    DEED OF DONATION OF PORTION

    OF REAL PROPERTY

    KNOW ALL MEN BY THESEE PRESENTS:

    THE MUNICIPAL GOVERNMENT OF SIBAGAT, AGUSAN DEL


    SUR duly represented by its Municipal Mayor HONORABLE MARIA LIZA
    L. EVANGELISTA, CPA, of legal age, married, Filipino citizen and a resident
    of Sibagat, Agusan del Sur, hereinafter called the DONOR;

    - in favor of –

    BARANGAY LOCAL GOVERNMENT UNIT (BLGU) OF BRGY.


    AFGA, AGUSAN DEL SUR herein represented by the Punong Barangay,
    Honorable ARNEIL B. ABUZO, of legal age, Filipino citizen, married and
    with residence at Purok-2, Brgy. Afga, Agusan del Sur, hereinafter called the
    DONEE;

    That the DONOR is the registered owner of a parcel of land covered by


    Transfer Certificate of Title No. T-16538 containing an area of THIRTY SIX
    THOUSAND SEVEN HUNDRED AND NINETEEN (36,719) SQUARE
    METERS, more or less and particularly described as follows:

    Lot 50, Gss-840

    Beginning at point marked “1” of Lot 50, Gss-840, being S., 08-37’E.,
    2796.83 m. from BLLM No. 1, Gss-840; thence;

    S., 33 deg. 20’W., 302.93 m. to point 2; S., 30 deg. 42’W., 128,06 m. to point 3;
    N., 59 deg. 22’W., 31.44 m. to point 4; N., 64 deg. 00’W., 97.16 m. to point 5;
    N., 39 deg. 09’E., 229.59 m. to point 6; N., 54 deg. 57’E., 236.74 m. to
    S., 38 deg. 24’E., 12.01 m. to point 1; point of beginning

    Containing an area of THIRTY SIX THOUSAND SEVEN HUNDRED AND


    NINETEEN (36,719) SQUARE METERS. All points are marked on the ground by
    B.L. Cyl. Cons. Mons. Bounded on the E., along line 1-2 by Lot 49, Gss-840; on the
    SE., along line 2-3 by Lot 48, Gss-840; on the SW., along lines 3-4-5 by National
    Road; on the NW., & W., along lines 5-6-7 by Lot 51, Gss-840; and on the NE.,
    along line 7-1 by Lot 29, Gss-840. Bearings true. This lot was surveyed in
    accordance with the law and existing regulations promulgated thereunder by P.
    Julianda, Public Land Surveyor on September 25, 1962.

    NOTE: This lot is covered by F.P.A. No.1 (VII-2) 8847.

    That DONOR have agreed and voluntarily waive a portion of Two


    Thousand Six Hundred (2,600) square meters only from the abovementioned
    property by virtue of the Municipal Resolution No.52-20, for the DONNE to
    utilize it as Barangay Resettlement Site and other public purpose for the benefit
    and welfare of the residents of Barangay Afga, thus for and in consideration of
    the DONOR’S concerned for their constituents, they willingly and voluntarily

    agreed to cedes, and transfers, by way of donation, in favor of the DONEE the
    2,600-square meters area above-cited, free and clear of any encumbrances.

    - Acceptance –

    DONEE thru the incumbent Honorable Punong Brgy hereby accepts with
    gratitude and thanks the donated area from the DONOR.

    IN WITNESS WHEREOF, the parties have hereunto affixed their hands,


    this 12th day of April 2011 at Butuan City, Philippines.
