Chidambaram Case Study. B.NIHARIKA

Mr. P Chidambaram arrested on the grounds of INX media case on August 21, 2019. The former
finance minister and one of the prominent leaders of Congress was arrested in a highly dramatic
way by the Central Bureau of Investigation as he is the primary accused in the INX media case
which shook the nation. Now Mr. Chidambaram is under CBI custody now with as he was denied
bail.
After the arrest of the Former Finance Minister, he was sent to Tihar Jail by the Central
Bureau of Investigation for a 14-day judicial Custody. Let's see the events lead to the arrest of
Mr.P Chidambaram and solve the case using Toulmin method of augmentation. The Central
Bureau has arrested Mr. P Chidambaram to investigate multiple loopholes that are directed
towards Mr. P. Chidambaram's son Karthi Chidambaram getting involved in pulling Foreign
Direct Investment into INX media. Karthi Chidambaram clamoured for a fix with the founders of
INX media and persuaded his father into this case.
The whole case came into the spotlight when the Founder of Aircel has claimed that Karthi
Chidambaram involved in Aircel Maxis deal and stipulated for a fix. The Enforcement Directory
of India has conducted a raid at Karthi Chidambaram's office and was shocked by the revelation
of newly found illicit 400cr. An FIR was filed by Enforcement directory in 2017 against INX media
and in the immediate action, Indrani Mukherjee and Peter Mukherjee were arrested. In
February 2018, Mr. Chidambaram was summoned by CBI and he moved to Delhi High court for
anticipatory bail plea. He also applied for bail in ED case and Delhi HC approves his plea. In
August 2019, Delhi HC cancels its judgment on the anticipatory bails. Before his arrest, Mr.
Chidambaram appeared in front of media at AICC in Delhi and defended all charges against his
family and him. Mr. Chidambaram gets arrested in CBI case and was moved to 4 days CBI
custody. He withdrew his petition against a nonbailable warrant issued by the trial court and
was moved to Tihar jail for a 14 day trial period.
The warrant for this claim is that Ms Indrani Mukherjee has turned approver against Mr.
P.Chidambaram stating he lent a helping hand in pulling money into INX media.When Mr
P.Chidambaram was the Finance Minister during the years 2010-2014, his son Karthi
Chidambaram has asked him to help Indrani Mukherjee and Peter Mukherjee in money
laundering case .FIPB has approved investment of 4.8Cr in INX media. But Peter Mukherjee and
Indrani Mukherjee had pulled in 400 Cr additionally into INX without the approval of FIPB.INX
Media not only received Rs 305.36 crore in violation of FIPB rules, it also invested in 26 percent
equity in INX News without FIPB approval.As Mr. P.Chidambaram was in control of the Foreign
investment control board, he suggested the duo file for another approval for 300 Cr and he
approved the plea of the founders and this was caught in the raid by Enforcement Directory.
The CBI has arrested Mr. Chidambaram to establish 3 links. Firstly, there is no proper
evidence showing 26% equity investment in INX by FDI. Next is they have to establish with a
proof that Karthi Chidambaram has taken a bribe from the Mukherjees. Mr. Karthi has allegedly
asked the Mukherjees to make the payment through advance strategic consulting. Lastly, CBI
has to investigate if Chidambaram has influences and Congress and Finance department officials
for the approval of FDI.
Former FM has rebutted all allegations against him and a bail plea was made by an
agency on behalf of Mr. Chidambaram and the Delhi high court has asked CBI to respond on this
case by September 23. The Enforcement Directory has given time to Mr Chidambaram to
surrender by himself. The former minister tried to avoid his arrest but now he is trying to avoid
stay at Tihar. As all allegations against him are powerfully built, he might not be free of these
accusations.
