METHOD OF MEASUREMENT (“MoM”)

To fulfil the scope of Works related to this project, the Contractor shall execute the
scope of Works as specified and reference to Contract documents. This Method of
Measurement (MoM) describes the method in which the respective line items in the
Bill of Quantities (BOQ) are to be measured and priced in accordance with the
Technical Specifications and terms and conditions of the Contract.

Contents of Bill of Quantities (BOQ)

The Bill of Quantities has been divided into the following Portions, which are
tailored to the TS Portion 1A through Portion 5:

• Portion 1A - Preliminaries (Fixed Lump Sum Price)


• Portion 1B - Preliminaries, Enabling and General Works
• Portion 2 - Site Works: Excavation & Transportation Works
• Portion 3A - Site Works: Remediation Works – TPH >1% - ≤ 5%
• Portion 3B - Site Works: Remediation Works – TPH >5% - ≤ 7%
• Portion 4 - Site Works: Remediation Works – TPH >7%
• Portion 5 - Site Works: Existing Landfill Expansion

Each of the above Portions include a variety of subtasks to be completed as detailed


within the Contract and as implied there from.

GENERAL NOTES

I. PREAMBLES

i. The priced BOQ represents the Works to be carried out in accordance with the
Contract. Descriptions contained in the BOQ represents the outline of the scope of
the respective item of work and proper reference is made to other parts of Contract
documents for complete information for pricing. Where appropriate, items are
cross-referenced to the Technical Specifications and other parts of Contract
documents.

ii. The Contractor shall be deemed to have included all necessary costs for Portion 1A
(Preliminaries, HSE studies, Temporary Works and Enabling Works) against the
respective items in the BOQ and shall not include an allowance for any such rates
or sums in any measured item of Portions 1B, 2, 3, 4, 5 and 6 of the BOQ.

iii. The Contractor shall allow in the Unit Rates for protecting all Works against
damage by whatever method is deemed necessary.

iv. The Unit Rate against each item in the BOQ shall be comprehensive and shall
include all matters and activities necessary for the proper engineering, design,
execution, and completion of the Works irrespective of access conditions, slope,
nature of ground, presence of oil or water or any other conditions. No claims for
additional payment will be allowed for any error or misunderstanding by the
Contractor of the work involved.

v. The Unit Rate for each item shall allow for all unforeseen costs, specific item(s) of
works not specified and/or included in the BOQ and expenses in complying with
all general risks, liabilities and obligations set forth or implied in the Drawings,
Specifications and the Contract including, but not limited to, the costs of the
following:
• Protection of all Works during transportation and construction activities;
• Any downtime (inclement weather, delays due to Contactor’s negligence
and Defects in the Works) shall be accounted for in the Unit Rates;
• Providing Work Plans, Method of Statements, Reports, deliverables and
other necessary required documents as per Contract requirements;
• Disposal of any wastes generated by the Contractor for its own operation
and maintenance of facilities, transportation fleet or equipment through
performance of the Works including all associated fees;
• Providing GIS data’s formats in preparing documentation and reports;
• Providing portable camera to record progress of the Project, key events and
activities from beginning to end including preliminaries, enabling works,
E&T, remediation technologies, landfilling and backfilling. Providing fixed
camera to monitor progress at Treatment Areas/Pads;
• Familiarization / Training of Company staff – during execution treatment
used;
• Cost for Air Conditioner Requirement in Heavy Equipment
• Cost in installing video surveillance system around the remediation/
treatment areas consisting of several video cameras with full view of the
entire areas in accordance but not limited to Clause 4.3 of Technical
Specification Portion 3 & Clause 4.3 of Technical Specification Portion 4
• Cost for capturing video and photography during the contractual period.
Various activities are to be recorded, including: key events, information
videos, monthly remediation progress activities, end-of-year summation
videos in accordance but not limited to Clause 9.6 of Technical
Specification Portion 1(A&B).

• Inclusive of costs associated with Contractors proven attempts to obtain, in


accordance with Technical Specification Portion 1(A&B), energy through
renewable energy sources and water conservation and re-use for the
following;

o Contractor and Company’s Field Offices, 20% supplied by renewable


energy and energy savings.
o Recycling and re-use segregation bins for papers, plastics, garbage’s,
glasses.
• Grey or treated water: conservation, recycling and re-use for 30% of treated
water to meet the project objectives and minimize the water usages
throughout the project duration. All Unit Rates for civil/construction
activities shall include allowance in providing UXO escort One (1) UXO
Level II per team at significant activities/areas with a potential UXO
anomalies;
• Providing UXO Construction Support to all civil works construction
activities (i.e. BAC, Survey works, excavation, treatment, stockpiling,
restoration and other civil works mentioned in the Contract);
• Pre-or Post-treatment activities;
• Providing signage boards or other signage safety, hazard, UXO etc. to the
excavation or remediated areas and delineated wooden posts in accordance
but not limited to Clause 16 of Technical Specification Portion 1(A&B);
• Maintenance of applicable Project Works in accordance but not limited to
Clause 11.3 of Technical Specification Portion 1(A&B);
• All required tests, inspections and trainings;
• Securing required permits, licenses or the like from State of Kuwait
Government and/or non-Governmental institutions/authorities as
applicable. All applicable taxes, duties, charges, import/export
duties/charges, government levies, landing charges, transport and the like
not mentioned in the BOQ line items;
• Temporary Works and other incidentals necessary to complete the Works;
and
• Compliance with all HSE requirements including provision of
environmental controls and mitigations; and providing emergency clinics
with trauma certified medics and ambulances.
• All costs associated with any / all interfaces with other Company nominated
Contractor(s) are to be included within Contractors Unit Rates
• Water or dust suppressions to prevent dust emission during execution of
works

vi. In relation to the Unit Rates herein, no claim shall be entertained for loss of
overhead or profit because of any variation, omission or addition, or because of
Contractor’s method of pricing.

vii. The Unit Rates for all personnel to complete the Works shall be deemed to be
inclusive of all mobilization and demobilization and for all ancillary costs,
including but not limited to, flights, accommodation, subsistence, in-and out
country transport, import/export duties and taxes etc.

