SUBJECT: SHOW CAUSE LETTER TO NOTICE FOR NEGATIVE SLIPPAGE

Sir;

This pertains to the Notice for the Negative Slippage dated September 04, 2019
and received by our field staff engineer last September 10, 2019.

In view of the Notice for the Negative Slippage, the undersigned most respectfully
aver that the accomplishment of the Project Contract No. NIAR6-COB-GYM-CW57-2019
will be accomplish on the contract duration of 120 calendar days. However, your letter
underscores that the basis of our work slippage was based on the submitted construction
program.

Please be informed that your Honorable Office provided us copies of the approved
Contract Agreement, Notice of Award and Notice to Proceed only on August 09, 2019. In
compliance with the Notice to Proceed, we submitted before the Record Section of
Region VI, the corresponding Construction Schedule in the form of PERT-CPM, S-Curve
and Cash Flow, including Performance Bond and copy of the required DOLE Construction
Safety and Health Program duly received by DOLE Region VI office for their evaluation and
approval.

Moreover, we designed our Construction Schedule in the timeline program


stipulated in the approved Contract Agreement of 120 calendar days and we believe in
good faith that we could finish the latter project on time. However, due to unforeseen
weather condition and some substantial factors affecting the consequent
accomplishment of the Project Contract No. NIAR6-COB-GYM-CW57-2019. The
construction of the Multi-Purpose Gym Phase I could not be accomplish in 120 calendar
days due to the following grounds:

1. Contract Agreement was approved last July 12, 2019 and the Notice to
Proceed was received only last August 09, 2019;

2. The project area was still utilized as a venue for significant activities of NIA
Region VI personnel in the observance of the yearly NIA Day celebration.

3. Unforeseen weather condition brought by typhoon Hannah and Jenny


distresses the working area to be impracticable and ineffectual.

4. Some necessary issues were discussed during the pre-construction


meeting held last August 15, 2019 at the Engineering Office such as:

A. NIA will secure cutting permits from the DENR.


B. NIA will work the issuance of Temporary Electric Facilities.
C. Immediate transfer of the Property Warehouse to pave way to the
excavation of new electrical lines.
In view of the foregoing, the undersigned most respectfully submit before your
Honorable Office, this Show-Cause Letter to justify the reason for the negative slippage
as per your letter dated September 04, 2019.
