MEMORANDUM

For : NEPEAN Philippines Inc.


Re : Redundancy

In view of the cessation and overhauling of NEPEAN Philippines Inc. (the


“Corporation”), the position of ________________ has been rendered redundant by the
Corporation effective ____________________.

Therefore, the two (2) employees of the Corporation under the said position,
namely___________________ and ________________________ shall be terminated from
employment by reason of redundancy under Article 283 of the Labor Code. They shall
not be absorbed for any other function by the Corporation.

Pursuant to the pertinent provisions of the Labor Code, the dismissed employees are
entitled to a separation pay equivalent to one (1) month pay for every year of service
rendered to the Corporation (provided that a fraction of 6 months is considered 1 year)
in addition to whatever benefits that the dismissed employees may be entitled to under
the law.

Further, notices of redundancy should be given to Department of Labor and


Employment by the Corporation at least thirty (30) prior to effectivity of the
redundancy.

Attached are suggested Notice of Redundancy forms required to be filed with the
Department of Labor and Employment.

Please let us know when the redundancy notice will be served at least three (3) days
prior to giving out of the notice.