viii. The Unit Rates shall be valid for the entire duration of the Contract and any
extensions thereof. No adjustment in the Unit Rates shall be allowed for any
increase or decrease in the estimated quantities.

ix. All Unit Rates are independent and not extra over unless specifically stated to the
contrary, thus only one Unit Rate shall apply to any item of measured work except
where specifically stated otherwise.

x. The Clause(s) of each item in the MoM is assigned at the relevant marginal heading
of the Bill of Quantities for cross reference but will not be limited to the mentioned
specific Clauses.

xi. The MoM and BOQ shall be read in conjunction with all other documents forming
the Contract, all of which shall be taken as mutually explanatory.

xii. The Contractor is referred to the Specification for the description and detail of the
standard of workmanship and material required for the Work.

xiii. Contractor shall be deemed to have understood and accepted the methodology by
which the BOQ has been prepared and is and will be priced accordingly.

II. MEASUREMENT

i. Detail calculation shall be up to two (2) decimal places. The total of all detail
calculations shall be rounded to the nearest units of measurement.
ii. The quantities are estimated in BOQ and may be varied, and actual quantities will
be determined and measured in accordance but not limited to Clause 12.5 of
Contract Specification.
iii. The item / quantities may be used in whole, in part or not at all and the Company
accepts no responsibility for the accuracy of the items and quantities.
iv. The BOQ defines the items, their quantities and the units of measurement under this
Contract. The BOQ are supplemented by measurement rules detailed herein.
v. The MoM shall prevail throughout the Contract notwithstanding any trade, local or
general custom and shall be used in the adjustment of all measured variation, or

further measurement or re-measurement, if any.


vi. All items or work is measured net as fixed in position.
vii. The use of hyphen between two dimensions in the BOQ shall mean a range of
dimensions exceeding the first dimension stated but not exceeding the second.
viii. Remeasuring of the quantities shall use same principles and method used to estimate
quantities in BOQ.

III. VERIFICATION OF MEASUREMENT

i. All measurements and records for the purpose of payment shall be made jointly by
the Company & Contractor in accordance but not limited to Clauses 12.5 & 12.7 of
Contract Specification.
ii. Measurement Plan shall be provided by Contractor and shall be submitted to
Company for approval.
IV. COORDINATION
The Contractor shall make due allowance in the Unit Rates for executing the Works
in cooperation and coordination with the works being executed by others, and
sequence and program the Works accordingly.

V. REGULATORY REQUIREMENTS
Unless otherwise required by the Contract, all costs of statutory requirements,
including obtaining any required permits, licenses and any other such statutory
requirements shall be inclusive to be included in the Unit Rates and/or Lump Sum.

VI. ABBREVIATIONS

PORTION 1A – PRELIMINARIES

1A.1 CONTRACTUAL PRELIMINARIES

1A.1a Bonds and Guarantees

The Lump sum price for bonds and guarantees shall cover all costs and expenses
incurred in obtaining, providing and maintaining all bonds and guarantees to be
provided by the Contractor in accordance but not limited to Clause 16 of Contract
Specification and Clause 40 of General Conditions of Contract.

1A.1b Insurances

The Lump sum price for insurances shall cover all costs and expenses incurred in
obtaining and maintaining all insurances to be provided by the Contractor in
accordance but not limited to Clause 9 of Contract Specification and Clause 39 of
General Conditions of Contract.

1A.2 HSE STUDIES

1A.2a Project Conceptual HSE Plan and Health Safety and Environmental Reviews
(PHSER 3, 4, 5 & 6)

The lump sum price for Project Conceptual HSE Plan and Health Safety and
Environmental Reviews (PHSER 3, 4, 5 & 6) shall include but not be limited to,
preparation, submission, performance of sessions Project HSE, PHSERs, HSE Plan
and HSE final reports, execution, compliance monitoring and required approval of
Project HSE plan on the basis of Company Conceptual HSE plan and PHSER 3, 4,
5 & 6 deliverables and closing & approval of all pending items, in accordance but

The lump sum price for Hazard Identification (HAZID) shall include but not be

required approval of HAZID deliverables (i.e. final reports, etc.), in accordance
with Clauses 8.0 & 8.3 of Contract Specification and Clauses 13.2 & 13.3 of
Technical Specifications Portion 1(A&B), whether or not they are specifically
mentioned within the item description.

1A.2c Hazard and Operation (HAZOP)

The lump sum price for Hazard and Operation (HAZOP) shall include but not be
limited to, preparation, submission, execution and compliance monitoring and
required approval of HAZOP deliverables (i.e. final reports, etc.), in accordance
with Clauses 8.0 & 8.3 of Contract Specification and Clauses 13.2 & 13.3 of
Technical Specifications Portion 1(A&B), whether or not they are specifically
mentioned within the item description.

1A.2d Quantitative Risk Assessment (QRA)

The lump sum price for the QRA shall include but not be limited to, preparation,
submission, execution, compliance monitoring and required approval of QRA
deliverables, as contained in Clauses 8.0 & 8.5 of Contract Specification and
Clauses 13.2 & 13.3 of Technical Specifications Portion 1(A&B), whether or not
they are specifically mentioned within the item description.

