Amendment IV.
The right of the people (you and I) to be
secure in their persons, houses, papers, and
effects (computer, cell phone, bank accounts,
DNA, etc.), against unreasonable searches
and seizures, shall not be violated, and no
Warrants shall issue, but upon probable
cause, supported by Oath or affirmation
(swearing out a warrant), and particularly
describing the place to be searched, and the
persons or things to be seized.
Government data basing (Data Mining)
• Operating between 1967 and 1973, over 5,925 foreigners and 1,690 organizations and
US citizens were included on the Project MINARET watch lists (among whom Malcolm X,
Jane Fonda, Joan Baez, Martin Luther King, etc.), a sister project to Project SHAMROCK.
• The Foreign Intelligence Surveillance Act of 1978 was voted by the Congress after the
exposure of the latter. The United States Foreign Intelligence Surveillance Court (FISC) is
a U.S. federal court authorized under 50 U.S.C. § 1803.
• In the United States, the DNA Identification Act of 1994 formally authorized the FBI to
operate CODIS (Combined DNA Index System). It was completed by the DNA Analysis
Backlog Elimination Act of 2000, which was amended by the USA PATRIOT Act, Title V.
• The FBI is currently the subject of a lawsuit brought by the Electronic Frontier
Foundation (EFF) because of a lack of public notice describing their database and the
criteria for including personal information, as required by the Privacy Act of 1974. The
lawsuits are a result of two Freedom of Information Act requests filed by the EFF in 2006.
• In 2006 the existence of the NSA call database was revealed. It is estimated that the
database contains over 1.9 trillion call-detail records. Project Stellar Wind efforts began
approximately seven months before the September 11, 2001 attacks.
• Fusion center was started as a joint project between the Department of Homeland
Security and the US Department of Justice's Office of Justice Programs between 2003
and 2007.
• The United States Air Force created, after the September 11, 2001 attacks, a
controversial database, TALON (Threat and Local Observation Notice) included lists of
anti-war groups and people who have attended anti-war rallies.

“Weighing all considerations, the researchers concluded
that the best option would be a 6,000-person hybrid force
headquartered in the U.S. Marshals Service. The
personnel in reserve status could be employed in state
and local police forces so they would be able to exercise
police functions in a civilian population daily and could be
called up as needed.
The Marshals Service was deemed to have many of the
requisite skills. However, its training and management
capabilities would need to be expanded to take on this
large mission, and it would have to recruit additional
personnel as well. The annual cost, $637 million, is
reasonable given the capability it buys. The cost savings in
relieving military forces of these duties could be greater
than required to create the SPF.
The Military Police option was attractive for a number of
reasons, especially its capacity, training, and logistical
capabilities, but its inability to engage in policing activities
when not deployed was a major stumbling block. The
Posse Comitatus Act precludes military personnel from
exercising police functions in a civilian setting, and
legislative relief might be difficult to get. Even if such relief
were forthcoming, it is unclear where and how routine
police skills might be honed.”

The Alaska National Guard, in coordination with
nearly 50 organizations and more than 4,000
participants, conducted their state’s portion of
the annual Vigilant Guard exercise from April 26
-- May 1, 2010. Local governments, the State of
Alaska, Alaska National Guard and Joint Task
Force Alaska conducted a state-wide
exercise that was designed to “increase
emergency response capabilities” to
earthquakes and natural disasters. The exercise
scenario involved an earthquake affecting South
Central Alaska and combined the state’s Alaska
Shield exercise, National Guard’s Vigilant Guard
exercise, and Joint Task Force Alaska’s Arctic
Edge exercise. A major component of the
exercise involved the expertise of the National
Guard CBRNE Enhanced Response Force
Package, which deals with chemical, biological,
and radiological disaster response. The National
Guard describes the importance of the exercise
in building “synchronization” between local and
federal authorities.

From September 15-18, the Montana
National Guard will be performing a joint
exercise with FEMA and NORTHCOM to

natural and manmade disasters. The

exercise in March and another round of

the Vigilant Guard exercises, but an
“AMALGAM DART exercise involving air
defense activities at Camp Rilea, Oregon”

Capabilities
7-1. State National Guard Reaction Force (NGRF)
a. Overview. Formed from current units and personnel resources, the
NGRFs are designed to be rapidly deployable battalion-sized “all-
hazards” temporary task forces. They are capable of supporting law
enforcement by providing site security, presence patrols, show of
force, establish roadblocks and/or checkpoints, control civil
disturbances, provide force protection and security for Weapons of
Mass Destruction-Civil Support Team (WMDCST) or Chemical,
Biological, Radiological, Nuclear and high-yield Explosives (CBRNE)
enhanced response force package (CERFP) operations, or respond to
and assist in protecting selected assets.
• Any deployment of troops (or rumors thereof) to the field (CONUS) or the
militarization and federalization of state and local police forces give citizens cause
for pause.
• When the citizens have lost faith in their Government, they no longer believe
Government is working in the peoples best interest.
