EMERGENCY EXPARTE TEMPORARY INJUNCTION TO STAY WRIT OF


POSSESSION AND EVICTION

COMES NOW, Appellant, Donna M. Looney who files this Emergency Exparte

Temporary Injunction to Stay Writ of Possession and Eviction states as follows:

1. This is an action for possession following a mortgage foreclosure sale.

2. Appellant is the mortgagor on a recorded mortgage for the subject property, wherein

Appellee was the mortgagee or its assignee and, upon information and belief, was the successful

bidder at the Sheriff Sale conducted on November 16, 2015.

3. On or about February 08, 2016 a Judgment of possession was entered against

Appellant.

4. On or about April 04, 2016 Appellant filed a Motion to Set Aside Foreclosure and the

hearing was held on April 18, 2016 at 10:00 a.m.

5. On April 18, 2016 Appellee’s Motion to Set Aside Foreclosure and Forcible Entry

Detainer was denied.


6. On April 21, 2016 a judgment of Writ of Possession was granted to Appellee, causing

Appellant to appeal this decision.

7. The scheduled eviction is set for May 2, 2016 at 7:30 a.m.

Wherefore, Appellant requests that this Honorable court enter an Order Staying the Writ

of Possession and Eviction until such time as the Court conducts the hearing on

Appellee’s appeal.

The Court having reviewed Appellant Donna Looney’s Emergency Exparte Temporary

Injunction to Stay Writ of Possession and Eviction Pending Appeal, explicitly noting that time

being of the essence based upon potential for eviction prior to ability to conduct formal hearing

and the Court being otherwise fully advised of the premises;

IT IS ORDERED that these proceedings any Writ of Possession and Eviction previously

entered are hereby stayed until further order of this Court;

IT IS FURTHER ORDERED that all parties shall appear on