1A.2e Environmental Social Impact Assessment (ESIA) Studies & Reports inclusive
Environmental Management Plan and Progressive Environmental Monitoring
Reports

The lump sum price Environmental Social Impact Assessment (ESIA) Studies &
Reports inclusive Environmental Management Plan and Progressive
Environmental Monitoring inclusive of Environmental Management Plan and
Progressive Environmental Compliance Monitoring Testing and Reports during
Contract duration shall include but not be limited to, preparation, submission,
execution of comprehensive studies, preparation and submission of ESIA reports,
execution of environmental compliance monitoring and reporting during the
contract duration and obtaining permits, approval of ESIA deliverables, in
accordance but not limited to Clauses 8.0 & 8.4 of Contract Specification and
Clauses 13.2 & 13.5 of Technical Specification Portion 1(A&B), whether or not they

1A.3 Mobilization of Mobile Site Offices and Temporary Site Offices

The lump sum price for Mobilization of Mobile Site Offices and Temporary Site
Offices for the period of the Contract, shall include but not limited to all costs
necessary in mobilizing all such temporary facilities to/from the project site
including but not limited to supply, construction, handling, procurement,
importation, clearing, grubbing & levelling of soils and all civil works related to
this item, approval of locations and subsequent re-exportation of materials, waste
handling and disposals and vehicles of whatever type or size required for the
performance of the Work, provision of necessary certification, custom Clearance,
duties, taxes, levies, obtaining necessary permits & licenses required to operate at
Work site for the execution of the Work, whether or not they are specifically
mentioned within the item description. Suitable facilities in accordance but not
limited to Clause 8.10 of Technical Specifications Portion 1(A&B), the price for
Mobile Site Office & Temporary Site Offices and Facilities shall be in accordance
but not limited to Clause 7 and Appendix IV of Contract Specification.

1A.4 WORK RELATED PRELIMINARIES, TEMPORARY WORKS AND


ENABLING WORKS
1A.4a WORK RELATED PRELIMINARIES - For Technical Specification Portion 1
(A&B), 2, 3 and 4 Works

1A.4a.1 High Resolution Satellite Imagery – Preliminary Works

The lump sum price to obtain and/or acquire High Resolution Satellite Imagery over
the areas of interest (full aerial coverage) in accordance but not limited to Clauses
8, 8.2, 13.1.2 & 13.6.1 of Technical Specification Portion 1(A&B) shall include, but
not be limited to utilization of all necessary labour, vehicles, software’s, computer,
office equipment, stationaries, office consumables, interpretation, processing,
providing working drawings, permits, authorizations, notifications, calculations,
including submission of any other relevant documents and deliverables, providing
sufficient number of drawings, whether or not they are specifically mentioned
within the item descriptions.

1A.4a.2 UXO Project Final Reports including Project GIS Database (s): For GIS +
Geophysical Survey + Clearance

The lump sum price for UXO Project Final Reports including Project GIS Database
(s): For GIS for Geophysical Survey + Clearance in accordance with Clause 10 of
Technical Specification Portion 1(A&B) shall include, but not be limited to

The rates for undertaking Groundtruthing Survey and Pre-Topographic Survey,


other associated activities and submission of relevant document (i.e. approved
RFI’s, etc.), deliverables in accordance but not limited to Clauses 1.2, 7.4, 8, 8.3 &
8.4 of Technical Specification Portion 1(A&B) and Clause 3.0 of Technical
Specification Portion 2, shall include but not be limited to the following:

• Utilizing of all necessary labour, equipment and material, vehicles, software


(shape files, AutoCAD & DXF), calibration/upgrading of equipment’s, photos,
logging, JSA, monuments/benchmarks, lay outing, pre/post topographic survey

disposal of sewage, waste water & rubbish to an approved dumping location,
telecommunications, data and electricity supplies including payment of all bills,
fees, rent, charges and the like, office, safety, first aid and medical consumables,
security arrangement including provision of security staff, payment of all fees,
taxes, rates, subscriptions, utilization and consumption charges for services, repair
and utilities, stationary and other office consumables, oils, grease, and all other
requirements in respect of maintaining the facilities throughout the duration of the
Contract, including approvals by Company and certification for use/occupation as

State laws and regulations.

payment shall be calculated on pro-rata basis of the unit rate of respective

• The NORM of work requires a grid of 25 m x 25 m (1 unit), with a survey
density of minimum one reading per grid. Where it existed, liquid phase
material in the feature reduced the area of walkover survey; and interfered with
the regularity of the grid pattern.
• To calculate the area of walkover survey, it is asserted that once a grid is
established, the vector sum of the displacements of all individual survey points
tends to zero, with respect to an offset from a perfect grid pattern. In other
words, a single reading cannot be judged as noncompliant by virtue of its
position; readings can only be considered on the merits of the whole
distribution. Each 25 m x 25 m grid square should contain at least one
radiological survey reading, such that grid-square can be considered covered by

• Any measurements and calculations method proposed by the Contractor and
approved by Company representative and any required relevant approved
documents as per the Contract;
• Providing calculation sheets as per approved measurement plan/re-
measurement calculation sheets (RMCS) referring to the relevant approved
documents in accordance with the requirements of technical specifications;
• All interim measurements will be verified and agreed during final measurement
based in all relevant approved documents.
• Rejected samples, i.e. not meeting the requirements as per Contract shall not be
paid and cost for retest including re-excavation/drilling, sample collection, re-
packing, labelling and transportation etc., testing and analysis, validation and
QA/QC are solely Contractor’s responsibilities and all costs for complying with
all requirements contained in Clause 11.5 of Technical Specification Portion

• Supply of water, materials requisition, taxes, shipping, delivery (from source to
site, vice versa);
• Warehousing, any necessary documents required by Contract terms and

ramps where the haul road runs adjacent to sensitive plant, utilities, equipment
and infrastructure and/or Contractor proposed location and approved by
Company. This largely applies to the areas within the oilfield or utilities
crossing;
• The barriers & crossing ramps shall be established in accordance with KOC
standard/drawings;
• All associated civil works (i.e. excavation, layout, reinforcement, concreting,
formworks, painting, supply of water, etc.) to complete the works, submission
of relevant drawings proposal and specification of crash barriers to be used and
submit to Company prior to commence the works;
• Preparation of plans methodology, procedure to carry the cited activities,
relocation costs associated with the movement of equipment between working
areas;
• Protection of flowline crossing points for vehicular access in accordance with

