    JUDICIAL AFFIDAVIT- COMPLAINT OF

    PRIVATE COMPLAINANT
    NARCISA AQUINO

    OFFER OF TESTIMONY:
    1. To testify on material allegations relevant to the filing of this
    criminal complaint; and
    2. Other relevant matters pertinent to the instant complaint.

    I, NARCISA AQUINO, fully conscious that I am answering under oath the


    following questions propounded to me by ATTY. MELVA C. FUENTES, at
    the MLC Law Office, Balagtas St. Cebu City, this 19 th day of January 2017
    and fully aware that I may face criminal liability for the false testimony or
    perjury for any false statement or claim herein, hereby state:

    Q1: Please state your personal circumstances.


    A1: I am NARCISA AQUINO, 45 years old, married, Filipino and a
    resident of Pit os, Cebu City.

    Q2: What are the factual antecedents of the instant complaint?


    A2: At around 8:00 P.M. of December 26, 2016, my husband, Juan Aquino
    was walking along P. Del Rosario St. Cebu City on his way to our home from
    his work as a construction worker at Junquera St. Cebu City when an
    unidentified assailant shot him at his head.

    Q3: What happened next?


    A3: The assailant hurriedly fled from the crime scene leaving my husband
    suffering from an excruciating pain.

    Q4: What else happened?


    A4: A bystander nearby saw the incident and identified the assailant who
    was his co-worker named Eric Tugade.

    Q5: How did the bystander describe the identified assailant?


    A5: He was wearing a black jacket and a bull cap that time.

    Q6: What else transpired on that incident?


    A6: Few minutes thereafter, a concerned citizen called for a police
    assistance, where PO1 John Pino and SPO1 Cris Olarte responded to the crime
    scene.
    Q7: What did they do next?
    A7: They call the emergency respond unit that brought Juan to Vicente
    Sotto Hospital, however, due to severe injuries, my husband succumbed to
    death.

    Q8: After your husband succumbed to death, what efforts were made
    in order to positively identify the assailant, if any?
    A8: A police investigation ensued and the bystander, who witnessed the
    incident, recounted the incident and positively identified the assailant. During
    the investigation, the weapon used by the assailant was seen few meters from
    the crime scene.

    Q9: Upon learning some of the details of the identity of the assailant,
    what happened next?
    A9: Police officers arrived at the crime scene and conducted a hot pursuit
    leading to the arrest of the culprit.

    Q10: What do you want to pray to this Honorable Court?


    A10: That a case for MURDER and/or the appropriate criminal case be filed
    against Eric Tugade.

    Q11: Do you have anything else to say?


    A11: None.
