    JUDICIAL AFFIDAVIT OF JERIZA DELA CRUZ-GABIOSA

    I, JERIZA DELA CRUZ-GABIOSA, of legal age, Filipino


    citizen, married, and is a resident of No. 123 Guinto Street, Barangay
    San Antonio, Makati City after having been sworn to in accordance
    with the law do hereby depose and state:

    That Atty. Beth Dela Rosa is the counsel who conducted and
    supervised my examination as a witness at her office at Kalawag I,
    Isulan, Sultan Kudarat Philippines;

    That I am answering the questions herein fully conscious that I


    do so under oath and that I may be criminally liable for false
    testimony or perjury;
    PURPOSE: This affidavit / testimony of plaintiff, JERIZA DELA CRUZ-
    GABIOSA is being offered to prove that as the compulsory heir and
    the rightful successor-owners of a piece of land located at Barangay
    Kalawag 1, Isulan, Sultan Kudarat.

    Q1: Do you swear to tell the truth and nothing but the truth?
    A1: Yes Ma’am.

    Q2: Please state your name and other personal circumstances for
    the record.
    A2: I am Jeriza Dela Cruz-Gabiosa, 41 years of age, married and
    resides in Tacloban City. I am the sister of Raymund Dela Cruz.
    I and my 3 sisters entrusted the 80,000sq meters of the
    property left by our deceased parents which is situated at
    Barangay Kalawag 1, Isulan, Sultan Kudarat.

    Q3: Do you have any idea of the property left by your deceased
    parents?
    A3: Yes, ma’am, I have an idea. In fact, when I was a child our
    parents show to us the original certificate of title of the said property.
    Our family home is also situated on the said property where I had
    experience many memorable childhood memories together with my
    parents and siblings. Every summer, I am helping my parents in
    planting trees and root crops. I am also helping them sell some of
    the root crops every Saturday and Sunday.

    Q4: Why did you entrust your deceased parents’ property to your
    eldest brother, Raymond?
    A4: I entrusted our deceased parents’ property to my eldest brother
    because he is the only one among our siblings who has no
    permanent job. I gave him the favor to take charge in
    managing the said property so that he can have a source of
    livelihood to feed his wife and his 6 minor children.

    Q5: Do you have any idea that Raymond sell the property of your
    deceased parents?
    A5:No ma’am, I have no idea at all. I have no constant
    communication with my eldest brother. Every time I call him,
    he said he was always busy working in the farm. He did not
    made mention about the selling of the said property. I am
    confident that he will not sell the said property because I
    trusted him being my brother. Further, I and all of my three
    sisters had no intention to donate nor waive our claim as
    successor co-owners of the property in favor of my eldest
    brother but simply to manage the said property to earn his
    keeps for his family.