• Perform NORM and asbestos testing at the site as per KOC.HE.024 for metallic
wastes (scrap metal etc.), redundant pipes, foundations, valves, fittings, brackets
and/or any materials that are subject for NORM testing;
• Material with NORM contamination and asbestos will be collected, handled
based on KOC procedure and regulations and temporary stored in designated
areas and later transported by the Contractor’s to final NORM handling area as
per Company directives;
• Removal from excavated materials & excavation areas, certification/inspection,
storage & disposal as inactive waste of munition & non-munition debris;
• Solid Materials shall be handled, cleaned (as necessary), temporarily stored,
loaded and transported in accordance with Company solid waste procedures
(KOC.EV.008 - Waste Management Procedure) including transportation and
off-loading at the approved Company South Kuwait scrap metal facility;
• Providing any special methods, process, platforms and/or equipment in
conducting the cited activities in wet oil lakes;
• Duty of care and chains of custody shall be used for waste disposal and
submission of Chain of custody documentation & other relevant documents;
• Any redundant pipelines (i.e. buried or above ground) more than 5m long shall
be coordinated to Company prior to execute the cited activities;
• Non-munitions debris after inspection and verification as FFE shall be disposed
as inactive waste in accordance with the provisions of the Contract;
• Prepare and submit plans methodology, procedures, proposal to monitor and/or
measured the metallic & construction debris, RFI’s and drawings to carry-out
the cited activities and all costs for complying with all relevant requirements

• Preparation of pre-& final reports (i.e. test result, analysis & lab results);
• Storage of samples in a controlled manner;
• All reproduction fees associated with duplication of certificates of analysis for

• All quality control duplicates, all field and laboratory blanks/spikes, certified
reference materials and all other necessary consumables and documentation to
verify quality;

• Provide a 5-mm polyethylene or plastic sheeting at the bottom of clean area for

2.6.1c Measurement

• Measurement shall be based in approved quantities in tonnes as executed by

supported by an approved RFI’s, weighbridge reading acquired data(s), results,
summary of trips, reports and/or any approved relevant documents;
• Treated quantities shall be weighted in tonnes on the basis of barcode systems
and weight bridge for material used for transportation and placement of treated
soil. Payment shall be calculated on weight basis of the treated material.
• Any MoM and calculations proposed by the Contractor and approved by

to additional pre-treatment, secondary or tertiary alike to attain the required

• Inclusive of costs for water requirement for the supply, storage, transportation,
and treatment if the Company does not provide water sources and usages. If
Company explores water sources and provide some water requirements to the
Contractor, the Contractor shall in return reimburse the net water associated
costs related to pre-treatment of water (if required) shall be provided in
accordance with unit price provided in Form of Tender Attachment 3.
• Inclusive of cost for mixing Soil having a range of >5% to ≤7% TPH to be
mixed with the oil impacted soil to be remediated from ≤ 5% TPH range in
accordance with clause 1.3 (i) of Technical Specification 3
• Payment shall be calculated on pro-rata basis of the unit rate based on each ratio
of respective volume and TPH level/range used in the mixing range (example
% of material from 1% to 5% shall be paid on unit rate specified for this range
and ratio or percent of TPH 5% to 7 % material shall be paid on unit rate for the
same.
• If applicable, Interim Payment for soils having a TPH range of >5% to ≤7%
mixed with the impacted soil to be remediated from ≤ 5% TPH range shall be
calculated on pro-rata basis of the unit rate based on the approved applied
mixing ratio of respective volume and TPH ranges.

Example:
o Approved Applied mixing ratio = 1:3
o Soils having a ≤ 5% TPH range = X Rates ($)
o Soils having a >5% to ≤7% TPH range = Y Rates ($)

Calculation:
• Pro-rata Rates = ((X Rates ($) multiply by 3) + Y Rates ($)) / 4 = $$$$ (This
calculated pro-rata rates to be applied in the mixing activities (if any).
• All associated prices or costs shall include the disposal of residual oil, waste

• Measurement shall be total weighted in tonnes deducting the net quantities of
water content. In other words, total weighted (final) soils deduct the added water
weight for the treatment;
• Additive weights due to bulking of contaminated soils during pre- or post-
treatment shall not be counted or weighted for the payments. These weights
shall remove from the post treatment weightages
• Any MoM and calculations proposed by the Contractor and approved by
Company representative and any required relevant approved documents as per
the Contract;
• Providing calculation sheets as per approved measurement plan/re-

• Measurement shall be based on weighted quantity in tonnes from the source
feature and categorized as per TPH level/range.

re-packing, labelling and transportation etc. , testing and analysis, validation and
QA/QC are solely Contractor’s responsibilities and all additional costs for
complying with all requirements contained in Clause 11.5 of Technical
Specification Portion 1(A&B), whether or not they are specifically mentioned
within the item descriptions

• Inclusive of cost for Contractor’s specialists in imparting training to Company
operating/maintenance personnel as follows:
➢ Training in vendor’s/Contractor’s premises in Kuwait for up to ten (10)
personnel for a period of three (3) working days; and on-site training for up
to ten (10) personnel for a duration of 90-120 working days.
➢ Contents and schedules of training program will be subject to Company
approval.
➢ Contractor shall arrange the required training resources (reference materials,
laptop computers, screen projectors etc.). Contractor/vendors shall provide
training documents to each participant. All costs for training shall be borne
by Contractor.
➢ Training certificates shall be issued to the participants.

• Utilizing of all necessary labour, Constructional Plant/equipment, material,


transportation, obtaining gate passes & permits, clearance, taxes, approved
sample container (i.e. plastic or glass jar), dry ice chest, labelling, marking, any
consumables items required for sample collection & laboratory analysis,
barricades and coordination;
• Preparing work plans, method statement and other required Contract documents
and deliverables;
• Conduct monthly monitoring consisting of sample collection and laboratory
analysis and reporting to establish degradation for successful remediation is
taking place and monitoring data show trends to meet the Contractors forecast
performance curves.
• Conduct verification samples at the end of treatment period to verify are
compliant with the treatment RTC;
• Conduct the following analysis and activities: Sample screen by gun, Field logs,
duplicate samples for QA/QC, Sample Analysis with various parameters,
Analytical Test, Sample identification, EGIS and EQuIS formattable data,
Chain of Custody, Arising, Sampling QA/QC, Trip Blanks, Field & Equipment
Rinse Blanks, Blind Duplicates and Certified Reference Sample;
• Quality control/reviews of data processing & analysis;
• Recording of all finding & reporting as specified;
• Return visit to Site where re-sampling or further sampling is required (such as
replacement of lost/destroyed samples during transport to or at the laboratory,
rejected samples, i.e. not meeting the requirements of Technical Specification
shall not be paid and cost for retest including re-excavation (if required), sample
collection, re-packing, labelling and transportation etc. are solely Contractor’s
responsibilities, whether or not they are specifically mentioned within the item
description;

• Grey or treated water conservation, recycling and re-use for 30 % of water


usages for treatment to meet the project objectives and minimize the water
usages throughout the project duration.

