in the commission or omission of the crime defined and
penalized under this Ordinance, (c.) the amount of fine which is payable in favor

of the City Government of General Santos, and (d.) notice requiring the person
apprehended for extra-judicial settlement of his or her violation by paying the
prescribed amount of fine at the Office of the City Treasurer within seventy-two
(72) hours from issuance thereof, otherwise, appropriate complaint shall be filed
against him/her before the court of law.
Section 11. Amendatory Clause.- All Ordinances, Resolutions, Orders,
Memoranda and other Issuances inconsistent herewith are hereby amended,
repealed or modified accordingly.
Section 12. Separability Clause. If, for any reason, any part or provision of
this Ordinance shall be found to be unconstitutional or invalid, other parts or
provision thereof which are not affected thereby, shall continue to be in full force
and effect.
Section 13. Effectivity Clause. This Ordinance shall take effect
immediately after fifteen (15) days following the completion of its full publication
in any newspaper of general circulation in the City of General Santos.

Chapter III
RESEARCH METHODOLOGY
This chapter presents the method of how the study was conducted. This
establishes the research design of the study. It describes the setting of the
research, geographical area, data gathering procedure, and sampling technique,
instruments, including methods implemented to maintain validity.
Research Design
A descriptive research design was used. It means that descriptive
research gathers quantifiable information that can be used for statistical
inference on your target audience through data analysis. As a consequence this
type of research takes the form of closed-ended questions, which limits its ability
to provide unique insights. However, used properly it can help an organization
better define and measure the significance of something about a group of
respondents and the population they represent.
Research Locale
The study was conducted at the Eusebio Bulaong Public Terminal which is
located at General Santos City Hall and at the General Santos City Bulaong
Terminal (City Terminal) which is located at Brgy. North, General Santos City. The
place where the data is being gathered is a government facility where in the
staffs and officers employed by the government happen to be working.

Data Collection
The researcher sought suggestions and instructions from the instructors
about the research study to be conducted. The researcher requested for experts
and knowledgeable in research work to evaluate the validity of the interview
questionnaire. Comments and suggestions for any changes and further
improvement of the questionnaire were adopted.
The researcher prepared a brief introduction and cover letter, stating the
purpose of the study, importance of the respondents participation and the
assurance of confidentiality of responses.
A communication letter was sent to the City Administrators Office and
General Santos City Bulaong Terminal (City Terminal) thru the city program
coordinator to allow the researcher to conduct the said study sought permission
for the participation of staffs and officers as the respondents of the study.

The Data was collected through interviewing some officers and staffs in
the City Administrators Office and City Terminal Office. Interviewing could get us
more accurate results for the gathered information came from the most reliable
source through personal questioning.
These were the question asked:

What are the vehicles that park inside and outside of the terminal and
how are they organized?

How does the LGU of General Santos City develop parking management

3.

of Bulaong City Terminal in a particular situation?


What are their parking management laws, ordinances, rules and
regulations in the Bulaong City Terminal and how they can be improved?

And also some of the data were collected from the web as a part of strengthening
the research study.

Chapter IV
FINDINGS AND DISCUSSION
In this chapter, the data gathered from the staffs and officers of the City
Administrators Office and General Santos City Bulaong Terminal (City Terminal)
in relation to the research objectives. This chapter discusses the result of the
semi-structured questionnaires/interviews responded by the participants. Before
the initiation of the research study, the significance, rationale and purpose of the

study were provided respondents. Furthermore, the respondents have also been
given the assurance that all the data they will give are used for the purpose of the
research and the identities of the respondents will be confidential. The object is
to determine the parking management system at General Santos City Bulaong
Terminal. This is the manner unto which the study accounts the factors and the
perception on the criteria themselves.
The data gathered are as follows:
The following are the ordinances, rules and regulations being implemented and
followed in the Bulaong Terminal,
Ordinance 02 series of 2013
WHEREAS, the Eusebio Bulaong Public Terminal is the only authorized
public passenger transport station in General Santos City;
WHEREAS, the City of General Santos continues to grow as a city, both
economically and socially and recognizes the publics growing need for public
transport, especially in the commercial areas;
WHEREAS, allowing large commercial establishments such as malls to
put up satellite public utility van terminals shall provide easy access,
convenience and safety to the riding public;
WHEREAS, the Department of the Interior and Local Government issued
Memoranda Circular No. 2011-150 dated October 12, 2011, subject matter of
which is the reiteration of DILG-DOTC Joint Memorandum Circular No. 01,

