Philippine constitution of 1987 - Article 3 “Bill of rights”

Declaration and enumeration of a person’s rights and privileges in which the constitution is designed to
protect against the violation by the government, or by individuals and group of individuals.

22 sections

1. Right to life deprivation of life, property and liberty without due process of law
1.1. Right to liberty walang nangingialam sa gusto mong gawin as long as nasa tama

2. Right of the people to be secure


2.1.Right of unlawful search and seizure
- bawal mag aresto o mag inspect nang walang warrant unless caught in the act (In flagrante
Delicto).
- Pwede arestuhin pag may bagay na illegal na nakalantad sa publiko
- Checkpoints, pang visual lang.

3. Privacy of communication and correspondence


- Bawal ang access sa private communication, bawal gawing evidence.
- Fruit of poisonous tree” pagkuha ng evidence sa maling paraan
- Pwede lang pag may utos galling sa itaas

4. Freedom of Speech
- Bawal parusahan ang mga nagpapahayag ng saloobin tungkol sa mga isyu sa lipunan pero
dapat proven na totoo, bawal sinungaling lods.
- Anti terrorism law

5. Religion and Belief


- Walang pakialamanan sa religion
- Pagpapakita ng devotion ay okay lang unless di naaapektuhan moral laws.

6. Right to travel
- Pagtira sa chosen na lugar nang walang nangingialam
- Hindrance dahil sa COVID 19 saka terrorism

7. Right to access information


- Access sa official records, government documents
8. Right to form associations and unions
- Kahit nasa public/private sector na employee, pwede unless di lalaban sa batas.
9. No property shall be taken for public use with just compensation
- Dapat wastong kabayaran
10. No law impairing the obligation of contracts must be passed
- Bawal mag violate ng law para ma preserve ang kontrata.
11. Free access to the courts and quasi-judicial bodies and adequate legal assistance shall not be
denied to any person by reason of poverty

- Sa mga offenders, dapat iinform yung rights niya in court.

13. All persons, except those charged with offenses punishable by reclusion perpetua when
evidence of guilt is strong, shall, before conviction, be bailable by sufficient sureties, or be
released on recognizance as may be provided by law. The right to bail shall not be impaired even
when the privilege of the writ of habeas corpus is suspended. Excessive bail shall not be
required.

- Pwede kahit suspended by writ of habes corpus ang privileges.
14. No person shall be held to answer for a criminal offense without due process of law.
*Due process-is the legal requirement that the state must respect all legal rights that are owed
to the person. Due process balances the power of the law of the land and protects the individual
person from it.
Substantive (focused sa batas at nakaayon sa sitwasyon, regulation of certain activities and
confiscation sa mga medium na ginamit sa crime) and procedural process (paglilitis, analysis ng
court)
15. The privilege of the writ of habeas corpus shall not be suspended except in cases of invasion or
rebellion, when the public safety requires it.
16. All persons shall have the right to a speedy disposition of their cases before all judicial, quasi-
judicial, or administrative bodies.
17. No person shall be compelled to be a witness against himself.
18. No person shall be detained solely by reason of his political beliefs and aspirations.
19. Excessive fines shall not be imposed, nor cruel, degrading or inhuman punishment inflicted.
Neither shall death penalty be imposed, unless, for compelling reasons involving heinous crimes,
the Congress hereafter provides for it. Any death penalty already imposed shall be reduced to
reclusion perpetua.
20. No person shall be imprisoned for debt or non-payment of a poll tax.
21. No person shall be twice put in jeopardy of punishment for the same offense. If an act is
punished by a law and an ordinance, conviction or acquittal under either shall constitute a bar to
another prosecution for the same act.
22. No ex post facto law or bill of attainder shall be enacted.
