DEED OF EXTRAJUDICIAL SETTLEMENT AND PARTITION

KNOW ALL MEN BY THESE PRESENTS:

This Deed is entered into and executed by and among the Heirs of TIMOTEO GRENGIO,
duly represented by his children, namely: EPIFANIO ________________,Heirs of the late
CRISTITUTO; LEONOR; CARMELITA; GREGORIO; TIRSO; DIOSCORO; MARIANITA;
ANECITO; and MARY ANN, all surnamed GRENGIO;

Heirs of LEONCIA GRENGIO, duly represented by her children, namely: PEDRO and
PRIMO, all surnamed TAGHAP;

Heirs of EUFROCINA GRENGIO, duly represented by her children MIGUELA;

MERCEDES; _____________Heirsw of JUANITA; Rey Ladag, Gilda Ladag, Jean Ladag,
Robert Ladag, Joy Ladag, and Hermogenes, Batal, Jr, Heirs of PRIMA; AVELINO; JUANITO;
JULIA; and CLARITA, all surnamed CALUGCUGAN;

Heirs of FELIPE GRENGIO, duly represented by his children, namely:____________,

surnamed GRENGIO;

WITNESSETH:

That the parties herein are all of legal age, Filipinos, and residents of the Municipality of
Sibulan, Negros Oriental;

That there are two parcels of land known as Lots Nos. 5205, consisting of NINE
THOUSAND SEVEN HUNDRED FORTY ONE (9, 741) square meters, more or less and Lot
No. 5882, consisting of FIFTEN THOUSAND THREE HUNDRED TWENTY SIX (15,326)
Square meters, more or less; both of the Cadastral Survey of Sibulan, Negros Oriental, located in
barangay Maningcao, Sibulan Negros Oriental, covered by Original Certificate of Title Nos.
OCT O-V-476 and OCT O-V-494, respectively, registered in the names of TIMOTEO,
LEONCIA, EUFRUCENA, FELIPE, PABLO, CIPRIANO, and SANTIAGO, all surnamed
GRENGIO, and which parcels of land are more particularly described in their respective titles
abovementioned;

That there is also a parcel of land known as Lot No. 5204, of the Cadastral Survey of
Sibulan, located in barangay Maningcao, Sibulan, Negros Oriental, covered by Original
Certificate of Title No. 0V-466 consisting of THIRTY EIGHT THOUSAND TWO HUNDRED
FORTY EIGHT (38,248) square meters, more or less is registered in the names of TIMOTEO,
LEONCIA, EUFRUCENA, FELIPE, PABLO, CIPRIANO, SANTIAGO, all surnamed
GRENGIO, and ATILANO, JOSEFINA, ANDRES, LUIS, and CATALINA, all surnamed
FONOLLERA;

That the aforementioned registered owners of Lots Nos. 5204, 5205 and 5288, all died
intestate sometime ago, leaving without any testamentary will nor debts not settled until the
present and upon their deaths they were survived by their legitimate, children and only
compulsory heirs, the parties herein;

That invoking the provisions of Section 1, Rule 74 of the New Rules of Court and in
accordance with the laws on intestate succession, the herein Heirs all the registered owners of
Lots Nos. 5204, 5205, and 5288, by these presents, DO HEREBY settle and adjudicate unto
themselves the above-described parcels of land, in accordance with their rights, interests and
participations over the same.