3B.1.1c Measurement

• Measurement shall be based in number(s) on the approved Sampling and


Analysis Data Management documents, results and reports as executed and
supported by an approved RFI’s and/or any approved relevant documents;
• Any MoM and calculations proposed by the Contractor and approved by
Company representative and any required relevant approved documents as per
the Contract;
• Providing calculation sheets and/or laboratory data with all as per approved
measurement plan/re-measurement calculation sheets (RMCS) referring to the
relevant approved documents in accordance with the requirements of technical
specifications;
• Rejected samples, i.e. not meeting the requirements as per Contract shall not be
paid and cost for retest including re-excavation/drilling, sample collection, re-
packing, labelling and transportation etc., testing and analysis, validation and
QA/QC are solely Contractor’s responsibilities and all costs for complying with
all requirements contained in Clause 11.5 of Technical Specification Portion
1(A&B), whether or not they are specifically mentioned within the item
descriptions
• All interim measurements will be verified and agreed during final measurement
based in all relevant approved documents.

consumables items required for sample collection & laboratory analysis,

• Preparing work plans, method statement and other required Contract documents
and deliverables;

The rate for undertaking bio/Remediation works for contaminated soils with >5%
& ≤ 7% TPH level and other associated activities and submission of relevant
document deliverables in accordance but not limited to Clauses 1.2 & 7.0 of
Technical Specification Portion 1(A&B) and All Clauses of Technical Specification
Portion 3, shall include but not be limited to the following:

• All costs related to Optimization Studies and Reports which include: Bench
Scale Tests and Field Trial (>5% to ≤7%) with Optimization Study Report using
either Bio and/or Other Technologies shall include, but not be limited to,
utilization of all necessary labour, equipment, lab analytical instrumentation,
analysis, and prototype treatment equipment, mixing with other TPH ranges
testing, pre and/or post treatment test, Construction Plant, material, computer,
software, vehicles, preparation of reports & procedures, the cost for any further
revision(s), assessment and reporting until successful demonstration of meeting
the RTC within the project timeframe, office materials or any other office
equipment, procurement, taxes, permits, analyzing, editing, copying,
evaluation, processing, duplications and all associated costs for complying in
accordance but not limited to all requirements in Clauses 1.2, 8.7 & 13 of
Technical Specification Portion 1(A&B), Clause 3.3 of Tech. Specification
Portion 3 & clause 3.2 of Technical Specification Portion 4.

• Utilizing of all necessary labour, equipment and material, constructional plant,


obtaining gate passes & permits, clearance, taxes, segregation (if required),
water, fuel, electrical, providing treatment areas/pads, fences/gates, access
roads, barricades, signboard, any consumables items required in treatment
works and coordination to others;
• Segregation of waste materials that cannot be treated from the treatment stream
and addressed as per Clause 7.4 of Portion 1(A&B) of the Technical

boulders materials, if any, shall be considered as part of the maximum allowable
waste product;
• Preparing work plans, method statement and other required Contract documents
and deliverables;
• Maintenance includes storm water managements and other associated works;
• Mixing and civil works required for handling (including double handling) of
excavated materials in forming temporary stockpiles or spoil heaps to be re-
used for transporting;
• Provide Loading Notes, tracking system (GPS), summary of trips & weight and
Log book to monitor the transported quantity that passed through the
weighbridge;
• Collect representative samples to measure and determine initial water content
(%) prior to treatment and final water content (%) after treatment in the field
and/or laboratory;
• Provide pre-treatment or post remediation or treatment technique or material for
all input and output parameter; if required or/as directed by the company;
• Provide and handle all mixing with additives for full scale as per pilot study
optimization;
• Cleaning of work areas as work progress and/or completion of works location
or adjacent location to condition existing before start of work;
• Cleaning and watering adjacent roadways areas of dust, dirt, and debris caused
by the transportation or spillages;
• Operation, maintenance, repair, replacement and depreciation of any and all
equipment and treatment system required to facilitate the remediation or
treatment process;
• Pre-& Post water treatment for usage and disposal if necessary and directed by
Company;
• Segregation of contaminated soils, breaking of oversized contaminated soils and
weighing;
• Water extraction from wells or water supply usage from other sources and
treatment if desired, recycling and re-use to use and, sampling, mixing, handling
and monitoring;
• Remediation and Treatment Technologies-Main Works monitoring, sample
collection, and analysis for verification that may be required, and all costs
associated with reporting remediation or treatment progress according to the
requirements outlined in the Contract;
• Providing power supply and accessories, supply water and water storage with
irrigation on planned schedule, water measurements, telephone, sanitary,
chemical disposal, safety, medical, first aid, ambulance, storages, and etc.;
• Produce initial Remediation or treatment monitoring, operation, quality
control/reviews of data processing & analysis and other required
sample/laboratory, recording & reporting; and contingent on verification

sample results;
• All costs associated with any and all pre- or post-treatment required.
• Inclusive of any enhancements or refinements to the remediation methods
required should a treatment method not fulfil the Remediation Treatment
Criteria detailed within the Technical Specification (including but not limited
to additional pre-treatment, secondary or tertiary alike to attain the required
targets).
• Inclusive of costs for water requirement for the supply, storage, transportation,
and treatment if the Company does not provide water sources and usages. If
Company explores water sources and provide some water requirements to the
Contractor, the Contractor shall in return reimburse the net water associated
costs related to pre-treatment of water (if required) shall be provided in
accordance with unit price provided in Form of Tender Attachment 3.
• Inclusive of cost for mixing Soil having a range of >5% to ≤7% TPH to be
mixed with the oil impacted soil to be remediated from ≤ 5% TPH range in
accordance with clause 1.3 (i) of Technical Specification 3
• Payment shall be calculated on pro-rata basis of the unit rate based on each ratio
of respective volume and TPH level/range used in the mixing range (example
% of material from 1% to 5% shall be paid on unit rate specified for this range
and ratio or percent of TPH 5% to 7 % material shall be paid on unit rate for the
same.
• If applicable, Interim Payment for soils having a TPH range of >5% to ≤7%
mixed with the impacted soil to be remediated from ≤ 5% TPH range shall be
calculated on pro-rata basis of the unit rate based on the approved applied
mixing ratio of respective volume and TPH ranges.

