REPUBLIC ACT NO.

9262 OTHERWISE KNOWN AS “THE ANTI-VIOLENCE

AGAINST WOMEN AND THEIR CHILDREN (VAWC) ACT OF 2004”
QUESTIONS

A. ESSAY TYPE

1. Briefly explain “Battered Woman Syndrome” as defined in R. A. 9262.

ANSWER: It is a scientifically defined pattern of psychological and behavioral

symptoms found in women living in battering relationships as a result of
cumulative abuse.

2. Ana had a romantic relationship with John, which resulted in the birth of Princess,
an illegitimate child. John freely acknowledged the paternity of Princess.
However, Ana’s relationship with John turned sour as the latter had an affair with
a younger woman. When Princess was just about one year old, John stopped
giving support, prompting Ana to file a case for support, which was eventually
granted. This notwithstanding, John still refused to give support for her and
Princess. As such, Ana was constrained to file a criminal case against John. Is
John liable for violation of RA 9262? Explain.

ANSWER: Yes. John is liable for violation of RA 9262 for his refusal to provide
support to his child. Economic abuse may include the deprivation of support of a
common child of the man-accused and the woman-victim, whether such common
child is legitimate or not.
