(6447) ‘Suspect Hate / Bias Motivated Page 2 NARRATIVE | : REPORTING OFFICER NARRATIVE K Dekalb County Sheriff's Office 2014-03455 Vici Oe ‘atime Reported DUI ARREST Fri 1107/2014 22:54 Arrest Charges: Citation- 625 5/3-707 Operating Uninsured Motor Vehicle Citation- 625 5/11-501A2 DUI - 625 S/11-50lal DUI Over .08 1- 625 5/11-601B Speeding 70/55 MPH Zone Citation- 625 5/11-709A Improper Lane Usage (On the above date and time I was traveling westbound on Route 64 east of Five Points when [utilized my Golden Eagle Directional Il Radar Unit observing oncoming traffic eastbound on Route 64 where I observed a vehicle registering the speed of 70 MPH in a 55 MPH Zone. At this time there was only one vehicle traveling eastbound in range of my Golden Eagle Directional If Radar Unit. Lmaneuvered my marked DCSO squad car behind the above mentioned vehicle capturing the registration to be I followed the vehicle for some time le times in addition prior to stopping the vehicle I did observe it cross the white fog line with its passenger side tires. As the vehicle crossed Route 64 and Peace Road | initiated my ‘emergency lights in order to affect a traffic stop. The pulled over in the middle of an intersection. approached the vehicle and identified the driver as Trudy Jacobsen. I introduced myself including my name, title, department and reason for the stop. Ms. Jacobsen opened the door. I could immedi ately detect the odor of alcohol emanating from the vehicle. I observed her to be the only occupant of the vehicle, I asked her how much alcohol she had consumed this evening. She said she had two glasses of wine. I asked where she had consumed the wine at. She stated left. She then stated she had to drive a grad student home and she was only a few blocks from her residence. She then asked me again why I pulled her over. I again informed her she was speeding 70 MPH in a 55 MPH Zone and in addition she was weaving within her lane. She then asked if I had observed the vehicle in front of her. 1 informed her I observed her weaving. I asked for her driver's license and proof of insurance. She was able to provide a valid driver's license. returned to my marked DCSO squad car and insured she had a valid DL. At that time a Sycamore Officer arrived on scene to assist me. I then reapproached Ms. Jacobson and asked if she would pull her vehicle out of the intersection approximately 20 feet. She then sped away for some distance and entered a nearby cemetery. As she Pulled over I reapproached her and asked her to step out of the vehicle to perform some field sobriety tests. The area used for testing was dry, free and clear of obstructions and the pavement was level. There was good light provided by my squad car headlights and spot light. It was a mild night with no precipitation. The first test I offered was the Horizontal Gaze Nystagmus Test. I asked Ms. Jacobsen if she was wearing contacts. She said she was not. We proceeded with the test. I checked her eyes for equal pupil size. Her pupils were equal in size. I checked for equal tracking. Her eyes tracked equally. I checked her eyes for lack of smooth Pursuit. I began this test with her left eye and moved the stimulus approximately 12 inches from her eyes approximately 1 inch above her eyes from shoulder to shoulder. I made two passes checking both eyes for a lack of smooth pursuit. Her eyes did not track the stimulus smoothly showing nystagmus in both eyes. I checked for nystagmus at maximum deviation. I began this test with her left eye holding the stimulus for approximately 4 seconds at maximum deviation and then her right eye holding the stimulus for approximately 4 seconds I made two passes observing nystagmus at maximum deviation. I then made two passes to check for the onset of nystagmus prior to 45 degrees in each eye which I observed in each eye.
