AMENDMENT OF BARANGAY ORDINANCE NO. 2012-018: AN ORDINANCE


AUTHORIZING THE INCREASE IN FEES AND CHARGES ASSESSED AND COLLECTED
FOR THE ISSUANCE OF CERTIFICATIONS, CLEARANCES, FILING AND SIMILAR
SERVICES RENDERED BY BARANGAY SAN LORENZO.

WHEREAS, Sections 152, 153 & 186 of Republic Act 7160, otherwise known as the
Local Government Code of 1991, authorizes the Barangays to impose and collect taxes, fees
and charges for services rendered;

WHEREAS, the Cluster I Barangay Captains had a meeting on October 20, 2012 at
Barangay Magallanes and agreed to have a uniform rate of fees and charges including the
imposition and collection of charges and penalties from business establishments operating
without a barangay business clearance or for non-renewal thereof;

WHEREAS, pursuant to the afore-cited provisions of law, the Sangguniang Barangay


enacted on April 6, 1993, Barangay Ordinance No. 92-93, Series of 1993 as amended on
January 20, 2011, Barangay Ordinance No. 2011-01, Series of 2011, which imposed the
collection of fees and charges for the issuance of certifications, clearances, permits and similar
services rendered by the Barangay;

WHEREAS, since the enactment and after a careful and comparative review of the
service fees and charges assessed by the different Barangays within Metro-Manila, there
arose a need to amend, revise or adjust the fees and charges currently being assessed and
collected by Barangay San Lorenzo, in view of the increase in the cost of materials and labor,
in operating the barangay office;

WHEREAS, in compliance with the requirement of law, a public hearing in connection


with this Ordinance will be held on June 20, 2014, to consult with the constituents and
stakeholders of Barangay San Lorenzo;

NOW, THEREFORE, IT IS HEREBY ORDAINED BY THE SANGGUNIANG


BARANGAY OF SAN LORENZO IN SESSION ASSEMBLED, THAT:

Section 1. This Ordinance shall be known as An Ordinance Amending BARANGAY


ORDINANCE NO. 2012-018 An Ordinance authorizing the increase in
fees and charges assessed and collected for the issuance of
certifications, clearances, filing and similar services from Barangay San
Lorenzo.

Section 2. Scope and Application - This Ordinance shall cover the increase in rates
of fees and charges for the following services:

1. BARANGAY BUSINESS CLEARANCE FOR NEW BUSINESSES / RENEWAL:


corporations, partnerships, single proprietorships, representative offices, dental &
medical clinics, Business & law offices, lessor and other judicial entities.

Rates for the Barangay Business Clearance will be based on the PAID-UP
CAPITAL indicated below:

The Barangay Business Clearance must be renewed yearly. Late renewal will be
assessed the existing rates and a 10% surcharge for every unpaid year.

Failure to secure a Barangay Business Clearance for a particular calendar year


shall be considered a late payment.

Failure to renew the Barangay Business Clearance for three (3) consecutive years
shall be considered a new business application.

Reprinting of Business Clearance (additional copy for change of business name, address or nature of

4. BILLBOARDS, SIGN BOARDS, NEON SIGNS AND OTHER OUTDOOR


ADVERTISEMENTS

The Barangay shall collect the following fees for billboards, signboards, neon signs
and other outdoor advertisements

Billboard/signboard, including, but not limited to, tarpaulin


banners or similar material:
Single Faced P300.00/ piece/ week
Double Faced P500.00/ piece/ week

Billboards or signboards for professional services P200.00/ year

Advertisement painted on building or structure P200.00/ year

Use of neon lights for the above billboards, an additional amount of P 100.00 per
square meter or fraction thereof of advertising space used shall be imposed.

Signs, signboards, advertisements and other signage, displayed at the place


where the business or profession is conducted, as well as in any public utility
vehicle, shall be exempted from the above imposition.

The sizes for the billboards and signboards shall strictly adhere to the standards
prescribed by the Business Permit Division of the Makati City Hall.

5. CLEARANCES FOR OTHER ACTIVITIES

Section 3. Repealing Clause. - All other Barangay Ordinance/s, rules and regulations or
part thereof which are in conflict or inconsistent with any provision of this
Ordinance are hereby repealed or modified accordingly.

Section 4. Separability Clause. - If a court of competent jurisdiction declares any provision,


section or part of this Ordinance invalid, such judgment shall not affect or impair
the remaining provisions, sections or parts that shall continue to be in full force
and effect.

Section 5. Effectivity. This Ordinance shall take effect upon its approval by the Sangguniang
Panlungsod of the City of Makati pursuant to Section 57 of Republic Act 7160 and
after ten (10) days from the date a copy hereof is posted in a bulletin board at the
entrance of the barangay hall and in at least two (2) other conspicuous places in
the barangay and published in a newspaper of general circulation in Makati City
pursuant to Section 59 of Republic Act 7160.

in the City of Makati.
