AMICABLE SETTLEMENT WITH QUIT CLAIM

AND WAIVER OF RIGHTS
WE, SP03 ROMMEL P. ACACIO and PO3 JOEL J.

CASTILLO, of legal age, Filipinos, and with business and postal address
at the Philippine National Police (PNP) Ramon, Police Station, Ramon,
Isabela after having been duly sworn to in accordance with law, hereby
depose and say, that:
1. We are the very same persons executing this affidavit;
2. We are members of the PNP of good standing of PNP Ramon Police

Station, Ramon, Isabela;
3. Last September 24, 2018 in the early morning while we were

attending our regular and usual flag ceremony, I SP03 Rommel P.
Acacio received a cellphone call from our Chief of Police (COP)
with his instruction to proceed at Barangay General Aguinaldo as
reported there was a person creating a disturbance who entered a
portion of the greening program of LGU, Ramon, Isabela and serve
as escorts of the Local Chief Executive of this municipality;
4. We arrived in the area with the presence of Barangay Captain

Ernesto V. Ruiz, Jr., his two (2) tanods and some other persons and
persons inside the greening program of the LGU of Ramon, Isabela
later on identified as Enetiquio O. Navarette with his two (2)
companions clearing and cutting not fully grown trees in which said
site is just adjacent the road going to Magat High Dam and the Old
Alfonso Lista Bridge strategically located at an intersection;
5. At this point, The Chief Executive and the Barangay Captain

(Mayor Jesus D. Laddaran & Barangay Captain Ernesto V. Ruiz, Jr.)
conferred on how to approach Navarette but he stubbornly refused
to stop and advanced in Ilocano dialect “ADDA PAPEL KO AWAN
MAKALAPPED KANYAK” (I have papers no one can stop me);
6. With the Mayor in his few distance away, this time Enetiquio O.
Navarette in his confused struggle brandishing his bolo, being
uncooperative prompting us to grappled and grabbed the bolo which
was wrested from Navarette under pains of strenuous efforts;
7. To bolster of the foregoing, we respectfully attached the following:

a.) Affidavit of Barangay Captain Ernesto V. Ruiz, Jr., as
ANNEX “A”;
b.) Magkasamang Sinumpaang Salaysay of Barangay Tanods
Agustin M. Telan and Eliseo Agyatan as ANNEX “B”; and
many more who are going to testify of the assault made by
Enetiquio O. Navarette;
8. Enetiquio O. Navarette is an illegal settler and intruding a land of

the public domain in which the portion encroached is a part of the
National Greening Program (NGP) of Local Government Unit of
Ramon, Isabela as shown in the following:
a.) Memorandum of Agreement between the LGU of Ramon,
Isabela and the DENR-CENRO as ANNEX “C”;
b.) Letter of Award by the DENR-CENRO to LGU Ramon,
Isabela as ANNEX “D”;
c.) Notice to proceed issued by the DENR-CENRO to LGU
Ramon, Isabela as ANNEX “E”;
d.) Certification issued by the DENR-CENRO that LGU Ramon,
Isabela as partner agency as ANNEX “F”;
9. Although and according to respondent Navarette that he was a

holder of Memorandum of Agreement and or Stewardship from
DENR-CENRO is highly irregular and casts doubt considering that
a certification from the Record Office of the DENR-CENRO of San
Isidro, Isabela that they have no record as evidenced by a
certification hereto attached as ANNEX “G”;
10. That respondent Navarette is an illegal settler and or squatter, that

even his house is erected on a land of public domain as certified by
the Municipal Assessor of Ramon, Isabela hereto attached as
ANNEX “H”;
11. Records as herein attached will show that on several occasions in
the past Mr. Navarette was able to disposed properties via private
documents in spite of the fact that he does not have even any single
property declared for tax purposes in his name. He made it a habit
to occupy lands of the public domain and later on clear the forested
areas and offered the same for money. Respondent for several times
has made the disposition of the following land of the public domain
for personal satisfaction, to wit:
a. Waiver of rights in favor of Hannibal Bello involving 4,000
square meters being a portion of a parcel of land with an area of
1.0350 hectares;
b. Amicable settlement and Waiver of Rights showing payment of
a parcel of land in favor of Warlito Domingo;
c. Waiver of Rights executed by Enetiquio Navarette in favor of
Analiza B. Valdez
d. Waiver of Rights in favor of Barbara Ganer and Rolando Viado;
e. Waiver of Rights in favor of Severino Hael and Magdalena Hael;
f. Sinumpaang Salaysay of Marie Jane Castillo Saet as ANNEXES
“I”, “J”, “K”, “L”, “M” and “N”;
12. Enetiquio O. Navarette employing force with serious

intimidation and/or seriously resists a person in authority who at that
time were engaged in the performance of official duties or on the
occasion thereof, thus he is liable for DIRECT ASSAULT defined
and penalized under Article 148 of the Revised Penal Code;
13. Respondent could be served with subpoena and other

processes at:
