EMPLOYMENT CONTRACT

KNOW ALL MEN BY THESE PRESENTS:

This contract made and entered into by and between:

__________________, a company duly registered and existing under the laws of the Republic of the
Philippines, with principal business address at __________________________, Davao City, represented
herein by its proprietor ____________________________, hereinafter referred to as the EMPLOYER;

-and-

________________________________________, and a resident


of__________________________________, of legal age, and hereinafter referred to as the EMPLOYEE;

WITNESSETH:

WHEREAS, the Employee applied for, and is willing to work as (__________________________),


with the commitment and guarantee to perform the work in accordance with the Rules, Regulations, Policies
and Instructions of the Employer and subject to the strict procedure and service standard imposed by the same;

WHEREAS, the Employer agrees to hire the services of the Employee as above-stated;

NOW THEREFORE, for and in consideration of the foregoing basic premises, herein parties agreed
and covenanted under the following terms and conditions, to wit:

1. PROBATIONARY PERIOD:

a. The Employee agrees to undergo a probationary employment period of ______ (___)


months starting from ___________. However, upon evaluation and the employee has
satisfactorily met the performance expected of him/her, said employee shall continue the
probationary period until the next probation, after which, another evaluation will be had.
The stated probationary period may be lessened if Employee’s performance during the
said period exceeds the expectation of the Employer;

b. Subject to the applicable provisions of the Labor Code as amended, the Employer
reserves the right to terminate the services of the Employee at any given time prior to the
expiration of the probationary period, if and when at the sound discretion of the
Employer, the Employee is not fit to his work designation or has violated the provisions
of the Company Manual and Disciplinary Chart ;

2. COMPENSATION

a. The Employer agrees and the Employee accepts a basic salary of _____________
(____Php) per day.
b. The Employer agrees and the Employee accepts a 13th month salary of _______________
to be divided into twenty four pay-outs in the amount of __________________ and given
in addition to his/her salary every pay-out.
c. The pay-out for the payroll period of the first 15 days of the month shall be on the
_________________( 20th of the same month), while the pay-out for the payroll period of
16th to 30th of the month shall be on _______________ (at the 5th of the following month).

3. HOURS/DAYS OF WORK

a. The Employee shall render work for ____(___) hours per day and Six (6) days per
calendar week, or an equivalent of ________ (xx) hours a week. Rest time is 12:00 to
13:00 hours each day of work. However the Employer may require the Employee to
render overtime during the latter’s day-off or during holidays subject to the additional
compensation as prescribed by the Labor Code;

b. The Employee shall see to it that he is at his work area before his actual working time
to facilitate the beginning of work at exactly on the required starting time;
4. GENERAL PROVISIONS

a. The Employee’s duties and responsibilities are geared towards fulfilling the vision,
mission and objectives of the Company. He shall be directly reporting to the
_________________________or his representative in accordance with the position
description of the job.

b. The Employee is provided initial orientation by the Company’s Officers particularly


on the Company’s Code of Conduct and Discipline, and Rules of Discipline,
Personnel and employment–related Policies and that the employee has further
understood the same. The immediate Supervisor shall see through these and provide a
briefing on matters appertaining to the job and will advise him/her of his/her particular
work schedule;

c. Employee’s immediate Supervisor shall periodically evaluate his/her work performance


in relation to the requirements of the position.

d. The Company reserves the right to discontinue the Employee’s services anytime during
the period of the probation should he/she fails to meet the performance standards nor
follow the Company’s Code of Conduct and Discipline, or for other just causes provided
by law.

e. It is agreed and understood that the Employee’s continued employment with the
Company will depend on the progress of his/her work and how ably he/she has performed
his/her duties and responsibilities. Upon meeting the standard requirements of the job, the
Company shall elevate the Employee’s employment to a Regular Status and he/she will
be entitled to all the benefits enjoyed by a Regular Employee.

5. EFFECTIVITY

This contract shall take effect on ___________________________or on the date the


Employee shall actually report to work;