That the parties herein have caused the consolidation and subdivision of the
aforementioned Lots Nos. 5204, 5205 and 5288 into twelve sub-lots, namely: Lot No. 1, with
an area of One Thousand Four Hundred Thirty Four (1,434) square meters, more or less; Lot
No. 2, with an area of Four Thousand Seven Hundred Eighty (4,780) square meters, more or less;
Lot No. 3, with an area of Four Thousand Seven Hundred Eighty (4,780) square meters, more or
less; Lot No. 4, with an area of Four Thousand Seven Hundred Eighty (4,780) square meters,
more or less; Lot No. 5, with an area of Three Thousand Three Hundred Forty Six (3,346) square
meters, more or less; Lot No. 6, with an area of Four Thousand Seven Hundred Eighty (4,780)
square meters, more or less; Lot No. 7, with an area of Four Thousand Seven Hundred Eighty
(4,780) square meters, more or less; Lot No. 8, with an area of Four Thousand Seven Hundred
Eighty (4,780), square meters, more or less; Lot No. 9, with an area of Seven Hundred Twelve
(712) square meters, more or less; Lot No. 10, with an area of Five Thousand Four Hundred
Eight Two (5,482) square meters, more or less; Lot No. 11 with an area of Ten Thousand Nine
Hundred Sixty Two (10,962) square meters, more or less; and Lot No. 12, with an area of Ten
Thousand Two Hundred Fifty (10,250) Square meters, more or less;.

That, in order that the rights, interests, and participations of the parties over the said land
be better served, they have mutually and voluntarily agreed to officially partitioned and
adjudicated unto themselves the above-described sub-lots into the following manner and forever
be bound therein:

1. Lot No. 1, consisting of 1,434 square meters, more or less, shall belong to the Heirs
of TIMOTEO GRENGIO, namely: MARIANITA, ANECITO, and MARY ANN, all
surnamed GRENGIO;
2. Lot No 2, consisting of 4,780 square meters, shall belong to the4 Heirs of LEONCIA
GREGIO, namely PEDRO and PRIMO, all surnamed TAGHAP;

3. Lot No. 3, consisting of 4,780 square meters, more or less, shall belong to the Heirs of
Cipriano Grengio, namely: APOLINARIO, BIENVENIDO, and JOCELYN, all
surnamed GRENGIO;
4. Lot No. 4, consisting of 4,780 square meters, more or less, shall belong to Heirs of
SANTIAGO GRENGIO;

5. Lot No.5, consisting of 3,346 square meters, more or less, shall belong to Heirs of
TIMOTEO GRENGIO, namely: EPIFANIO, Heirs of CRISTUTO, LEONOR,
CARMELITA, GREGORIO, TIRSO and DIOSCORO, all surnamed GRENGIO;

6. Lot No. 6, consisting of 4,780 square meters, more or less, shall belong to the Heirs
of PABLO GRENGIO, namely; Pablo, Jr. and Gregorio, all surnamed GRENGIO;

7. Lot No. 7, consisting of 4,780 square meters, more or less, shall belong to the Heirs
of FELIPE GRENGIO;
8. Lot No. 8, consisting of 4,780 square meters, more or less, shall belong to the Heirs
of EUFRUCENA GRENGIO;

9. Lot No. 9, consisting of 712, square meters, more or less, shall belong to Heirs of
ATILANO and LUIS FONOLLERA, in equal shares;

10. Lot No. 10, consisting of 5,482 square meters, more or less, shall belong to the Heirs
of CATALINA FONOLLERA;

11. Lot No. 11, consisting of 10,962 square meters, more or less, and the One Fourth(1/4)
of which consisting of 2,741 square meters, more or less, shall belong to the Heirs of
Josefina Fonollera and the remaining Three Fourth (3/4 ), consisting of 8,221 square
meters, shall belong to the Heirs of ANDRESS FONOLLERA;

12. Lot No. 12, consisting of 10,962 square meters, more or less, shall belong to the Heirs
of ATILANO FONOLLERA and LUIS FONOLLERA, in equal undivided shares;

That further, the parties herein declare that the said parcel of land is not tenanted nor
worked upon by an agricultural lessee for the herein parties are the ones in possession of the said
parcel of land and that this transaction is in consonance with the provisions of the
Comprehensive Agrarian Reform Law of the Philippines because this lots belong to their
respective retention limits.

IN WITNESS WHEREOF, we have hereunto affixed our signatures this ____day of April