Series of 2008, particularly on the guidelines in the establishment and operation


of Public Transport Terminals;
WHEREAS, this Ordinance shall further supplement and modify
Ordinance No. 08 Series of 2005, entitled An Ordinance Providing for the
Policies Rules and Regulations in the Operation and Maintenance of Eusebio
Bulaong Public Terminal located at Bulaong Subdivision Barangay Dadiangas
North, General Santos City and Other Purposes ;
Section 1. Short Title. This Ordinance shall be known as Public Utility Van
Satellite Terminal Ordinance of General Santos City.
Section 2. Definition of Terms. As used in this Ordinance, the following terms
shall mean:
a. Large Establishment- refers to an establishment with a building
gross floor area of at least (50,000) square meters or One Hundred (100)
stores.
b. Public Utility Van Satellite Terminal- refers to a station where
transport van vehicles load or unload passengers or goods situated in
some large establishments in General Santos City.
c. PUV Satellite Terminal Operator- refers to the commercial large
establishment authorized to operate a Public Utility Van Satellite Terminal.
Section 3. Qualifications. The Proponent PUV Satellite Terminal Operator or
large

commercial

qualifications;

establishment

must

possess

the

following

minimum

a.

Must be a resident of General Santos City and has

been operating the establishment for at least five (5)


consecutive years;
b.

Must have at least Five Hundred Million Pesos

(P500,000,000.00) capital;
c.

Must own the land, which should be at least one

hectare, to be used for this satellite Terminal;


d.

The establishment shall directly operate the terminal

without delegating to the van operators;


Section 4. Prohibition on the Use of Public Roads. The PUV Satellite
Terminal may be located within the commercial zone provided it is not along the
following major roads: Santiago Boulevard, Jose Catolico Sr. Avenue, Acharon
Boulevard, Pioneer Avenue, Pendatun Avenue and Magsaysay Avenue.
No PUV Satellite Terminal shall be set up and operated within a distance
of two kilometers from the other PUV Satellite Terminal.
Section 5. Facilities. The PUV Satellite Terminal shall, in addition to other
requirements of the Building Code, provide for:
(a) loading/unloading bays and vehicle lay-over areas;
(b) a ticket booth;
(c) covered, decent and comfortable waiting areas, and breastfeeding
room;

(d) clean comfort rooms for men, women, elderly and persons with
disabilities;
(e) a free and safe drinking station;
(f) garbage waste containers;
(g) a CCTV camera and sufficient security for safety; and
(h) at least one (1) emergency fire truck;
(i) availability of Information and Passenger Assistance Counters or
Personnel;
(j) appropriate and adequate signages;
(k) priority lane for persons with special needs specifically pregnant
women, mothers travelling with infants and/or small children and those with
physical disabilities.
Section 6. Fees. The following fees shall be levied upon:
a.) Terminal Fee. The public utility van satellite operators may charge
reasonable terminal usage fee to the public utility vans operating at the PUV
satellite terminals not exceeding P60.00;
b.) Departure Fee. The public utility vans will also pay P30.00 to the
operator as departure fee and which shall be remitted to the City Treasurers
Office;

The owner/operator is required to prepare daily departure report, copy


furnish the terminal overseer.
Section 7. Memorandum Of Agreement (MOA) with Van Owners/Operators.
For the efficient operation of the PUV Satellite Terminal, the commercial
establishment shall enter into a memorandum of agreement with the van
operators and drivers association on the use of the said Satellite Terminal.
Section 8. LTFRB Authority. There is hereby imposed the following
requirements to the owner, operator or driver of PUVs:
a.) The owner/operator shall secure a certificate of compliance from
the Office of the Land Transportation Franchising and Regulatory Board
(LTFRB);
b.) Business permit from the City Government through the
Business Permits and Licenses Division of City Mayors Office.
Section 9. Contract. The operator of the said public utility van satellite terminal
shall be given a two-year contract for its operation, renewable upon expiration of
the said contract.
Section 10. Penalty Clause. Any person or group of persons who violates this
Ordinance shall be punished by a fine of Five Thousand Pesos (P5,000.00) or
imprisonment of ten (10) days or both such fine and imprisonment at the
discretion of the Court.