Example:
o Approved Applied mixing ratio = 1:3
o Soils having a ≤ 5% TPH range = X Rates ($)
o Soils having a >5% to ≤7% TPH range = Y Rates ($)

Calculation:
• Pro-rata Rates = ((X Rates ($) multiply by 3) + Y Rates ($)) / 4 = $$$$ (This
calculated pro-rata rates to be applied in the mixing activities (if any).
• All associated prices or costs shall include the disposal of residual oil, waste
water, salt, by-product waste etc. generated by the remediation or treatment
process, whether or not they are specifically mentioned within the item
description.

3B.2.c Measurement
• Measurement shall be based in approved quantities in tonnes as executed by
remediation works for contaminated soils with TPH of 1 % and ≤ 5% level for
remediation and/ or >5 % and ≤7% for remediation or treatment technologies
and > 7 % for treatment technologies and supported by an approved RFI’s,

weighbridge reading acquired data(s), results, reports and/or any approved


relevant documents;
• Measurement shall be total weighted in tonnes deducting the net quantities of
water content. In other words, total weighted (final) soils deduct the added water
weight for the treatment;
• Additive weights due to bulking of contaminated soils during pre- or post-
treatment shall not be counted or weighted for the payments. These weights
shall remove from the post treatment weightages
• Any MoM and calculations proposed by the Contractor and approved by
Company representative and any required relevant approved documents as per
the Contract;
• Providing calculation sheets as per approved measurement plan/re-
measurement calculation sheets (RMCS) referring to the relevant approved
documents in accordance with the requirements of technical specifications;
• Measurement shall be based on weighted quantity in tonnes from the source
feature and categorized as per TPH level/range.
• Rejected treatment material, not meeting the requirements as per Contract shall
not be paid until retested including loading and unloading, sample collection,
re-packing, labelling and transportation etc. , testing and analysis, validation and
QA/QC are solely Contractor’s responsibilities and all additional costs for
complying with all requirements contained in Clause 11.5 of Technical
Specification Portion 1(A&B), whether or not they are specifically mentioned
within the item descriptions.
• All interim measurements will be verified and agreed during final measurement
based in all relevant approved documents
• Inclusive of cost for Contractor’s specialists in imparting training to Company
operating/maintenance personnel as follows:
➢ Training in vendor’s/Contractor’s premises in Kuwait for up to ten (10)
personnel for a period of three (3) working days; and on-site training for up
to ten (10) personnel for a duration of 90-120 working days.
➢ Contents and schedules of training program will be subject to Company
approval.
➢ Contractor shall arrange the required training resources (reference materials,
laptop computers, screen projectors etc.). Contractor/vendors shall provide
training documents to each participant. All costs for training shall be borne
by Contractor.
➢ Training certificates shall be issued to the participants.

Specification Portion 1(A&B) shall include but not be limited to the following:

• Utilizing of all necessary labour, constructional plant, equipment, material and


any consumables items required for collecting and delivery of samples,
software, hand tools, packaging, labelling, marking, copying, binding, testing,
calibration, obtaining gate passes & permits, clearance, taxes, providing
scaffolds and barricades;
• Conducting manual and/or hand pitting and mechanical soil sampling
collections at various completion depth inclusive UXO anomaly avoidance;
• Return visit to Site where re-sampling or further sampling is required (such as
replacement of lost/destroyed samples during transport to or at the laboratory);
• Rejected samples (i.e. not meeting the requirements in the Technical
Specification) shall not be paid and cost for retest including re-excavation, soil
and/or groundwater sample collection, re-packing, labelling and transportation
are solely Contractor’s responsibilities;
• Providing sufficient protection throughout the Contract period until issuance of
the Certificate of Completion whereupon the permanent monitoring boreholes
will be handed over to the Company;
• Rejecting of data sample result based on validation and/or QA/QC shall be re-
collected and analysed at no cost to the Company;
• Field logs submission according to KOC standards;
• Submission, screening records documented in detail for soil, location, TPH
values, all reports shall be submitted to substantiate and/or support the main
sampling reports;
• Preparation of pre-& final reports, results, documentations and other related
reports), whether or not they are specifically mentioned within the item
description;

4.1c Measurement

• Measurement shall be based in number(s) on the approved Sample analysis &


Data Management associated with approved relevant documents and supported

4.2 REMEDIATION WORKS FOR CONTAMINATED SOILS

4.2a Unit of Measurement

4.2b Pricing

The rates for undertaking remediation works for contaminated soils with >7% TPH
level, other associated activities & works required to be carried out and submission
of relevant document deliverables in accordance but not limited to Clauses 1.2 & 7
of Technical Specification Portion 1(A&B), and all Clauses stated in Technical
Specification Portion 4, shall include but not be limited to the following:

• Field Treatment Technologies Studies (>7% TPH) with Optimization Study


Report, shall include, but not be limited to, utilization of all necessary labour,
equipment, lab analytical instrumentation , analysis, and prototype treatment
equipment, , mixing with other TPH ranges testing, pre and/or post treatment,
if required to achieve the RTC,material, computer, software, vehicles,
preparation of reports & procedures, the cost for any further revision(s),
assessment and reporting until successful demonstration of meeting the RTC
within the project timeframe, office materials or any other office equipment,
procurement, taxes, permits, analyzing, editing, copying, evaluation,
processing, duplications and all associated costs for complying in accordance
but not limited to all requirements in Clauses 1.2, 8.7 & 13 of Technical
Specification Portion 1(A&B), Clause 3.3 of Tech. Specification Portion 3 &
Clause 3.2 of Technical Specification Portion 4.

