Beltran/12443 was working at ‘the BSO Main Jail, located at 555 SE lst Av, Fort Lauderdale, Broward County, FL. Specifically, Beltran was assigned to the Unit 1 - 4 Delta - Dayroom area while he was guarding innate Nikolas Cruz. Beltran tated that he requested that Cruz not drag his eandale on the ground while walking around the Dayroom area. Beltran indicated that he and Cruz then got into a physical altercation that resulted in Beltran going to the ground and Cruz taking Beltzan's conductive electronic weapon (here in referred to as CEW) from him. Beltran reported that the CEW discharged while he was attempting to gain control of it back from Cruz. BSO Detention Technician Horace/182¢9 stated that he observed Cruz rushing at Roltzan and striking Beltran; however, he lost sight of then as he began calling for stance as the fight continued, Beltran provided me with video surveillance of the incident and while watching the video gurveillance I observed the following: Cruz can be seen rushing at Beltran and striking Beltran with his left fist. Cruz can be sean taking Beltran to the ground, temporarily Jaying on top of Beltran, and then using hie right fiet to strike Beltran multiple times fon the top of the head, Beltran could be seen attempting to gain control of Cruz and getting on-top of Cruz at which point Cruz can be seen using hia right hand te take jeltran’s CEW out of the holeter on Beltran's duty belt. Cruz then briefly had posession of the CEW and could be seen attempting to wrestle the device away from Beltran at which point the CEW can be seen discharging before Beltran subsequently gains control over it again. Cruz then swings at Beltran and strikes Beltran several more times until Beltran uses hia right hand, containing the CEW, to strike at Cruz’s face. After being struck by Beltran, Cruz retreated to one of the seats located in the Dayroon area, at which point Beltran was able to take hin into custody. Thus, Cruz did then and there intentionally and unlawfully threaten by word or act to do violence to the person of Sgt. Beltran, of the Broward County Sheriff"s Office, coupled with an apparent ability to do 20, knowing at the time that Sgt. Beltran that violence was imminent, and said assault was committed with a deadly weapon, more particularly described az Beltran» CEW, without intent to kill, contrary to F.S. 724.011, F.8, 784.021 and F.8. 784.07(2) (c), (26) Also, Cruz did knowingly commit a battery upon Sgt. Beltran, a duly qualified law enforcement officer of the Broward County Sheriff's Office, while the said law enforcenent officer was engaged in the lavful performance of his duties, in that the said Nikolas Cruz did actually and intentionally touch or strike the said law enforcement officer against hie will, and at the time of such touching or striking, the defendant knew that Sgt. Beltran was a law enforcement officer, contrary to F.8. 784.03(1), F.S. 784.07(1)-(d) and F.S. 784.07(2) (b), (14). In addition, Cruz did then and there knowingly and willfolly use « self-defense cheaical spray, non-lethal electric weapon or device, or a dart-firing Stun gun, to-wit: a conductive electronic weapon, againat a law enforcement officer, to-wit: Sgt.