If the violator is a group, association, corporation, partnership, or


cooperative, the group leader, president or manager shall additionally be liable
thereof.
Where the violator of this Ordinance does not contest his or her
apprehension and elect to pay the fine imposed under the preceding paragraph,

Title 36 Traffic and Transportation (Chapter IV)


Parking Area for Bus
Section 1. All passenger buses are hereby prohibited to go around the town
(General Santos Poblacion) picking up passengers.
Section 2. Passenger buses should park at the designated waiting station the
General Santos Park, Recreational area and along the market in Simplicio
Cagampang Street.
Section 3. The speed limit of all motor vehicles running in the Poblacion and
Lagao area shall be 5 miles per hour.
Section 4. Penalty Any driver found guilty of violating any provisions of this
ordinance shall be punished with a fine of not less than ten pesos (P10.00) nor
more than two hundred pesos (P200.00) or an imprisonment of not less than five
(5) days nor more than six (6) months and in case of recidivist, both fine and
imprisonment at the discretion of the court and subsidiary imprisonment in case
of insolvency.
Parking at Road-Right-of-Way

Section 1. It is unlawful for any land transportation to park over night on road
right of way.
Section 2. Any driver or owner of land transportation company will be both liable
if found guilty of the above provision and punished of a fine of not more than two
hundred pesos or an imprisonment of not more than six months or both fine and
imprisonment at the discretion of the court.
Parking Space/Terminal
Section 1. All provisions regarding designation of parking for passenger buses,
jeepneys, cargo trucks and tricycles embodied under Ordinance Nos. 8 and 23,
series of 1964, respectively; Ordinance No. 26, series of 1965, and Ordinance
No. 62 series of 1967, are hereby repealed.
Section 2. The following is hereby adopted:
1.

That all passenger buses including Minibuses without its own terminals

That portion of the Morrow Boulevard from corner Gallego Boulevard to West

Side Road and the Southwestern portion of General Santos is designated as


parking space for jeepneys going out and coming in from Kiamba, Maasim,
Calumpang,
5.

Siguel

and

Polomolok;

That the West Side road, Eastern side from corners Morrow Boulevard to

Cagampang
6.

Klinan,

Street

is

designated

as

parking

space

for

tricycles;

That no streets, alleys, and parks shall be utilized as terminal of public utility

buses and jeepneys except those mentioned in this Ordinance.


Section 3. Violation of this Ordinance shall subject the offender/offenders to a
fine of not less than P20.00 but not more than P50.00, or an imprisonment of not
less than 5 days, but not more than 15 days, or both at the discretion of the court.
Section 4. All other ordinance which may run counter with the provisions of the
ordinance is hereby deemed repealed.

Chapter V
CONCLUSION AND RECOMMENDATION
This chapter presents the conclusion and recommendation on the parking
management system of General Santos City Bulaong Terminal study.
Conclusion
Parking is and will remain an issue that affects everyone in the community,
from traffic management and law enforcement to attraction owners and residents
of nearby neighbourhoods. All types of systems will be needed to address the
parking challenge, from systems that provide parking availability at the regional
and lot-, floor-, aisle- or space-specific level to high tech parking reservation and
navigation systems.
Based on the findings, the following conclusions yield in the study. The
General Santos City Bulaong Terminal has a systematic procedure of arrivals
and departures of passengers commuting thru an organized parking
management system from General Santos City to other points of destination
using various public utility vehicles and enforces rules and regulations for orderly
vehicle movement, parking inside and outside, ensure public safety and lessen
the traffic congestion.

Recommendation
Based on the result of the study, the researcher recommended the
following:
1. Further study must be conducted also on the other public terminals
(especially in GSC public market) in General Santos City.
2. The future researchers should observed more to pertain a condition of
development of parking system.
