OPPOSITION
[TO THE MOTION FOR DEMURRER]

PLAINTIFF, by counsel, respectfully opposes the motion of plaintiff for

demurrer, and in support of such opposition do hereby states:

1. On 27 April 2008, plaintiff received a copy of defendant’s Motion for

Demurrer [“Motion”].

2. Defendant prays that this Honorable Court order the acquittal of the

accused of the crime of Piracy on the ground that the prosecution has failed to show

that the passengers actually lost specific belongings and that absent proof of any loss

on the part of any of the passengers, the claim of violation of Article 122 of the

Revised Penal Code on Piracy is untenable.

3. There is no doubt that plaintiff was able to sufficiently prove by

evidence that accused committed the crime of Piracy and showing the elements of the

crime under Article 122 of the Revised Penal Code:


3.1 Accused boarded the vessel without authority

3.2 Accused is not a member of the vessel’s complement nor a

passenger

3.3 Accused seized the personal belongings of its complement or

passengers.

4. Proof of the specific items lost by passengers is immaterial to

prosecution or conviction of the crime of Piracy.

PRAYER

WHEREFORE, it is respectfully prayed that Accused PEPE PAWIKAN’s

Motion for Demurrer be denied.

Other just and equitable reliefs are also prayed for.
