VI. CHRONOLOGICAL EVENTS

1. On June 16, 2021 at 12:15 midnight an Alleged Rape Incident transpired at


Kagandahan Dormitory, Legarda St., Barangay 410, Sampaloc, Manila City. The victim
was identified as Wynona Mendoza, female, single,19 years old, nursing student of
Arellano University Legarda Campus, and a resident of the above address was found by
her roommate, Marie E. Tess, half naked unconsciously lying on her bed wearing white
t-shirt without panty inside their room. She then sought assistance from patrolling
officers of this Station where they rushed the victim at Mary Chiles General Hospital,
Dalupan St., Sampaloc, Manila for immediate medical attention while pieces of
evidence gathered were collected and turned over to Evidence Custodian. At around
1:00 a.m., same date, Marie E. Tess was invited in this office to provide statement
regarding the incident.

2. At 1:30 a.m., PSMS Maria P Alad, duty investigator proceeded at Mary Chiles
General Hospital, to check the condition of the victim and to provide her statement.
Upon arrival thereat, victim was already conscious thus was able to provided her
statement.

3. Based on the victim’s account, at around 10:30 p.m of June 15, 2021, she
invited four (4) persons (3) male and (1) female in their dormitory. These persons she
identified as: (1) Yuda Wan, female, 19 years old, college student and presently a
resident of 5th St., Concepcion Aguila, Mendiola, Manila, (2) Vincent Zo, 20 years old,
college student and presently a resident of General Tinio, Caloocan City, (3) John Paul
Baluyut, 21 years old, college student and presently a resident of 233 Gastambide St.
Sampaloc, Manila, and (4) one John Paul Arayat, whose circumstances are unknown to
her.

4. She narrated that when these four persons arrived at their dormitory on or
about 11:00 p.m., her roommate, Marie E. Tess was still there. She invited her to join
them in their drinking spree but the latter refused as she claimed to be meeting another
friend nearby. After Marie E. Tess left, she and four (4) others started to drink Alfonso
Brandy. At around 11:30 p.m., Yuda Wan and Vincent Zo left so that only she and two
others she identified as John Paul Baluyut and a certain John Paul Arayat stayed inside
their room and continued drinking. Further inquiry disclosed that she felt drunk and
before losing her consciousness, she remembered John Paul Baluyut forcing his penis
into her mouth. She tried to resist and shout for help but the two strongly hold her hands
and shut her up by putting their hands into her mouth. After a while, she became
exhausted and hence allowing them to consummate their sexual desires. When she
woke up, she was already in a hospital feeling pain in her virginal part.
5. Victim was subjected for Genital Examination at PNP Crime Laboratory
Office, Camp Crame, Quezon City.

6. Follow-up operation was conducted by the elements of this Station. Suspect


John Paul Baluyut, who according to the victim is a student of Far Eastern University
Recto, Manila wherein she provided personnel of this Station photographs of the said
suspect from her cellphone served as basis to positively identify him and effect his
arrest in a fast-food beside Far Eastern University Campus.

7. Armed with a photograph of suspect Baluyut, the arresting team found a


person similar to the photograph earlier provided by the victim eating at Jolibee in front
of main entrance of Far Eastern Univesity Campus, Morayta Manila. They then
approached him and asked if he is John Paul Baluyut where the latter affirmed. They
then informed him of the offense he was allegedly involved and effected his arrest. The
apprehending officers also inquired if he is aware of the whereabouts of his cohort John
Paul Arayat where he answered that said person resides at Barangay 141, Sampaloc
Manila. Operatives of the station thereafter proceeded at the said address and with the
assistance of Barangay Officials was able to locate his residence. Suspect John Arayat
was found in his house cleaning his motorcycle. Upon positive identification of John
Paul Baluyut and the Barangay Officials, he was informed of the allegation charged
against him. He thereby peacefully submitted himself to the arresting team.

Upon arrest, both suspects were informed of the offense they allegedly

committed in a Filipino language they clearly understood, known, and spoken.
Subsequently they were brought to this station for disposition.

VII. RESULT OF OPERATION

Follow-up operation was effectively conducted by the elements of


this Station against the above named suspects without any untoward
incident.

VIII. ACTION TAKEN

A criminal complaint for Rape under Article 266-A of the Revised


Penal Code, as amended by RA 8353, was referred against John Paul
Baluyut and John Paul Arayat before the Office of the City Prosecutor,
Manila for Inquest Proceedings.

IX. RECOMMENDATION
In view of the foregoing, the following are recommended:
A. To avoid similar incident to happen, victimology can be prevented by
limiting the selling of liquor.
B. Women and minor shall be encouraged to choose their peers and
refrain from drinking with someone who is not familiar with them.