If the Contractor conducts the trial outside of Kuwait, it shall pay for the travel
expenses and accommodations for up to four Company personnel to observe the
trial test over one (1) week period in line with Company policies. These costs
shall be included in the price for treatment optimization study.

• Provide and utilize of all necessary labour, equipment and material,


constructional plant, obtaining gate passes & permits, clearance, taxes,
segregation (if required), water, providing treatment areas/pads, fences, access
roads, barricades, signboard, any consumables items required in treatment

dispose offsite as directed by Company). Segregated tar ball materials, if any,
shall be considered as part of the maximum allowable waste product;
• Prepare work plans, method statement and other required Contract documents
and deliverables;
• Mixing and civil works required for handling (including double handling) of

and system operation, maintenance, testing and monitoring, transportation and
methods of irrigation, etc.;
• Cleaning of work areas as work progress and/or completion of works return
adjacent areas to condition existing before start of work;
• Cleaning and watering adjacent roadways areas of dust, dirt, and debris caused
by the transportation or spillages as directed by the Company's Superintendent;
• Operation, maintenance, repair, replacement and depreciation of any and all
equipment and treatment system and material required to facilitate the treatment
process;
• Segregation of contaminated soils, breaking of oversized contaminated soils and
weighing,
• Explore and select water supply, manage water storage and treatment, disposal
of reject water, sampling, mixing, handling and monitoring;
• Pre-& Post water supply and/or treatment for usage and recycling and disposal
(if necessary and directed) by Company;
• All Main Works monitoring, sample collection, and analysis that may be
required and all costs associated with reporting treatment progress according to
the requirements outlined in the Contract;
• Providing power supply and accessories, water, telephone, sanitary disposal,
safety, medical, first aid, ambulance, storages, etc.;
• Produce initial Remediation or treatment monitoring, operation, quality
control/reviews of data processing & analysis and other required
sample/laboratory, recording & reporting; and contingent on verification
sample results ;
• Provide the necessary personnel to design, install, commission, operate,
monitor, and maintain the system at the design treatment rate and without

significant downtime in order to meet the project work;


• Treatment plant system shall be installed, commissioned, operated, and
monitored and decommissioned in accordance with applicable International
Standards and/or Company standards/procedures, the requirements of the
Contract Documents, and the Contractor prepared PEP and other application
documents;
• All costs associated with any and all pre- or post-treatment required.
• All costs associated with treatment any recovered oil and disposal of this
material as per Company’s and KEPA protocols.
• Inclusive of any enhancements or refinements to the remediation methods
required should a treatment method not fulfil the Remediation Treatment
Criteria detailed within the Technical Specification (including but not limited
to additional pre-treatment, secondary or tertiary alike to attain the required
targets).
• Inclusive of costs associated with Contractors proven attempts to obtain
renewable energy sources and water conservation in accordance with Technical
Specification Portion 1(A&B). For treatment plant having a soil greater than 7%
TPH HEM - 10% renewable energy using waste oil product or alternative fuel
for operating equipment or alternative proposed source may utilized.
• All associated costs shall include to execute the disposal of residual oil, waste
water, salt, by-product waste etc. generated by the treatment process, whether
or not they are specifically mentioned within the item description.
• Inclusive of costs for water requirement for the supply, storage, transportation,
and treatment if the Company does not provide water sources and usages. If
Company explores water sources and provide some water requirements to the
Contractor, the Contractor shall in return reimburse the net water associated
costs related to pre-treatment of water (if required) shall be provided in
accordance with unit price provided in Form of Tender Attachment 3.
• All associated costs in providing training for the operation of treatment
equipment plant with full operating system and maintenance. Contractor shall
provide training for each proposed type of equipment in accordance but not
limited to Clause 5 of Technical Specification Portion 4.
• Inclusive of cost for Contractor’s specialists in imparting training to Company
operating/maintenance personnel as follows:
➢ Training in vendor’s/Contractor’s premises in Kuwait for up to ten (10)
personnel for a period of three (3) working days; and on-site training for up
to ten (10) personnel for a duration of 90-120 working days.
➢ Contents and schedules of training program will be subject to Company
approval.
➢ Contractor shall arrange the required training resources (reference materials,
laptop computers, screen projectors etc.). Contractor/vendors shall provide
training documents to each participant. All costs for training shall be borne
by Contractor.
➢ Training certificates shall be issued to the participants.

4.2c Measurement

• Measurement shall be based in approved quantities in tonnes as executed by


treatment technologies works for contaminated soils with TPH levels 5 % to ≤
7% and TPH levels > 7% and supported by an approved RFI’s, weighbridge
reading acquired data(s), results, reports and/or any approved relevant
documents;
• Measurement shall be total weighted in tonnes deducting the net quantities of
water content. In other words, total weighted (final) soils deduct the added water
weight for the treatment (e.g. final water content minus initial water content
established prior to commencement and end of the treatment technology);
• Any MoM and calculations proposed by the Contractor and approved by
Company representative and any required relevant approved documents as per
the Contract;
• Additive weights due to bulking of contaminated soils during pre- or post-
treatment shall not be counted or weighted for the payments. These weights
shall remove from the post treatment weightages
• Providing calculation sheets as per approved measurement plan/re-
measurement calculation sheets (RMCS) referring to the relevant approved
documents in accordance with the requirements of technical specifications;
• Rejected treatment technology material, not meeting the requirements as per
Contract shall not be paid until retested including loading and unloading, sample
collection, re-packing, labelling and transportation etc. , testing and analysis,
validation and QA/QC are solely Contractor’s responsibilities and all additional
costs for complying with all requirements contained in of Technical
Specification Portion 3, whether or not they are specifically mentioned within
the item descriptions
• All interim measurements will be verified and agreed during final measurement
based in all relevant approved documents.

