 General Instructions to Students

1 mark will be deducted by default for failure to follow format and


instruction.
 Zero marks will be given for failure to complete and submit the assignment.
 Late submission will not be entertained.
 Plagiarism is a serious offence. The examiner has the right not to accept

 Plagiarism include the following (but not limited to):
o copy another student’s work,
o hire or ask another individual to complete the assignment for you,
o copy too many words or ideas from one or two sources, that make up a

Group work
 Each group member must actively participate in the completion of the assignment.
Free-riding is unethical and extremely unfair to fellow group members.
 Each group member is expected to keep the contact numbers and e-mail
addresses of the other members of the group.
 The group leader has the responsibility to ensure that all group members play a
part in the completion of the assignment. The group leader is also responsible to
ensure that all members’ names are written on the final submission.
 It is the responsibility of each group member to ensure that the final submission
is complete and of the acceptable standard. Should any errors or omissions
occurred in the final submission, each group member shall be held accountable.

QUESTION 3

Plaintif, anak lelaki kepada Pewasiat, merupakan orang yang mengemukakan Wasiat
terakhir See Yuu Soon (L) bertarikh 22 November 2011 (“Wasiat Pertama tersebut”) yang
mana telah ditandatangani oleh Pewasiat.

Defendan, adik lelaki Plaintif, yang mana mengemukakan kononnya Wasiat terakhir See
Yuu Soon bertarikh 30 Ogos 2018 (“Wasiat Kedua tersebut”).

Pewasiat yang berumur 95 tahun telah meninggal dunia pada 14 Mac 2020, meninggal
enam (6) orang anak lelaki termasuk kedua-dua Plaintif dan Defendan, beserta empat (4)
orang anak perempuan. Setelah kematian Pewasiat, satu perjumpaan telah diadakan di
pejabat peguam Tetuan Good & Co. untuk membincangkan berkenaan pengurusan harta si
Pewasiat. Sewaktu perjumpaan itu, Tetuan Good & Co. telah memaklumkan kepada semua
benefisiari berkenaan Wasiat Kedua tersebut. Wasiat Kedua tersebut disempurnakan pada
30 Ogos 2018 di pejabat Tetuan Good & Co. dan ia didapati sempurnakan dengan cap jari
si Pewasiat.

Pihak plaintif tidak berpuas hati dengan hasil perjumpaan tersebut dan memilih untuk
mendapatkan nasihat perundangan sendiri berkenaan kedua-dua wasiat tersebut. Kedua-
dua Plaintid dan Defendan memasukkan kaveat ke atas estet Pewasiat. Walaupun Defendan
telah memohon probet bagi estet Pewasiat berdasarkan Wasiat Kedua tersebut,
permohonan tersebut telah ditarikbalik serta merta. Plaintif memohon deklarasi yang mana
Wasiat Pertama tersebut adalah betul dan adalah wasiat Pewasiat yang sah. Plaintif juga
memohon deklarasi yang Wasiat Kedua tersebut adalah tidak sah, terbatal dan tidak boleh
dikuatkuasakan. Manakala Defendan memohon vice versa terhadap Plaintif.

Arahan:
1. Pihak-pihak dikehendaki menyediakan pliding yang bersesuaian berdasarkan fakta
kes diatas.
2. Pihak-pihak juga boleh mereka butiran penting lain kecuali yang telah dinyatakan.
