    COMPLAINT-AFFIDAVIT

    I, CATHERINA GRAY, Filipino, 23 years old, single, and with residence at


    Legazpi City, after having been duly sworn in accordance with law, hereby
    depose and state that:
    1. This complaint-affidavit is being filed to charge Cardo Dalisay Duterte
    a.k.a “Cardo”, Filipino, of legal age, and with residence at Legazpi City,
    of the crime of Rape under Article (Art.) 266 of the Revised Penal Code
    (RPC), committed as follows:
    (a) On January 1, 2019, at around 7:00 in the evening, I went out
    to go to the public market;
    (b) While I was walking through the rice fields, not too far from
    our house, I noticed someone walking from behind to which I
    recognized as Cardo;
    (c) As courtesy, I greeted him “maray na banggi”, however he did
    not answer back but immediately punched me on the abdomen
    once;
    (d) I was able to run but he caught me and hit me with a rod-like
    object which I noticed that he was holding the moment I saw
    him;
    (e) I felt dizzy and fell on the ground, but I was still conscious;
    (f) Because of fear, I pretended to be dead hoping that he would
    leave me;
    (g)However, he started undressing me; pulling my jogging pants
    and removed my panty, blouse then bra;
    (h) He subsequently sucked my breast and kissed my lips, then
    forced his penis into my vagina. He started thrusting and
    pumping, and I felt an extreme pain in my vagina.
    (i) Thereafter, he donned his clothes. Before leaving he checked
    if I was still alive, but I held my breath. He covered my body
    with grass then, he left.
    (j) With all the trauma and pain, I lost consciousness. the
    moment I regained consciousness, it was already too dark.
    Since I could not stand up, I crawled my way into the bright
    lights and reached what I thought was the highway. I lied there
    the whole time and prayed that someone would save, and then
    I passed out again;
    (k) When I woke up, I was already at the hospital with my
    grandfather.
    2. The following day, I went to the police station to officially file this
    complaint.
    3. Based on the foregoing, it is beyond cavil that respondent Cardo
    Dalisay committed the crime of rape punishable under Art. 266 of the
    RPC. He had sexual intercourse with me without my consent.