PORTION 5 – SITE WORKS: EXISTING LANDFILL EXPANSION

5.0 EXISTING LANDFILL EXPANSION

The rates for undertaking Construction of Extension Landfill in accordance with TS


Portion 5. including supply, construction and other associated activities to complete
the works and submission of relevant document deliverables in accordance but not
limited to Clauses 1.2, 1.3, 4.2 & 9.0 of Technical Specification Portion 1(A&B) and
all Clauses stated in Technical Specification Portion 5, shall include but not be
limited to the following:

• Provide all necessary labour and material, Constructional Plant, supply of all
required materials, equipment, power, water and water managements, safety
measures, environmental monitoring networks, site survey, temporary facilities,
tie-in to existing landfill, as-built drawings, protection during transportation,
access road maintenance, signboards, obtaining gate passes & permits,
clearance, taxes, lay-outing, excavation, compaction, trimming, marking, any
consumables items required for landfill expansion and coordination to others;
• Construct an efficient expansion of the existing landfill facility if required and
directed by Company confirmed by trial test and/or pilot study test in
accordance with Kuwait and applicable International Standards to meet
minimum requirements for containment and disposal of untreatable material
and non-treatable or segregated material as directed by the Company;
• Preparing work plans, method statement and other required Contract documents
and deliverables;
• Review existing UXO clearance and survey records and undertake additional
UXO survey and clearance of Battle area clearance for the existing landfill
extension area, if directed by Company and if necessary and as described in
Clause 10 of Portion 1(A&B) of the Technical Specification;
• Operation, maintenance, and monitoring (OM&M) of the expanded landfill
until defect liability;
• Supply Materials and Testing Equipment for the environmental (OM&M)
during the contract duration;
• Quality control (QC)/reviews of data processing & analysis;
• As built layer of design, equipment and instrument to be installed, layer of

relevant approved documents as per the Contract;
• Providing calculation sheets as per approved measurement plan/re-
measurement calculation sheets (RMCS) referring to the relevant approved
documents in accordance with the requirements of technical specifications;

Clauses 1.2, 4.2, 7.4, 9 & 13.6.6 of Technical Specification Portion 1(A&B), Clauses
3.3, 3.4, 3.6, 3.7, 3.8 & 7.3 of Technical Specification Portion 2 and Clauses 1.2 &
All clauses of Technical Specification Portion 5, shall include but not be limited to
the following:

• Provide all necessary labour and material, Constructional Plant, supply of all
required materials, equipment, power, water and water managements, safety
measures, environmental monitoring networks, site survey, temporary facilities,
tie-in to existing landfill, as-built drawings, protection during transportation,

of the expansion landfill facility.


• Compaction, moisture conditioning (during pre- & post excavation and
disposal), spreading and testing (if applicable) of untreatable contaminated
materials to the expanded landfill.
• Re-compaction for each lift which does not meet the compaction requirement
at no additional cost.
• Conduct pre-post topographic survey during disposal activities to monitor the
filling quantity and submit to Company for review and approval on a planned
schedule or as directed by the Company;
• Quality control (QC)/reviews of data processing & analysis;
• As built layer of design, equipment and instrument to be installed, layer of
capping to be listed and all associated works to complete;
• Recording of all finding & reporting as specified, whether or not they are
specifically mentioned within the item description;

5.3c Measurement

• Measurement shall be based in approved quantities disposed in the landfill in


tonnes, compacted within the range of 85-90% of the maximum density of the
modified proctor test and supported by an approved RFI’s and/or any approved
relevant documents;
• Any MoM and calculations (i.e. pre-during and post topographic survey,
contouring, 3D formats, by trips, by weighbridge reading and or others method
in calculating the quantities) as proposed by the Contractor to justify the
quantities in the landfill and approved by Company representative and any
required relevant approved documents as per the Contract;
• The lowest quantities shall be prevailing after comparing the quantities
calculated as per any proposed and agreed methodology;
• Providing calculation sheets as per approved measurement plan/re-
measurement calculation sheets (RMCS) referring to the relevant approved
documents in accordance with the requirements of technical specifications;
• All interim measurements will be verified and agreed during final measurement
based in all relevant approved documents.

5.4 SUPPLY AND INSTALL CAPPING AND COMMISSIONING FOR LANDFILL

5.4b Pricing

The rates for undertaking Supply and Install Capping and commissioning for
landfill extension in accordance with Technical Specification Portion 5, other
associated activities to complete the works and submission of relevant document
deliverables in accordance but not limited to Clauses 1.2, & 9.5 of Technical
Specification Portion 1(A&B) and all Clauses of Technical Specification Portion 5,
shall include but not be limited to the following:
• Construction, handling, procurement, importation, clearing, grubbing &
levelling of soils and all works related to this item, approval of locations and
subsequent re-exportation of materials, waste handling and disposals and
vehicles of whatever type or size required for the performance of the Work,
provision of necessary certification, custom Clearance, duties, taxes, levies,
obtaining necessary permits & licenses required to operate at Work site for the
execution of the Work, submission of any other relevant documents and
deliverables for Company approval whether or not they are specifically
mentioned within the item description.
• Provide all necessary labour and material, Constructional Plant, supply of all
required materials, equipment, power, water and water managements, safety
measures, environmental monitoring networks, site survey, temporary facilities,
tie-in to existing landfill, as-built drawings, protection during transportation,

• Provide training service to Company’s personnel on environmental
management as to be developed for the expansion, and operation and
maintenance of equipment and material as described in this Technical
Specification Portion 5;
• Inclusive of costs associated with Contractors proven attempts to obtain, in
accordance with Technical Specification Portion 1(A&B), energy through
renewable energy sources and water conservation an operational energy
consumption for leachate pumps and lighting, 15% supplied by renewable
energy.

6.0 KUWAITIZATION

The Lump sum price for undertaking Kuwaitization shall include all necessary costs
to comply with requirement as specified in Clauses 6, 12.3.13, Annexure I & II of
Contract Specification but not limited to salaries of Kuwaiti Nationals and
overheads of any nature (such as Taxes, Insurances, benefits & like).
These costs will be paid on an incurred prorated basis (monthly).
